OCTOBER 2,2001
The regular meeting of the City Council of the City of Apache Junction,
Arizona,was held on October 2,2001,at the Apache Junction City Council
Chambers pursuant to the notice ,required by law.
CALL TO ORDER
Mayor Coleman called the meeting to order at 7:00 p.

Vice Mayor Surra gave the Invocation.

CALL TO THE PUBLIC
Councilmember Urich SECONDED THE
Mr.Raymond Blevins,730 W.Southern Avenue,Apache Junction,addressed the
council regarding the flooding in his area.He thanked the city staff for
their assistance with his problem over the last ten years and their continuing
commitment to solve the problem.He commented his house was built in 1981 so
the city had to have issued the permit for his house to be built and others in
the area.This would have been a city problem at that time.
Ms.Lisa Twigg,711 W.23rd Avenue,Apache Junction,addressed the council
regarding flooding in her area.She thanked the city for its attention to the
flooding.She commented Ron Grittman had stated at the work session that the
flooding problem is more serious at San Marcos and Southern than where the
water flows through her property,the Blevins property and the properties
behind them.However,some of the water emptying into San Marcos and Southern
comes from her property and the alley behind her.As block walls have been
constructed,the water will not be able to drain in that direction and it will
back up on her property.They have had water come in their house and garage
and have videos of past floodings.They had agreed to the storm drainage
easement on the east side of their property when it was purchased in 1991,but
they were unaware their entire property was a wash.They have been told their

house was build 1.5'too low.As the city issued the building permit,she
believes the city should take responsibility for her house being built too
low.
Mr.Dan Wald,3400 S.Ironwood Drive,#260,Apache Junction,addressed the
council to thank them for passing the economic development agreements for the
Chamber of Commerce and the Main Street Program.He encouraged the council to
consider acquiring certain properties along the city corridor that would
enhance economic development.Many of them are currently privately -owned and
they have been difficult in allowing various businesses to have appropriate
access.There are programs available in other states they might want to
research,such as the North Dakota Future Fund,the Minnesota Future Fund,the
South Dakota Future Program,the Wyoming Future Program,and others in Arizona
and California.A key element in those programs is a 1%sales tax dedicated
to economic development.
Ms.Jane Blanton,455 E.Junction,Apache Junction,addressed the council
regarding massage therapy.She agrees with the city standards for massage
therapists and the vice mayor's concerns for training and potential harm to
the citizens.She briefed the council on her qualifications and requested
being grandfathered in by having her Mesa license honored.
Vice Mayor Surra asked staff to report back on any reciprocal agreements the
city may have about acknowledging prior licenses from other cities that have
similar standards.It would then be put on an agenda if necessary.
CITY MANAGER'S REPORT
City Manager Curtis Shook commented the state is entering a period of
recession.All East Valley communities are experiencing a drop in revenues
from sales tax.Additionally,the governor is intending to cut the state-
shared revenues by 4%,but it actually works out to 8% to 10%.It would mean
a loss of approximately $250,000 for Apache Junction.The city is down about
10%in the first quarter of this year and we are looking at cash flow
measures.The governor is calling for a special session around November 14
regarding the state -shared revenues and he will continue to track the issue.
The city should be given the opportunity to speak on what such a loss would
mean.He commended the council for their foresight in doing the budget by not
adopting the census -enhanced state -shared revenues.He believes the city has

positioned itself so it does not have to be very worried,but they do have to
be circumspect in what they do.

DIRECTION TO STAFF REGARDING CURRENT
CITY REQUIREMENTS FOR MASSAGE THERAPISTS )
)City Clerk Kathleen Connelly
briefed the council on the item.There are no state regulations on this issue
at this time.She gave a summary on other cities'requirements and the
definition of what is a recognized school of massage.She commented the city
does have a provision in the code for people with licenses from other cities
but i t is conditional.No massage therapist shall be issued a license if the
applicant fails to furnish a diploma or certificate of graduation from a
recognized school of massage.However,a license may be issued if the
applicant has been licensed to perform any massage or touching techniques in
another city or state for two successive years and such license has not been
revoked,suspended or denied renewal on the grounds of misconduct by the
applicant,provided such applicant presents a diploma or certificate of
graduation from a recognized school of massage together with a transcript of
completed courses.
Vice Mayor Surra asked if the
license would still have to be in effect.

City Clerk Kathleen Connelly stated
that is not what the city code states.
Vice Mayor Surra commented i t does
not say anything about if it has lapsed,only if it was lost through whatever.
City. Clerk Kathleen Connelly
commented i t states if it was revoked,suspended or denied on the grounds of
misconduct.
Vice Mayor Surra commented if it had
lapsed due to a move or something,they could still look at the license i f
they had attended a school.
City Clerk Kathleen Connelly stated
1-Lwould have to meet our definition of.a school.
Vice Mayor Surra.askedjf that would
be thecase if the license was issued when that school may not have had the
credentials,but now has them.
City Clerk Kathleen Connelly stated
it would have to be the same school.It cannot be a subsequent school as the
criteria may be different.The applicant must have proof of being licensed by
other communities for two years,present a diploma or certificate of
graduation from a school of massage that has rules that match up with ours,
and have a transcript of the completed courses.
Mayor Coleman asked how long the
Arizona •State Board of Private,Technical and_Business:Schools and the Arizona
State Post Secondary Board of Education had been in existence.
City Clerk .Kathleen Connelly was
uncertain but commented some of the old ordinances on the books have those
entities mentioned.

no .possibility of an applicant thattad attended a school ,from-long ago that
was not officially recognized,even though they had a license elsewhere,being
able to be licensed here since the school is not recognized:...

City Clerk Kathleen Connelly stated
the surrounding communities have the same criteria and definition of a
recognized school of massage as Apache Junction does.
Vice Mayor Surra commented if they
have had a license somewhere else they probably have gone to a school that met
the definition.
City Clerk Kathleen Connelly stated
that is correct.If they were licensed by that jurisdiction,they would have
had to fulfill that definition.
Vice Mayor Surra asked what would
have happened if they did not.
City Clerk Kathleen Connelly stated
they would not have been given a valid license.

looked at on a case by case basis.

understood that when Mesa changed their requirements to include graduation or
a certificate from a recognized school that they grandfathered some i n at that
time.
City Cleric Kathleen Connelly stated•
that was for -a limited .grandfathered -period.They did not change their
definitions,but changed the hours required.People who had licenses under
the old rules were.allowedto operate for a limited period of time in -order to
bring up their number of hours.Once that time had elapsed,those individuals.
that,had not met!the:new educational hours could not,have their licenses
renewed.Tempe did the same thing.
Vice Mayor: Surra commentedAhat
means that someone could have lost their city license;elsewhere ,fdr other than
misconduct.

that is correct.
Mayor Coleman commented he believed
her recommendation would be to keep the code the way i t is now but review it
periodically.
City Clerk Kathleen Connelly stated
they would be automatically reviewing it.If something is adopted by the
state,it would be brought to council.She commented the League would
probably be very active in drafting any changes to be made since so many
cities have something on the books regarding this.She added if Ms.Blanton
could produce a diploma and the transcripts,she believes she would qualify
under the ordinance.However,she needs to produce the documentation.

MASSAGE THERAPISTS:WE MONITOR FOR CHANGES IN ANY CHANGES IN STATE LAW AND
UPDATE OUR ORDINANCE AS NEEDED;AND TO GATHER ANY OTHER RECIPROCITY ITEMS THAT
MAY NOT MEET OUR STANDARDS BUT THAT OTHER CITIES ARE USING OTHER THAN OUR OWN
STANDARD JUST SO WE CAN COMPARE.

DIRECTION TO STAFF REGARDING FLOODING
ISSUES IN THE VICINITY OF SOUTHERN
REGULAR MEETING OF THE CITY COUNCIL

)Councilmember Eck commented he
believes everyone would like to get this fixed as soon as possible,but i t
will be an ongoing problem.He asked for this to be on the agenda to
determine if there was anything the city could do for a short time remedy
while the master plan is being worked on.
Vice Mayor Surra commented she was
concerned that the two areas that were discussed at the work session and their
representatives have a varying opinion as to the obligation that the city has
to solve their problem.If the permits were issued through city offices,then
there should be a record of a drainage plan that was passed.
City Engineer Ron Grittman stated
the subdivision actually started construction in 1972.That is when the roads
were put in.I t has taken decades to construct all the homes in the area.
The Twigg property was probably one of the last built in the area.The
issuance of a permit regarding flooding issues typically only applies to areas
within an established FEMA flood plain.The finished floor elevation must be
one foot above the 100 -year storm event.This area is not within a FEMA flood
plain or anything the city would have mapped at that point.He commented i t
is inadvertent that the homebuilder did not build the home 1.5'higher.If he
had,they would not be having this problem.Mr.Blevins would still have his,
but not the Twiggs.The city has no ability to determine what the finished
floor elevation is unless its within a mapped flood plain.
Vice Mayor Surra commented that the
fact that i t looks like i t sits in the middle of a wash has no bearing.
City Engineer Ron Grittman stated i t
has not been mapped to determine how big the wash is or the height of the -
water.
Vice Mayor Surra stated she
recognized the lack of information available at that time but i t does not meet
with her satisfaction.
City Engineer Ron Grittman stated
the only requirement to establish that elevation is when you are in the Waters
of the United States.This small wash running through the neighborhood is not

considered one of the Waters of the United States.Engineering could
determine the elevation of those waters,but i t is a matter of time and money.
Vice Mayor Surra asked if the
drainage study will give them information on this wash.
City Engineer Ron Grittman stated i t
will tell the volume of water that the city will be dealing with.It will not
determine the elevation the water will rise to during a storm event.
Vice Mayor Surra asked if the
information supplied in the drainage study would assist in the calculation of
the elevation.
City Engineer Ron Grittman stated
elevation studies are very detailed surveys.They would map down to less than
an inch what the elevation is and all of the structures around it.I t
requires an inordinate amount of money.
Vice Mayor Surra asked if they might
want to do that for those identified areas,not for the whole city.She
believes they need the additional study for those areas.
City Engineer Ron Grittman stated
the current engineering staff is capable of doing that level of analysis.
However,if this is done other projects, :including roadway projects,would not:
get designed.I t is a matter ofpriorities.He would like tO find the volume
of water they will be dealing with and then he can put in pipes that will
handle the flow,
Vice Mayor Surra commented that
would reduce the height going into the area.-
City Engineer Ron Grittman stated
that is correct.He needs to determine the volume rather than the height.
Councilmember Dietz asked if the
study will tell how much water is running down 23rd Avenue to Buena Vista and
that would tell them what kind of action to take.

City Engineer Ron Grittman stated
that is correct.
Councilmember Dietz asked if they
would have known this from past history.
City Engineer Ron Grittman stated
the drainage studies they have were all done about fifteen years ago.The
last water master plan wasJione_in 1984.It does not specifically identify
this particular corner.The problem did not exist at that time as most of the
houses were not built and the water did not flow through there.A lot of the
studies were done before the current level of development.
Councilmember Dietz asked if all of
the water at this corner is being generated by their subdivision and the
southwest end.
City Engineer Ron Grittman showed
them on a map how the water flows.:They are seeing water coming from within
their neighborhood and upstream of their neighborhood.
Councilmember Milkey stated he
agreed with CouncilmemberEck.He would like to find a short term fix for the
problem until the study: is complete:He invited input-from -the:neighborhood,
such: as their knowledge of fa new channel that the water could be diverted to.
Councilmember Dietz suggested: they
try to do something about all of the washes that ,th&city has repeated
flooding With..It:may be years down the Toad befOre they can get everything
takencareof if they wait for the master plan.

they are only starting it once they getthe:study done:
Councilmember Dietz commented they
have people here, on Delaware, Tepee.and Other plates that are ,constantly:
getting flooded out wit-revery storm we have.:We have to lookilard ,at some
short term solution.

City Engineer Ron Grittman:stated
they can come up with a solution,: but it ,is a matter of funding. •
Councilmember Dietz stated they need
to figure out how much i t is going to cost and then do what they need to do.
He feels the city needs to do something.
Councilmember Milkey asked if they
can expedite the study.
City Engineer Ron Grittmarrstated
they are moving as quickly as they can.Kimley-Horn is aware of the
importance of this and the problems thecity has.
Vice Mayor Surra.asked if they could
go for the larger -sized boxes to handle the volume now instead of waiting -for
the results of the study.If it is More than the city needs,than i t is more
than the city needs.'
City Engineer Ron 'Grittman stated
those larger boxes would cost more.Hecommented this area mould take
$500,000 if council wanted t!cYset that priority on it •
Vice Mayor Surra commented waiting-
seems bad.She ,would lik&to get Started on those areas already identified
and put the larger boxes in.;.They Might be ,,able ,to make up the costs at
locations later,on where they KnOwlfie exact volumes..:
City Engineer Ron GrittMan'commented
they will have to decide:whatJeyel of protection i t should be built to.He
is not aware of any city building to convey all the water in a 100 -year storm
event:I t is not affordable.They need to decide on whetherto fiandle 25-
year or 504year ,storms.Structures should convey the :100 -year storm,but i t
is a matter b-reconomics:If they :put too large a box in ,one area,costing
the city an additional $150,000 that is money: that coulckhaveteenused in
another area toiresolVe another problem:He would rather'try to size and
expend the appropriate, amount of mOney to find the prOpersolution for the
area.

Vice Mayor Surra suggested some of
the money from the Southern and San Marcos area could be given to the 23rd
Avenue area.They supposedly get some of their runoff so it would lessen the
runoff.
City Engineer Ron Grittman stated
funding sources will be coming out of the master plan.Council will decide at
that point which ones to use.
Vice Mayor Surra asked if they are
adjusting the development fees so that they could be used for this type of
improvement,or is there a development fee that could be used for this type of
improvement.I t appears that when new subdivisions are built,they impact the
previous residents flooding.
City Engineer Ron Grittman stated
new homes are required to deal with their own problems.He is concerned that
if they collect utility funds from developers without being in the storm water
business,they might not have the authority to expend them.
Vice Mayor Surra suggested when
roads are torn up to put in the boxes,road funds could be used to repave the
roadway.
Councilmember Dietz asked if there
are grants available.
City Engineer Ron Grittman stated
there are.Superstition and Broadway both had extensive storm drain systems
put in within the first few miles using bond money.

City Manager Curtis Shook commented
they can ask the development fee consultant if it is legal to charge a
development fee for this issue.If so,they can ask for one to be included.
The problem is a lot of the major washes in the northeast and northwest are
not under city control:they are individually owned.The city has been trying
to get those owners to give the drainage channels to the city for maintenance.
Mayor Coleman closed the discussion

Councilmember Eck MOVED THAT STAFF
CONTINUE TO ALLEVIATE THE FLOODING ISSUES IN THE VICINITY OF SOUTHERN AVENUE
AND SAN MARCOS TO STAFF'S CURRENT,FULLEST POTENTIAL,MEANING PLEASE KEEP
BRAINSTORMING,DOING WHAT WE'RE DOING AS FAR AS WEED CONTROL AND TYPE OF
BERMING,FOR THE SHORT TERM,AND THEN INFORM MAYOR AND COUNCIL AS SOON AS
POSSIBLE WHEN THE CITY-WIDE DRAINAGE STUDY IS COMPLETE AND WHAT THOSE
RECOMMENDATIONS ARE.

DISCUSSION AND DIRECTION TO STAFF
REGARDING DOG RUN AT PROSPECTOR PARK
)Councilmember Urich commented she
would like staff to check with other cities for possible ideas.She stated we
may be the only city in the East Valley that does not have one.
Vice Mayor Surra stated she would
like to see if this could be worked into one of the park improvements.She
would not like to see i t restricted to Prospector Park,but for i t placed
where and when i t is most suitable and feasible.
Councilmember Urich commented she
was willing to make that change.

liability and legality was included in her motion.
Councilmember Urich stated they are.
Councilmember Eck commented he
believes this should be brought before the Parks & Recreation Commission for
their ideas.
City Clerk Kathleen Connelly read a
comment from Councilmember Durbala regarding this item.He had asked that i t
be read into the record:
"I feel that we should be more concerned with having more things
for our children first before we worry about dogs.I feel that
the other hand ball courts are a better way to spend money or an
exercise run for adults to be a better use of funds at this time.
Mayor Coleman asked Jeff Bell
to address the council.
Parks & Recreation Director
Jeff Bell commented he has some information at hand on dog parks in the
neighboring communities.He appreciated Councilmember Eck's suggestion
on having the Parks & Recreation Commission give input on the issue.
They will be updating the long range improvement program and this will
be added.Upon completion,they will share the information with the
council.
Mayor Coleman closed the

Governments meeting- last Wednesday,Councilmembers Milkey and Urich ,were in
attendance He thanked Bryant Powell,and Shari Watson and other staff
involved in finding the location and providing the meal.

application for a grant to the Arizona Department of Transportation for
participation in the FY 2002 Local Transportation Assistance Fund Program.
5. _Consideration of Bid Award for PR 0I-04:Landscape Maintenance for
Renaissance Point,Arroyo Verde,Phelps Drive and Ironwood COve Landscaping
in an amount not to exceed $80,520.00.
6.Consideration of Bid Award for PW 2001-26,Self -Propelled Road Sweeper,to
RDO:Equipment Company in the amount of $35,649:17 plus applicable sales
tax.
7.Consideration of Economic Development Agreement with Apache Junction
Chamber of Commerce for Fiscal Year 2001-2002.
8.Consideration of Economic Development Agreement with Apache Junction Main
Street Program Inc.for Fiscal Year 2001-2002.
