REGULAR MEETING
APRIL 2,1996
The regular meeting of the City Council of the City of Apache Junction,
Arizona,was held on April 2,1996,at the Apache Junction City Council
Chambers pursuant to the notice required by law.
CALL TO ORDER
Mayor Coleman called the meeting to order at 7:00 p.m.
INVOCATION
Councilmember Surra gave the Invocation.

AWARDS,PRESENTATIONS AND COMMUNICATIONS
Mayor Coleman announced a proclamation designating April 1-6,1996,as
"Community Development Block Grant Week"and City Clerk Kathleen Connelly read
it into the record.

CITY MANAGER'S REPORT
City Manager Curtis Shook reported on the neighborhoods program and informed
that the next neighborhood meeting will be at Sierra Entrada,clubhouse,on
April 8 at 7:00 p.m.
PUBLIC HEARINGS
ORDINANCE NO.949,PZ-2-96,REZONING
REQUEST FOR THE RENAISSANCE POINT
SUBDIVISION,ARISTAR INVESTMENTS,
LLC.AND DELAWARE INVESTMENTS,LLC.
)Development Services Director
Larry Harmer briefed the council on this item.He described the location of
the development;stated that zoning would change from CR-3 to CR-3/PD (Planned
Development)and described the surrounding area and the proposed development.

Mr.Harmer stated that the Planning Commission denied the rezoning and listed
the reasons,as outlined in the staff report,and listed some of the staff's
recommendations in case the council wished to approve it.
Councilmember Barker stated there
was a concern that 16th Avenue would have a traffic impact and asked if that
would be widened.
Mr.Harmer explained that would be a
standard requirement at the time the units along 16th Avenue are going to be
built.
Councilmember Durbala inquired about
the lot sizes.
Mr.Harmer explained that lot sizes
are similar to those in Apache Villa.
Councilmember Durbala confirmed with
staff that this development was not age restricted.
Mayor Coleman called upon the
Mr.Kent Lay,applicant,offered to
Councilmember Barker inquired about
Mr.Lay replied that they plan to

do that from property line to property line but they would be willing to
extend that further only without curb and gutter.
Councilmember Barker confirmed with
Mr.Lay that the only entrance to the development during the first phase would
be off of Ironwood.
Mr.Lay added that they would also
improve Ironwood along that stretch.

Councilmember Surra inquired about
the time frame for completion of the development.
Mr.Lay replied they will start with
the project as soon as the plans are approved by the city and would like to
complete it by the fourth quarter of this year.
Councilmember Durbala asked if there
would be a turn lane into the subdivision.
City Engineer Gordon Grandy replied
there would be just the curb radius returns coming off from Broadway,but
there would not be any decceleration or acceleration lanes for this
subdivision.
Councilmember Surra inquired about
any architectural drawings of the houses.
Mr.Lay replied there were only
plans but no architectural drawings yet.
Councilmember Durbala asked if the
lots would be large enough to allow for a pool in the backyard.
Mr.Lay replied explained that even
though the lots are narrow,they will be deep with enough space for a pool.
Mr.Grandy stated that if the
developer is willing to extend the widening of 16th Avenue during the first
phase,other portions would have to be done at the same time because of the
amount of traffic that will be generated with the opening of Delaware to
Southern.
Mr.Lay replied they will honor that
request.
Mayor Coleman opened the public
hearing.
Mr.Gordon Haack,1695 W.13th
Avenue,spoke on behalf of Apache Villa homeowners.He spoke against this
item stating their main concerns were that the size of the lots and the
setbacks were too small,and requested a minimum of 7000 s.f.lots.
Mrs.Midge Conway,902 S.Ocotillo
Dr.,Apache Villa,Apache Junction.She spoke in favor of this item stating
that some of the houses in Renaissance Point would be bigger than those in
Apache Villa;that they would be attractive,high quality,it would only
enhance the property value in the area,and would help the community with
property taxes.

Mr.Alan Tom,6707 E.McKellips,
Mesa,stated his family owns land on the northwest corner of Ironwood and
Southern and spoke in favor of this development.
Mayor Coleman called upon anyone
else from the public who wished to speak.There being none,he closed the
public hearing.
Councilmember Durbala MOVED THAT

DISTRICT CLASSIFICATION IN REZONING CASE PZ-2-96 FROM CR-3 (CONVENTIONAL
SINGLE-FAMILY HOMES ON 7000 SQUARE FOOT MINIMUM LOTS)TO CR-3/PD (CONVENTIONAL
SINGLE-FAMILY HOMES BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING
PROVISIONS;AND PROVIDING FOR SEVERABILITY."

ORDINANCE NO.950,RESTRICTIONS ON USE
OF PUBLIC PROPERTY
)Public Safety Director Robert
Galloway briefed the council on this item.He reminded the council he had
made a presentation on this at the last work session and stated that this
would regulate the types of uses of public lands within the city.He stated
that some of the State land the city has bought is being used for permanent
camping and parking of RVs;that has led to the destruction and pollution of
vegetation in the area and represents a health hazard.He explained the
purpose of this ordinance and stated that it has been reviewed and agreed upon
by State officials,city staff,and people in the community.

Councilmember Hendricks was
concerned that human waste was going to be left behind.
The council discussed the
possibility of making people remove any human waste,trash,etc.at the time
they leave the site.
Chief Galloway replied there was the
question of whether or not a person was responsible for certain trash,etc.at
the site and it would be difficult to prove.
Councilmember Barker suggested to
make that a request at the time people are asked to leave and inform them
about citation for dumping trash.
Chief Galloway agreed.
Councilmember Hendricks suggested
that police officers provide the trash bags to people.
Councilmember Durbala suggested
passing this ordinance with the emergency clause.
City Clerk Kathy Connelly replied
that it had not been shown on the agenda with the emergency clause.
Chief Galloway stated that even
though this would not be effective until thirty days,they could start giving
people notice to get ready and staff could also get prepared to relocate
people.
Mayor Coleman opened the public
hearing.There being no one wishing to speak on this item,he closed the
hearing.

NEW BUSINESS
FUNDING FOR NORTHERN ARIZONA UNIVERSITY
(NAU)FOUNDATION FOR FISCAL YEAR 1996-97 )
)City Manager Curtis Shook briefed
the council on this item.He reminded Council of the presentation by Jeanelle
O'Dell of NAU at the work session and commented on the benefits to the
community.He recommended support for the program.
Councilmember Surra commented in
favor of the program.
Councilmember Barker MOVED TO
APPROVE THE CONCEPT OF THE NORTHERN ARIZONA UNIVERSITY EXTENSION AT SIGNAL
PEAK CAMPUS;AND THAT WE CONSIDER THE SPECIFIC FINANCES DURING THE BUDGET
CONSIDERATION.
Councilmember Durbala SECONDED THE
MOTION.
VOTE:Unanimous.

FACILITATION SERVICES FOR A TOWN HALL )
)City Manager Curtis Shook briefed
the council on this item.He stated that Town Hall is an extension of the
program to develop an strategic plan for the future of the community and
requested authorization of this item.

CITY MANAGER BE AUTHORIZED TO PROCEED WITH SEEKING PROPOSALS FOR FACILITATOR

Councilmember Surra reported that she had attended the Friends of the Library
annual luncheon and had given a presentation at it.
