CALL TO ORDER Mayor Coleman called the meeting to order at 7:00 p.m. INVOCATION Councilmember Milkey gave the Invocation. PLEDGE OF ALLEGIANCE Councilmember Dietz led the Pledge of Allegiance. AWARDS,PRESENTATIONS AND COMMUNICATIONS Mayor Coleman read a proclamation designating November 11,2001 as the date for the Veterans'Day Parade.Mr.Robert McKinney accepted the proclamation and thanked the council for allowing the parade to be moved to Apache Trail. CALL TO THE PUBLIC Mr.Elliott Fisher,547 E.Quail,Apache Junction,Greater Apache Junction Association for Effective Government,addressed the council regarding the Altug claim against the city,his complaint on certain items being included on the consent agenda that he feels merit a public hearing,his opinion on the jobs the city manager and city attorney have done while in office,his capital facilities plan lawsuit,and his complaint filed on the last election. Mr.John Insalaco,1570 S.Buena Vista,Apache Junction,addressed the council regarding weeds on Idaho.He was just informed that city crews have been taking care of the problem over the last three days.He commented nothing helps beautify the city more than to keep it clean.He added a human resources department for any city,corporation or agency is supposed to work towards helping the employees.He has heard that this one is a "headhunter" and gives answers that if an employee does not like it,they can leave.The department needs to have a little more tact when addressing good city employees. CITY MANAGER'S REPORT City Manager Curtis Shook commented Governor Hull's proposal that includes a 4% cut in state -shared revenues to all cities and towns will be heard tomorrow in the senate.Many cities and towns will be represented and he will also be attending.The hearing is to determine and take testimony on what such a cut might mean to the cities and towns.There are sizable issues involved with this. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 16,2001 PAGE 4 OF 12 PUBLIC HEARINGS APPLICATION FOR A SPECIAL EVENT LIQUOR LICENSE FOR THE APACHE JUNCTION/GOLD CANYON ROTARY #1246 FOR LOST DUTCHMAN DAYS/APPLICATION FOR A SPECIAL EVENT LIQUOR LICENSE FOR THE APACHE JUNCTION/ GOLD CANYON ROTARY #1246 FOR SUPERSTITION MOUNTAIN STAMPEDE )City Attorney Joel Stern stated the public hearings could be done together on these items but the motions must be separate. City Clerk Kathleen Connelly briefed the council on the items.These are two separate license applications for two separate events.The Stampede takes place next month,Lost Dutchman Days takes place in February 2002.Information from the police department, planning division and the fire district was included in the packet and there are no objections.The applicant is present for any questions. Mayor Coleman requested the applicant address the council. Mr.Gary Selvy,817 E.Granada, Apache Junction,addressed the council to answer any questions. Councilmember Eck commented these are annual events. Mr.Gary Selvy stated they have been for the past 8 to 10 years. Mr.Gary Mulholland,710 S.Muleshoe Road,Apache Junction,commented they have some changes to the Stampede this year.They have a different carnival this year.They will be visiting the elementary schools from November 16 on to discuss the western lifestyle and rodeo.They will have free admittance for all Apache Junction students for the Stampede. Mr.Elliott Fisher,547 E.Quail, Apache Junction,addressed the council.He commented the city is giving out a lot of special event liquor licenses and he wondered if that would continue. He asked what is classified as a special event and if his organization would qualify for one if he applied. Mayor Coleman closed the public hearing with no one else wishing to speak.He reopened the item to council discussion. Councilmember Durbala asked if Vice Mayor Surra would volunteer to assist at the event as she did last year.He commented he would like to tell them that they could count on the two of them assisting this year. Vice Mayor Surra stated she would. She added she does believe the special events will continue,and anyone who comes before them with an application appropriately filled out,meeting all the requirements,and is willing to be a part of a special event will get the same consideration. Mayor Coleman closed the discussion and called for a motion. ASKED QUESTIONS"FOR CITY DEPARTMENTS ) )Councilmember Urich commented this had been:discussed .at the work session last night and she was ready to . make a motion. Councilmember Durbala asked .if she was looking for something similar to the pamphlet he had provided from West Peoria,Illinois.Some of the questions included in it could create a legal problem,so they should go through this. Councilmember Urich commented she had gone through i t but she would like to let staff make the -determination on: what should be included. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 16,2001 PAGE 7 OF 12 Vice Mayor Surra commented she believes having a brochure and other materials available for mail out or hand out is a good idea.She would also like to see information placed on the cable channel and the web site.She would like to see staff research and determine if that is feasible.She commented she believes several departments have already been working on some of this per an earlier direction to staff. The brochure could be distributed to new residents. Councilmember Durbala commented i t could be given to people who write for information on the community.He added he had given a copy of the Illinois brochure to Dean Svoboda who liked i t and thought it was pretty explanatory.The previous one they had been working on only included phone numbers. Mayor Coleman closed the discussion and called for a motion. Councilmember Urich MOVED THAT STAFF BE GIVEN THE FOLLOWING DIRECTION REGARDING "FREQUENTLY ASKED QUESTIONS"FOR CITY DEPARTMENTS:THAT STAFF COMPILE A LIST OF FREQUENTLY ASKED QUESTIONS FROM ALL CITY DEPARTMENTS -AND,DETERMINE THE MEANS TO DISSEMINATE THE SAME THROUGH USE OF THE CITYSCAPE COMMUNITY MAGAZINE,BROCHURES',CITY'S WEB SITE AND CITY'S_CABLE CHANNEL AND REPORT INFORMATION BACK TO COUNCIL. Councilmember Dietz SECONDED THE MOTION. VOTE:Unanimous. The motion carried. DIRECTION TO STAFF REGARDING TRAIL OF FLAGS )Councilmember Urich commented she did not believe the council would support the idea at this time of displaying the Trail of Flags during the nation's crisis.She did not wish.to make a motion. Vice Mayor Surra commented she has a substitute direction to give.SHE MOVED THAT STAFF BE GIVEN THE FOLLOWING REGULAR MEETING OF THE CITY COUNCIL OCTOBER 16,2001 PAGE 8 OF 12 DIRECTION REGARDING THE TRAIL OF FLAGS:AND THAT IS THAT WE USE THE SUGGESTED DATES THAT WERE LISTED IN THE MAYOR'S REPORT LAST NIGHT THAT HE READ,WHICH INCLUDES MORE DATES THAN THE ONES WE ORIGINALLY HAD IN THE NUMBER OF TIMES THAT WE WOULD FLY THE FLAGS,AND I WOULD LIKE TO SEE THOSE DATES FOLLOWED.I AM NOT CONCERNED ABOUT THE ILLUMINATION WHEN WE KEEP THEM UP OVERNIGHT FOR THOSE,LIKE WHEN WE KEEP THEM UP FOR A FEW DAYS OVER A WEEKEND OR SOMETHING DURING PARADE TIMES AND LOST DUTCHMAN DAYS AND ALL THAT,BUT I DO THINK THAT WE DON'T USE ALL OF THE DATES THAT WERE LISTED IN THAT REPORT YOU GAVE LAST NIGHT.AND I WOULD LIKE TO SEE US TRY TO GET THE STAFF,TO GIVE DIRECTION TO THEM TO FIND OUT IF IT WOULD BE FEASIBLE FOR US TO PUT THOSE UP MORE THAN WHAT THEY ARE NOW. SELECTION OF MEETING DATES,TIMES,LOCATIONS,AND PURPOSES Councilmember Dietz MOVED THAT AN EXECUTIVE SESSION AT 6:00 P.M.AND WORK SESSION AT 7:00 P.M.BE HELD ON MONDAY,NOVEMBER 5,2001,IN THE CITY CONFERENCE ROOM AND CITY COUNCIL CHAMBERS RESPECTIVELY:AND THAT AN EXECUTIVE SESSION AT 6:00 P.M.BE HELD ON TUESDAY,NOVEMBER 6,2001, IN THE CITY CONFERENCE ROOM. Vice Mayor Surra SECONDED THE MOTION. VOTE:Unanimous. The motion carried. INFORMATION AND REPORTS Mayor Coleman announced that Chief Warner,Councilmember Durbala and their wives won second place in the Boys and Girls Club Golf Tournament. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 16,2001 PAGE 9 OF 12 Mayor Coleman announced that Vice Mayor Surra represented the city at the League of Cities & Towns Resolutions Committee and all three of the city's proposed resolutions were passed and will be considered at the conference at the regular Resolutions Committee meeting.He was impressed that she able to represent the city that well and get the ideas across that well. Vice Mayor Surra commented that Councilmember Durbala has annually brought forward resolutions that he has felt would have the opportunity for passing. This year they were three very good ones that were presented and her arguments were minimal.He seemed to know how everyone on the committee would feel about these resolutions and he made the city look good. Mayor Coleman commented they had a joint city council meeting with the City of Mesa last Tuesday and he thought it was very productive in the areas of planning and transportation needs.He thanked the entire council for being there and speaking well. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 16,2001 PAGE 10 OF 12 6.Consideration of Resolution No.01-20,Accepting dedication of land to the City of Apache Junction for right-of-way and easements for City purposes in conjunction with street improvement projects on Superstition Boulevard, Ironwood Drive,Broadway Avenue,and other miscellaneous right-of-way. 7.Consideration of renewal of Professional Services Agreement with Williams and Associates for lobbying activities in an amount of $2,916.67 per month through December 31,2002,and authorization for Mayor to sign subject to approval of City Attorney. 8.Consideration of Professional Services Agreement with G & C Aviation Consulting,Inc.for professional consulting services regarding aviation issues in an amount of $1,000 per month through June 30,2002,and authorization for Mayor to sign subject to approval of City Attorney. 9.Consideration of award of bid for Project PW 2001-30,Construction of concrete work and related improvements on Cactus Road from Baseline Avenue to Auto Center Drive to Down to Earth Contracting,Inc.in the amount of $75,469.20 plus 10%for unforeseen changes for a total amount not to exceed $83,016.12. 10.Consideration of authorization for purchase of right-of-way in the amount of $16,000.00 from Jakob and Myriam Shechter on Ironwood Drive between Apache Trail and Superstition Boulevard in conjunction with the City's street improvement project.
