AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING
THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-38-86 FROM GR GENERAL RURAL TO
C-3/PD GENERAL COMMERCIAL DISTRICT BY PLANNED DEVELOPMENT;REPEALING ANY
CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
1.The zoning district classification on the Zoning District Map,City of
Apache Junction,Arizona,for the parcels of land described as:
The North i of the Northeast i of the Northeast A of the Southwest
of Section 27,Township 1 North,Range 8 East,Gila and Salt River
Base and Meridian,Apache Junction,Pinal County,Arizona
be and hereby i s amended from GR General Rural to C-3/PD General Commercial
District by Planned Development.
2.The approval of the zoning district classification shall be construed
as only concept approval for the base zoning and shall serve as official
approval of the base zoning amendment to the Zoning Map.
3.Development of said property shall be i n accordance with the provisions
of Article 19 of the Zoning Ordinance.The provisions of the Uniform
Building Code and all other City codes,policies,guides,and detailed
standards shall apply and control all design and construction of improve-
ments.
4.Rezoning applichction materials for remaining property as shown on the
site plan to General Commercial District by Planned Development (C-3/PD)
must be submitted within 60 days.They may leave out the southernmost
parcel until i t i s acquired by them.An application for C-3/PD for this
parcel must be filed within 60 days of the time this last parcel i s acquired.
5.All of the properties being acquired must be legally combined into one
parcel.
6.Application materials for the abandonment of East 17th Avenue,East 18th
Avenue,and South Bowman Road within the limits of the project must be
submitted within 60 days.
7.No grading or site preparation commence until just prior to the start
of construction.
8.Developer relocate or preserve native vegetation where reasonably possible.
9.Applicant dedicate the North forty feet (40')and the East forty feet
(40')of the subject site for public roadway and associated purposes
along with a twenty foot (20')by twenty foot (20')cutoff at the intersec-
tion of E.16th Avenue and S.Cortez Road.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,sub -section,sentence,phrase,clause or portion of this
ordinance or any part of the code adopted herein by reference i s for any
reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction,such decision shall not affect the validity of
the remaining portion thereof.
