AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING
THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-26-86 FROM GR GENERAL RURAL TO
CR-5/PD MULTIPLE FAMILY RESIDENCE ZONE BY PLANNED DEVELOPMENT;REPEALING
ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
1.The zoning district classification on the Zoning District Map,City of
Apache Junction,Arizona,for the parcels of land described as:
Lot 5 and Lot 8 i n Section 18,Township 1 North,Range 8 East,Gila
and Salt River Base and Meridian,Apache Junction,Pinal County,
Arizona
be and hereby i s amended from GR General Rural to CR-5/PD Multiple Family
Residence Zone by Planned Development.
2.The approval of the zoning district classification shall be construed
as only concept approval for the base zoning and shall serve as official
approval of the base zoning amendment to the Zoning Map.
3.Development of said property shall be i n accordance with the provisions
of Article 19 of the Zoning Ordinance.The provisions of the Uniform
Building Code and all other City codes,policies,guides,and detailed
standards shall apply and control all design and construction of improve-
ments.
4.The applicant dedicate the North fifty feet (50')and the East thirty-three
feet (33')of Parcel 1,and the South thirty-three feet (33')and the
East thirty-three feet (33')of Parcel 2 for public roadway and associated
purposes along with a twenty foot (20')by twenty foot (20')cutoff at
intersections.
5.That plans for landscaping be included as a part of the zoning requirement.
The plans for landscaping be included i n the preliminary plan approval
process.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances i n conflict with the provisions of
this ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,sub -section,sentence,phrase,clause or portion of this
ordinance or any part of the code adopted herein by reference i s for any
reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction,such decision shall not affect the validity of
the remaining portion thereof.
