HomeMy WebLinkAbout1996-03-05 City Council Regular MinutesCITY COUNCIL REGULAR MEETING MARCH 5,1996 The regular meeting of the City Council of the City of Apache Junction, Arizona,was held on March 5,1996,at the Apache Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Mayor Coleman called the meeting to order at 7:00 p.m. INVOCATION Mayor Coleman gave the Invocation. PLEDGE OF ALLEGIANCE Vice Mayor Richmond led ROLL CALL Council members Present: Staff Present: Others Present: the Pledge of Allegiance. Councilmember Durbala SECONDED THE MOTION. VOTE:Unanimous. The motion carried. AWARDS,PRESENTATIONS AND COMMUNICATIONS None. CALL TO THE PUBLIC J.R.Palmer addressed the council in opposition to the opening of 29th Avenue at Winchester Road;inquired why city employees are not required to live in the city;and spoke in opposition to commercial development in the area of 29th Avenue and Winchester Road. CITY MANAGER'S REPORT City Manager Curtis Shook reported that based on direction from the council at the last meeting regarding Triax Cablevision,soon staff will be scheduling public meetings to obtain input from people about their problems with that service,as the city moves into possible renegotiations with the company regarding their franchise.He stated he has already received some input from people and indicated that this was a topic of great interest in the community. He stated that the meetings will be held the end of March or in April. PUBLIC HEARINGS ORDINANCE NO.946 (PZ-95-07,JOHN SLENTZ)) )Development Services Director Larry Harmer stated that this item was for a privately owned property at the northeast corner of Idaho Rd.and Superstition Freeway;that i t is designated on the General Plan as a commercial;that the consideration tonight was to provide the overall zoning of 5 acres,which are currently zoned general rural.He stated this request was for zoning only but a subdivision plat would have to be filed on this prior to final development of the property because this is being separated into three lots.He stated the intent of this rezoning is to take advantage of the lake traffic at that intersection. Planning Manager Jim Nakagawa added that the 5 -acre parcel to the west was rezoned last September for the Four Sons Convenience Store.He stated that at that time staff identified a road issue and explained that certain roads needed to go through for both circulation and access to emergency vehicles in order to follow the city road REGULAR MEETING OF THE CITY COUNCIL MARCH 5,1996 PAGE 2 OF 9 plan.He explained that an east -west road needed to go through the north of the site to connect Winchester with Idaho.He stated that the Planning and Zoning Commission on February 13 recommended approval of this project.He briefed the council on the stipulations contained within the ordinance. Mr.Gary Bryce,455 W.Holmes,Mesa, spoke on behalf of the applicant in favor of his rezoning request. hearing. Mayor Coleman opened the public Mr.Ray Downs representing Four Sons Convenience Store spoke in support of the applicant. Mr.J.R.Palmer,2761 S.Winchester Rd.,spoke against this item. Mr.Bill Hyde,4217 E.Alder,Mesa, spoke on behalf of the applicant. Mayor Coleman asked if there was anyone else wishing to speak;there being no one else,he closed the public hearing. Councilmember Barker inquired about the deletion from the ordinance of a dedicated easement. City Engineer Gordon Grandy explained that the west 33 feet on Winchester Rd was an easement for road purposes,but they did not know what the owner of property to the east intended to do with that,and since they did not need the full dedication of Winchester off of this rezoning case,they would like to retain the full easement for future possibilities on Winchester. Councilmember Barker asked if the issues referred to in the letter from Countryside RV Resort would be addressed by the city as they go through the preliminary plat,etc. Mr.Grandy answered that with respect to the buffering he would recommend landscaping with bushes instead of the trees on the four -foot strip;that with respect to street lighting,there would be enough lighting on the commercial site plus 24 -hour activity to detour any vandalism away from the area;that with respect to the road being paved and curbed,that would be a given since that is part of the city requirements;that with respect to truck parking on the street,a sign prohibiting that could be used;that with respect to the two-year limit on the rezoning,it was already a requirement;and that with respect to dust control on Winchester Road due to an increase in traffic,if that was a problem,they would need to pave the rest of Winchester to 29th Avenue. REGULAR MEETING OF THE CITY COUNCIL MARCH 5,1996 PAGE 3 OF 9 Councilmember Durbala inquired about the response from the Police and Fire departments concerning the welfare and safety as a result of opening 29th Avenue. Mr.Grandy replied that the Fire District was in favor of using 29th Avenue for access to the area. Councilmember Durbala MOVED THAT ORDINANCE NO.946 BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilmember Hendricks SECONDED THE MOTION. VOTE:Unanimous. The motion carried. City Clerk Kathy Connelly read,"AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-95-07 FROM GR (GENERAL RURAL)TO C-3/PD (GENERAL COMMERCIAL BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY." Councilmember Durbala MOVED THAT ORDINANCE NO.946,AS READ BY THE CITY CLERK BE APPROVED AND ADOPTED. Councilmember Barker AMENDED THAT IN NUMBER 2 OF THE ORDINANCE THE PHRASE "AND THE EAST THIRTY-THREE FEET (33')"BE STRICKEN. Councilmember Durbala SECONDED THE MOTION. AMENDMENT VOTE:Unanimous. The motion carried. MAIN MOTION VOTE:Unanimous. The motion carried. ORDINANCE NO.947 (PZ-96-01.JOYCE RINGLE ) )Planning Manager Jim Nakagawa stated this was a rezoning request for a 1.25 -acre parcel from CR-5, apartments,to R1-43/MH,residential/manufactured homes.He stated this was south of Broadway and east of Tomahawk at the location of 10th Avenue and REGULAR MEETING OF THE CITY COUNCIL MARCH 5,1996 PAGE 4 OF 9 Vista;that there is a mixture of housing in this area with a home, apartments,and mobile homes.He stated that the Planning and Zoning Commission on February 13 recommended approval of this based on the fact that the rezoning would be consistent with the General Plan and it would lessen the impact that the current zoning would generate. Ms.Mary Watson of Superstition Realty,spoke on behalf of the applicant in favor of this rezoning. Mayor Coleman opened the public hearing.There being no one wishing to speak on this item,he closed the hearing. Councilmember Durbala asked if this area was also designated as a mobile home subdivision. Harmer answered (unintelligible). Development Services Director Larry Councilmember Surra stated that the City Council and the Planning and Zoning Commission have realized that mobile homes should be set in their own subdivision,and she asked if there were any guarantees that these lots would conform with that in the future. Development Services Director Larry Harmer answered that this area was not a subdivision or a mobile home park but predominately mobile homes in nature;that there was no indication that this would be a subdivision or a park;and that staff has not received formal direction from the council to begin the process for initiating mobile homes to mobile home subdivisions. Councilmember Surra commented that they needed to draw a line to stop mobile homes from spreading in the general rural zone. Mr.Harmer replied that the problem was that the GR zoning allows for mobile homes and if they wished to change that,they would have to go through the entire process of an ordinance change. Councilmember Durbala asked if this property could split further in the future. Mr.Harmer answered that the lots are the minimum size and cannot be split further,and that they are for either a single or wide mobile home but not for two units. Councilmember Durbala MOVED THAT ORDINANCE NO.947 BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. ORDINANCE NO.948,AN -6-95,CITY -INITIATED ANNEXATION OF SEVERAL PARCELS IN SECTION 31 )Development Services Director Larry Harmer stated that this annexation related to the city's policy of squaring off the city limits;that the annexation process has followed A.R.S. Section 9-471 which includes filing the petition,public hearing notification and signature gathering;that they have been successful in getting the signatures required to cover the 50% plus one of the ownership and 50% plus one of the assessed valuation of the area.He further briefed the council on the ordinance. hearing. Mayor Coleman opened the public Mr.Miller of Palmas Del Sol East asked if this property was included in the annexation. Mr.Harmer answered that it was not included. Mayor Coleman asked if anyone else from the public wished to speak.There being no one else wishing to speak,he closed the hearing. City Clerk Kathy Connelly read,"AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE CITY OF APACHE JUNCTION,PINAL COUNTY,STATE OF ARIZONA,PURSUANT TO PROVISIONS OF TITLE 9, CHAPTER 4,ARTICLE 7,ARIZONA REVISED STATUTES AND AMENDMENTS THERETO,BY ANNEXING CERTAIN TERRITORY CONTIGUOUS TO THE EXISTING CITY LIMITS OF THE CITY OF APACHE JUNCTION;ADOPTING ZONING CLASSIFICATIONS FOR ANNEXED TERRITORY; REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY." OLD BUSINESS RESOLUTION NO.96-05,ESTABLISHING AN ICMA RETIREMENT CORPORATION DEFERRED COMPENSATION PLAN )City Manager Curtis Shook stated that last evening Susanne Dobel (ICMA RC Marketing Representative)explained the establishment of the 457 Deferred Compensation Program;that this has been a program he has taken part in for fourteen years;that he would like to reestablish it;and that it would be available to various city employees as well. Councilmember Surra MOVED THAT RESOLUTION NO.96-05,"ESTABLISHING FOR THE CITY OF APACHE JUNCTION A DEFERRED COMPENSATION PLAN TO BE ADMINISTERED BY THE ICMA RETIREMENT CORPORATION"BE APPROVED. INFORMATION AND REPORTS Councilmember Durbala reported that he attended a seminar of Main Street on businesses and customer service. Mayor Coleman reported he attended a meeting on the highway system in Mesa this afternoon regarding congestion pricing and toll roads.He also stated that Lost Dutchman Days was successful.
