AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AMENDING THE CITY OF APACHE JUNCTION COMMUNITY
SERVICES DEPARTMENT FACILITY USE MANUAL;REPEALING ANY CONFLICTING
PROVISIONS;PROVIDING FOR SEVERABILITY;AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,AIRZONA,AS FOLLOWS:
SECTION I IN GENERAL
That certain document known as the CITY OF APACHE JUNCTION COMMUNITY SERVICES
DEPARTMENT FACILITY USE MANUAL,three (3)-copies of which are on file in the
office of the City Clerk,which was made a public record by Resolution No.86-08,
is hereby amended as follows:
USER CATEGORIES
D.All organizationsmusthave a facility permit issued by the Community
Services Department and shall have liability insurance with the following
criteria:
1.City of Apache Junction to be named as additional insured.
2.Comprehensive liability of none per person,and none per incident,for
uses as designated.
3.Property damage of none for uses as designated.
NOTE:Liability insurance i s waived for family,organization or company
picnics.Uses other than those designated to request City Council
'consideration.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
Ordinance or any part of the Code adopted herein by reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this Ordinance
or any part of the Code adopted herein by reference is for any reason held to be
invalid or unconstitutional by the decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions thereof.
SECTION IV EMERGENCY CLAUSE
I t being necessary for the preservation of the peace,health and safety of the
City of Apache Junction,Arizona,that this ordinance become effective immediately,
an emergency i s hereby declared to exist and this ordinance shall be effective
immediately upon its passage and adoption.
