SPECIAL MEETING
OCTOBER 6, 2006
The special meeting of the City Council of the City of
Apache Junction, Arizona, was held on October 6, 2006, at the
Apache Junction City Council Chambers pursuant to the notice
required by law.
CALL TO ORDER
Mayor Coleman called the meeting to order at 4:00 p.m.

THAT WE IMMEDIATELY ADJOURN TO EXECUTIVE SESSION IN THE CITY
COUNCIL CONFERENCE ROOM FOR THE PURPOSE OF CONSIDERATION FOR
LEGAL ADVICE WITH THE CITY ATTORNEY.

Councilmember Waldron SECONDED THE
MOTION.
VOTE:Unanimous.
The motion carried.
The council immediately adjourned to the city council conference
room for purpose of an executive session.
Mayor Coleman reconvened the meeting at 4:33 p.m.
RESOLUTION NO. 06-52, NOTICE OF
INTENT TO ENTER INTO A RETAIL
DEVELOPMENT TAX INCENTIVE AGREEMENT
WITH APACHE JUNCTION TOWN CENTRE
L.L.C.

Hoffman briefed the council on the item.He stated he and the
mayor had met earlier in the week with the development partners
for this project.They had a positive and productive
negotiation session.Tonight they have a step that would allow
them to move forward in considering a development agreement.
The city attorney can talk about the specifics of this.In sum,
what was discussed was the utilization of retail sales tax as
being a mechanism for insuring that the investment that the
developers will be making in public infrastructure can be repaid
to them.Because it references a tax incentive, there is some
law involved.It will require a 14 day posting period.
City Attorney Joel Stern
commented pursuant to A.R.S. § 9-500.11, when a city or town
desires to enter into a retail development tax incentive
agreement they must adopt a notice of intent to enter such
agreement at least 14 days before they vote on and approve a
similar development agreement.Resolution No. 06-52, which has
whereas clauses setting up how they got here, has Attachment A
which is the notice.It is essentially a legal mechanism to go
on to the next step, which is to get it done timely, especially
since there has been very positive negotiations with the
developer.

City Manager George Hoffman
commented if council were willing to do it, they could
contemplate a special meeting for Monday, October 23.They
could do that at the next regularly scheduled council meeting.
City Attorney Joel Stern
stated they would put an item on there.It is actually already
on there under future meetings, but they can do that.
Mayor Coleman commented the
use of tax incentives is kind of the idea behind redevelopment
areas and creating one in the first place.It was created 7
years ago and it is coming to fruition right now.He
appreciates all the work that staff has done to get us to this
point.He called for any discussion from the council.There
being no discussion, he called for a motion.
Councilmember Dietz asked if
this is a public hearing.
City Attorney Joel Stern
stated it is not.It is not open to the public for public
comment.
Councilmember Waldron MOVED
THAT RESOLUTION NO. 06-52, A RESOLUTION OF THE MAYOR AND CITY
COUNCIL OF THE CITY OF APACHE JUNCTION, PINAL COUNTY, ARIZONA,
ADOPTING A NOTICE OF INTENT TO ENTER INTO A RETAIL DEVELOPMENT
TAX INCENTIVE AGREEMENT FOR THE SUPERSTITION SQUARE DOWNTOWN
PROJECT WITH AJ TOWN CENTRE, L.L.C., BE APPROVED.
THE MOTION.
VOTE:Unanimous.
The motion carried.
