AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING
THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-41-86 FROM CR-5 MULTIPLE FAMILY
RESIDENCE ZONE TO C-2 LOCAL COMMERCIAL DISTRICT;REPEALING ANY CONFLICTING
PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map,City of Apache
Junction,Arizona,for the parcels of land described as:
the South of the Southwest *of the Southwest *of the Southeast
*of Section 18,Township 1 North,Range 8 East,Gila and Salt River
Base and Meridian,Pinal County,Arizona;
EXCEPT the East 283 feet thereof;and EXCEPT the West forty feet
(40')and the South fifty feet (507—for public roadway and associated
purposes
be and hereby i s amended from CR-5 Multiple Family Residence Zone to C-2
Local Commercial District;subject to the following stipulations:1)applicant
dedicate a twenty foot (20')by twenty foot (20')cutoff at the intersection
of Superstition Blvd.and Delaware Dr.;and 2)applicant i s requested to
submit a site plan prior to development for approval by the Planning and
Zoning Commission.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances i n conflict with the provisions of
this ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,sub -section,sentence,phrase,clause or portion of this
ordinance or any part of the code adopted herein by reference i s for any
reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction,such decision shall not affect the validity of
the remaining portion thereof.
