HomeMy WebLinkAbout1995-04-18 City Council Regular MinutesCITY COUNCIL REGULAR MEETING APRIL 18,1995 The regular meeting of the City Council of the City of Apache Junction, Arizona,was held on April 18,1995,at the Apache Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Mayor Perkins called the meeting to order at 7:03 p.m. INVOCATION Councilman Perkins gave the Invocation. PLEDGE OF ALLEGIANCE Councilman Hendricks led the Pledge of Allegiance. REGULAR MEETING OF THE CITY COUNCIL APRIL 18,1995 PAGE 1 OF 8 Councilwoman Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. AWARDS.PRESENTATIONS AND COMMUNICATIONS Mayor Perkins presented certificates to the coaches and youth members of the Championship Youth Basketball Team. Carol Doty,representing the Chamber of Commerce,presented the Chamber's contribution of $2,000 to be used for rodeo park fencing and presented brochures from the Apache Junction Film Commission. CALL TO THE PUBLIC Mr.Mike Alltop addressed the council regarding the status of the review process for animal control regulations. CITY MANAGER'S REPORT Interim City Manager George Hoffman updated the council on the retesting proposal by the sewer district.He stated that it was agreeable and that the first steps are being taken in implementing that testing program. Mr.Hoffman updated the council on Prospector Park Phase III which includes the construction of restrooms.He informed the council that the Parks and Recreation Director is pursuing a grant to extend the hours of the public swimming pool on Saturdays during the summer and to offer entertainment such as movies and music.He added that the grant would pay for staffing and utilities.Mr.Hoffman also reported that staff will be looking at applying for a grant from the Forestry Division at Arizona State Land Department with the objective to use volunteers to enhance the urban forest in local communities. Mr.Hoffman reported that the Public Safety Department has moved into their new facilities and that an open house is being planned for mid -May.He stated that the Parks and Recreation Director and the City Engineer are in the process of developing the bid specifications for the landscaping of the facilities and its retention basin. Mr.Hoffman reported on the Library expansion and explained there are several finishing details that need to be done right but staff was having difficulties getting the contractor to complete them.However,the contract provides for remedies to those issues that staff is pursuing. REGULAR MEETING OF THE CITY COUNCIL APRIL 18,1995 PAGE 2 OF 8 Mr.Hoffman explained that the Public Safety Department has been following his direction regarding other priorities but next will be working with the community in reviewing and analyzing the animal control ordinance. Mayor Perkins recessed the meeting at 7:25 p.m.She reconvened the meeting at 7:35 p.m. PUBLIC HEARINGS STREET LIGHT IMPROVEMENT DISTRICT 9302-1, PALM SPRINGS INCREASE IN S.R.P. CONSTRUCTION COSTS )City Engineer Gordon Grandy informed the council that because of labor and material cost increases,there will be an increase in this improvement district.He stated that for the first three years of the improvement each of the homeowners would have another $0.87 per month added to their assessment. Vice Mayor Barker asked i f homeowners had been notified. Mr.Grandy answered they had not been notified. The council recommended to notify the homeowners of this.Staff stated that mailing was too expensive.The council discussed the possibility of letting people know about it through the Homeowners Association but not all are members and some are already away for the summer.They decided that people could still be informed by word of mouth. (This hearing was for purposes of information only and no council action was necessary.) OFF-TRACK WAGERING RENEWAL PERMIT FOR ARIZONA JOE'S SUBMITTED BY TURF PARADISE ) )City Clerk Kathy Connelly explained this is the annual request from Turf Paradise on behalf of Turf Paradise,Prescott Downs and Fort Tuthill Downs for a continuation of the off- track wagering facility at Arizona Joe's Restaurant.She stated that a representative from Turf Paradise was present to answer any questions from the council. The council did not have any questions on this. Councilman Hendricks MOVED THAT REQUEST FOR RENEWAL OF AN OFF TRACK WAGERING FACILITY AT ARIZONA JOE'S RESTAURANT SUBMITTED BY TURF PARADISE RACE COURSE FOR TURF PARADISE RACE REGULAR MEETING OF THE CITY COUNCIL APRIL 18,1995 PAGE 3 OF 8 COURSE,PRESCOTT DOWNS AND FORT TUTHILL DOWNS,FOR THE PERIODS OF TIME AS INDICATED IN THE LETTER FROM GARY TALKINGTON REPRESENTING THE RACING ENTITIES, DATED APRIL 4,1995,BE RECOMMENDED FOR APPROVAL TO THE ARIZONA RACING COMMISSION. MOTION. VOTE:Unanimous. The motion carried. VOTE: In Favor: Vice Mayor Barker SECONDED THE Councilman Coleman,Councilwoman Richmond,Vice Mayor Barker,Councilman Perkins,Councilman Hendricks,Councilman Perkins. Abstained:Councilwoman Surra (due to a personal conflict) The motion carried. OLD BUSINESS SUGGESTED CHANGES TO THE GENERAL RURAL ZONING DISTRICT ) )Planning Division Mgr.Jim Nakagawa stated that at the February 21 council meeting Councilman Hendricks expressed an interest in changes in the GR zone which was in response to some complaints from people about some of the uses allowed.He briefed the council on the suggested changes that staff was making which addressed the issues previously discussed.He stated that if those changes met the council's approval he would then proceed with the zoning amendment process. Councilman Hendricks asked why dog kennels was not being addressed in here. Vice Mayor Barker asked if that issue was not being addressed in the animal control ordinance. City Clerk Kathy Connelly clarified that zoning would have to handle the zoning of kennels. Mr.Nakagawa replied they could place in here a conditional use permit for dog kennels in order for it to receive zoning clearance. REGULAR MEETING OF THE CITY COUNCIL APRIL 18,1995 PAGE 4 OF 8 Councilman Hendricks stated he would like to see that.He asked if the kennel size could be addressed in here or if it was addressed anywhere else. Mr.Nakagawa reminded the council that animal regulations specify that three dogs or less are allowed without a permit;for four or five dogs there is a personal kennel permit required;and for six dogs or more there is a commercial kennel permit required.He stated that the changes would depend on where the council wants to draw the line.He reminded the council that they were dealing with GR zoning and so he did not know how this issue would impact residential zones,but they could deal with just GR zoning issues and try to make some changes here. Councilman Hendricks asked if the council would then have to address other ordinances on the subject. Mr.Nakagawa answered they would have to do that down the line. Councilman Hendricks suggested to consider this issue together with the other ordinances. Vice Mayor Barker commented that if they were going to consider a conditional use permit for dog kennels they should also consider stables since these seem to have the same use. Mr.Nakagawa pointed out that equine regulations are contained in a separate section other than just GR,and in there are different provisions for boarding stables in any residential area. Councilman Hendricks asked if that section covers other large animals such as llamas. Mr.Nakagawa answered that other type of large animals was not covered under equine regulations but in the other large lots residential zones,R1-43 and CR-1. Mayor Perkins suggested to continue this item for discussion at a work session. Councilman Hendricks stated that home occupation was too open.He was concerned that this allows for retail sale which may attract a lot of traffic to the area.He commented that people could even sell guns out of their homes,although the federal law is changing people's ability to do that.He stated that under home occupation here provided,people may think they can dedicate a room in their homes for a retail sale business. REGULAR MEETING OF THE CITY COUNCIL APRIL 18,1995 PAGE 5 OF 8 Mr.Nakagawa answered that home occupation here would not override any federal law such as the Brady Bill. Councilman Hendricks asked if they could require a conditional use permit for home occupation so that the city can keep control of that. Mr.Nakagawa replied that they would also have to change that in all residential areas where this is also allowed. Vice Mayor Barker suggested to just change the criteria so that it would not allow for things they are concerned about. Ms.Connelly agreed that home occupation was too open and may be interpreted to allow retail sales which is not conducive to a residential area. Councilman Hendricks added that he would like to also look at detached accessory buildings and their minimum distance to side and rear lot lines. Councilman Councilwoman Surra MOVED THAT STAFF BRING THIS ITEM BACK AT THE NEXT WORK SESSION (MAY 1). Vice Mayor Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. NEW BUSINESS None. COUNCIL DIRECTION TO STAFF ON PROPOSED LEGISLATION OR ACTIONS None. SELECTION OF MEETING DATES,TIMES,LOCATIONS,AND PURPOSES MOVED THAT AN EXECUTIVE SESSION AT 6:00 P.M.AND A WORK SESSION AT 7:00 P.M.BE HELD ON MONDAY,MAY 1,1995,IN THE CITY COUNCIL CONFERENCE ROOM AND CITY COUNCIL CHAMBERS RESPECTIVELY;AND THAT AN EXECUTIVE SESSION AT 6:00 P.M.BE HELD ON TUESDAY,MAY 2,1995,IN THE CITY COUNCIL CONFERENCE ROOM.
