JANUARY 9,1996
meeting of the City Council of the City of Apache Junction,
on January 9,1995 at the Apache Junction City Council
to the notice required by law.
CALL TO ORDER
Mayor Coleman called the meeting to order at 7:00 p.m.

PROPOSED ANNEXATIONS AN -7-95,AN -8-95
AND AN -9-95
)Development Services Director
Larry Harmer stated that the first annexation covers a 10 -acre parcel;the
second covers the 10 -acre parcel plus 320 acres;and the third covers the
first two plus an additional 40 acres.All of that covers the same area in
the vicinity of Goldfield,Baseline,Tomahawk and Southern.He stated that
this is a request for annexation by representatives of Desert Sun
Condominiums.
Mr.Harmer stated that one of the council's goal was to square off the city
limits and explained the advantages of that.He stated that staff has
packaged several different annexation configurations for the council to review
and that all of the property owners have been notified and all of the
responses received so far have been favorable.

Mr.Harmer stated that one of the reasons Desert Sun Condominiums has
requested annexation is because they want access to the sewer service.
However,annexation does not mandate that they hook onto the sewer system if
they already have a working disposal system,unless the State has a problem
with that.
Mr.Harmer stated that upon completion of the annexation,staff would initiate
a council action to expand the sewer service area so that the people can have
access to that if they so desire.

)Mayor Coleman opened the public
hearing.There being no one wishing to speak on this item,he closed the
hearing.
Mr.Harmer informed the council that
staff had been contacted prior to doing this by several of the property owners
within this area asking that their property be annexed.
AN -8-95,PROPOSED ANNEXATION
)Mayor Coleman opened the public
hearing.
Mr.Howard Downs addressed the
council with the question of whether or not they would be able to get water
service for the area where he lives when this is annexed.
City Manager Curtis Shook replied
that if that area is within the boundaries of the Water Utility Community
Facilities District,they would look into the possibility of extending water
service to that area.
Mr.Robert J.Hoover,S.Starr Rd.,
spoke in opposition to the annexation.
Mr.Jim Babies from Desert Sun
Condominiums,asked about the status of Golden Vista.
Mr.Shook replied that Golden Vista
has already been annexed into the city and that is why it does not show on the
map for this annexation.
Mrs.Angela LaSasso,from South
Acacia asked the council to make sure the city can provide water to area
residents before they make a decision on this annexation.
Mr.Al Cochran,asked if there have
been any discussions with the sewer district about the location of service
lines for the area.

Mr.Shook replied that the sewer
service is voluntary and people have to request that service.He suggested
that interested people should address the sewer district with that issue.
Mr.Don Ford,2760 S.Starr Rd.,
asked if people were going to vote on this annexation of if the council was
going to decide for them.
Development Services Director Larry
Harmer explained the annexation procedures as mandated by State statute.He
stated that State law mandates that a minimum of 50% plus one of the owners
and 50% of the assessed valuation must be reached before the council can even
consider voting on an annexation.If that happens the council can vote for
the entire area.He stated there is an appeal process by which people can
address the process under which the annexation took place,but a public vote
is not provided for in this law.
Mrs.Carolyn Casella from South
Cortez was concerned that the area would become high density after i t is
annexed.
Mr.Harmer explained that State law
requires that the zoning classification of the area be maintained after
annexation.
Mrs.Sandie Smith,Pinal County
District 2 Supervisor,explained that the county does not take a stand on
annexation because people are residents of the county whether they live inside
or outside the city limits.She stated the county cannot provide some of the
things that the city can such as water,denser police protection,sewer,etc.
She offered the continuous cooperation of the county's Planning and Zoning
with the city's Planning and Zoning on the zoning issue.
Mr.Don Peterson,from South Acacia,
stated that water service for the area be considered first.
There being no one else wishing to
speak on this item,Mayor Coleman closed the public hearing.

Larry Harmer stated that this annexation included the two previously discussed
areas plus Denali Mobile Home Park.
Mayor Coleman opened the public
hearing.There being no one wishing to speak on this item,he closed the
hearing.

Councilmember Barker pointed out the
misunderstanding that the city would be mandated to provide water to the area.
Mr.Shook explained that if people
are within the boundaries of the Water Utilities District,they can make a
request for water service.The district will then look at whether or not
there are current expansion plans for that area and if there was enough
interest or high density for the service,the district might want to extend it
to that area.However,annexation by the city does not mean that water lines
would be automatically extended.
Councilmember Surra added that even
if they are not annexed to the city,they could still make a request for water
service to the water district.
Mr.Shook informed the public that
annexation does not incur more taxes because the city does not have property
taxes.
