HomeMy WebLinkAbout1995-05-16 City Council Regular MinutesCITY COUNCIL REGULAR MEETING MAY 16,1995 The regular meeting of the City Council of the City of Apache Junction, Arizona,was held on May 16,1995,at the Apache Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Mayor Perkins called the meeting to order at 7:07 p.m. INVOCATION Councilmember Surra gave the Invocation. PLEDGE OF ALLEGIANCE Councilmember Hendricks led the Pledge of Allegiance. REGULAR MEETING OF THE CITY COUNCIL MAY 16,1995 PAGE 1 OF 9 ACCEPTANCE OF CONSENT AGENDA ) )Councilmember Coleman MOVED THAT THE CONSENT AGENDA BE ACCEPTED AS PRESENTED;AND THAT THE CONTRACT WITH ARNOLD HIRSCH FOR PROSECUTORIAL SERVICES FOR FISCAL YEAR 1995-96,BE APPROVED AS PRESENTED,AND THAT THE MAYOR BE AUTHORIZED TO EXECUTE SUCH CONTRACT. Councilmember Hendricks SECONDED THE MOTION. VOTE:Unanimous. The motion carried. AWARDS,PRESENTATIONS AND COMMUNICATIONS Mayor Perkins presented plaques to employees completing 15 years of service. She also presented a proclamation to Public Works Director Doug Dobson declaring May 22-26 as "National Public Works Week." CALL TO THE PUBLIC None. CITY MANAGER'S REPORT Interim City Manager George Hoffman updated the council on the Special Census recount.He stated that out of 6,375 households contacted 2,109 residents were counted plus an additional 103 as a result of a door-to-door count.He added that a certain number could be eliminated due to a double count of some of the people and residents outside the city limits,but they were confident that the final count would be more than the initial count. Mr.Hoffman reported that grant proposal for $25,000 to the Governor's Office of Highway Safety submitted by Public Works Director Doug Dobson for upgrading street name signs was successful.He stated the signs would be changed to 6 -inch letters to include the Lost Dutchman logo.He also reported that a grant proposal for $43,500 submitted by Spencer Spencer of the Library staff for an integrated automated system was approved,and it was contingent upon the federal government's funding decisions which would be by the end of October. Mr.Hoffman reminded the council that on May 17 at 10:00 a.m.would be the open house for the Department of Public Safety facilities,and on May 25 would be the grand opening of the Library addition.He informed the council that on May 18 at 6:30 p.m.Chief Galloway would be holding an organizational meeting with dog advocates and owners for the review of the animal control ordinance. Mr.Hoffman informed the council of the city trash pickup the week of May 22 and thanked A.J.Waste for receiving that free of charge at the landfill. REGULAR MEETING OF THE CITY COUNCIL MAY 16,1995 PAGE 2 OF 9 Mr.Hoffman announced that new City Manager Curtis Shook would be present at the meeting of June 6 and he thanked the council for the opportunity of serving in the capacity of Interim City Manager up until now. PUBLIC HEARINGS ORDINANCE NO.927,PZ-2-95,REZONING REQUEST BY INUS HOLT )Planning Division Mgr.Jim Nakagawa briefed the council on this item.He stated that on May 9 the Planning and Zoning Commission conducted a public hearing on this and recommend approval,which Planning staff supports. hearing. spoke in favor of this item. Mayor Perkins opened the public Midge Conway,902 S.Ocotillo Dr., Vice Mayor Barker MOVED THAT ORDINANCE NO.927 BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilmember Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. City Clerk Kathy Connelly read,"AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-2-95 FROM TH (TRAILER HOMESITE ZONE)TO C-1 (NEIGHBORHOOD COMMERCIAL/CONVENIENCE DISTRICT);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY." Vice Mayor Barker MOVED THAT ORDINANCE NO.927,AS READ BY THE CITY CLERK,BE APPROVED AND ADOPTED. Councilmember Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. REGULAR MEETING OF THE CITY COUNCIL MAY 16,1995 PAGE 3 OF 9 RESOLUTION NO.95-10,LEVYING ASSESSED VALUATION ON STREET LIGHT DISTRICT SL9304-1,APACHE VILLA )City Engineer Gordon Grandy briefed the council on this item.He stated the lights in Apache Villa are on and it is time for the county assessor to start collecting the money to pay SRP.He stated this resolution is the last document needed to complete the improvement district. Mayor Perkins opened the public hearing.There being no one wishing to speak,she closed the hearing. Councilmember Surra MOVED THAT RESOLUTION NO.95-10,"RELATING TO TAXATION,LEVYING UPON THE ASSESSED VALUATION OF THE PROPERTY WITHIN THE CITY OF APACHE JUNCTION,SUBJECT TO TAXATION,AND WITHIN THE MUNICIPAL STREET LIGHTING IMPROVEMENT DISTRICT 5L9304-1,A CERTAIN SUM UPON EACH ONE HUNDRED DOLLARS OF VALUATION SUFFICIENT TO RAISE THE AMOUNT REQUIRED FOR THE ANNUAL EXPENSE OF THE SAID MUNICIPAL STREET LIGHTING IMPROVEMENT DISTRICTS,AND DECLARING AN EMERGENCY,BE APPROVED." Vice Mayor Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. ORDINANCE NO.926,AMENDING ORDINANCE NO.503,AMENDING PROCEDURES FOR ALLOWING CONSTRUCTION IN THE PUBLIC RIGHTS -OF -WAY AND EASEMENTS )Interim City Manager George Hoffman reminded the council of their meeting with the Superstition Mountain Community Facilities District on May 8 and their thorough discussion of the matter.He suggested continuing this item to July to be considered together with the review of the development guide and other infrastructure development regulations and standards. Councilmember Surra MOVED TO TAKE NO ACTION ON THIS PROPOSED ORDINANCE THIS EVENING,BUT INSTEAD THAT IT BE A PART OF DIRECTION TO STAFF FOR PROPOSED ITEM #12 WHICH IS FOR REVIEW AND REVISION OF THE DEVELOPMENT GUIDE AND OTHER INFRASTRUCTURE DEVELOPMENT REGULATIONS AND STANDARDS OF THE CITY OF APACHE JUNCTION. NEW BUSINESS RECOMMENDATIONS ON 1995 OVERALL ECONOMIC DEVELOPMENT PROGRAM (OEDP) )Interim City Manager George Hoffman stated that the council had discussed this item at the work session and since then staff has received additional topics to be included. City Clerk Kathy Connelly added that staff had contacted the School District,Chamber of Commerce,and Main Street for their input and also some citizens comments have been received. Vice Mayor Barker MOVED TO DIRECT STAFF TO INCLUDE THE STATEMENTS FROM THE INTERIM CITY MANAGER AND THE CITY CLERK AND ALL INFORMATION THAT CAN BE GARNERED FROM ANY AND ALL SOURCES,AND THAT IT BE COMPILED AND PUT TOGETHER BY THE TIME CAAG NEEDS TO RECEIVE THIS INFORMATION;TO DELETE THOSE THINGS WHICH ARE ALREADY COMPLETED ON THIS LIST; AND IF THE ADDITIONAL SWIMMING POOL IS NOT ALREADY PART OF THE PARKS PLAN, INCLUDE THAT;AND COMBINE THE ITEM FROM THE CITIZEN REQUEST LIST. Councilmember Surra SECONDED THE MOTION. VOTE:Unanimous. The motion carried. PAY INCREASE FOR PRESIDING MAGISTRATE ) )Councilmember Surra commented that pay raise is usually preceded by an evaluation which is typically based on a 12 -month performance record.SHE MOVED TO ALLOW JUDGE HARRIS UNTIL OCTOBER TO ACCUMULATE A RECORD OF PERFORMANCE IN HER COURT BEFORE RECEIVING ANY SUCH EVALUATION,AND THAT STAFF IN THE MEANTIME GATHER SOME INFORMATION REGARDING THE COST OF LIVING INCREASE POSSIBILITIES FOR EMPLOYEES UNDER CONTRACT OR HOURLY WAGE,AND FOR THE NEXT FISCAL YEAR UTILIZE THAT INFORMATION RETROACTIVELY AFTER THE EVALUATION. Vice Mayor Barker SECONDED THE MOTION.She asked clarification on the cost of living. Councilmember Surra replied that council needed some information about the guidelines for cost of living so that they can put that into effect whenever they review all of the salary REGULAR MEETING OF THE CITY COUNCIL MAY 16,1995 PAGE 5 OF 9 schedules for the next fiscal year (1995-96);and since this evaluation is for October (1995),if it is acceptable to the council,that it be retroactive regardless of the review. Vice Mayor Barker suggested that i f the cost of living is going to be granted,that this start in July (1995) instead of being retroactive. Councilmember Surra replied that the council did not have the information needed for that. The council proceeded with the vote. VOTE:Unanimous. The motion carried. RECOMMENDATIONS FROM HEALTH AND HUMAN SER- VICES COMMISSION FOR FISCAL YEAR 1995-96 ) )City Clerk Kathy Connelly briefed the council on this item.She listed the commission's recommendations as follows:Abuse Prevention Council $5,000;Apache Junction Reach Out Food Bank $7,000;East Valley Catholic Social Service $13.000;Community Action Human Resources Agency $5,000;Salvation Army $21,000;and Superstition Mt.Mental Health Center $23,000.She pointed out there were some stipulations for funding stated in her memo. Vice Mayor Barker MOVED THAT THE RECOMMENDATIONS OF THE HEALTH AND HUMAN SERVICES COMMISSION FOR HUMAN SERVICES FUNDING FOR FISCAL YEAR 1995-96 BE ACCEPTED AS PRESENTED;AND THAT STAFF BE DIRECTED TO PREPARE THE NECESSARY CONTRACTS FOR COUNCIL CONSIDERATION IN CONJUNCTION WITH FINAL BUDGET ADOPTION. Councilmember Surra SECONDED THE MOTION. VOTE:Unanimous. The motion carried. COUNCIL DIRECTION TO STAFF ON PROPOSED LEGISLATION OR ACTIONS REVIEW AND REVISION OF DEVELOPMENT GUIDE AND OTHER INFRASTRUCTURE DEVELOPMENT REGULATIONS AND STANDARDS )Councilmember Coleman asked staff if development impact fees would be part of this. REGULAR MEETING OF THE CITY COUNCIL MAY 16,1995 PAGE 6 OF 9 Interim City Manager George Hoffman answered those fees are part of a substantive study and staff was in the process of issuing the Request for Proposals (REP)for that.He stated they will include in this review a fee schedule but not the development impact fees. Councilmember Coleman asked when staff was anticipating issuing the Request for Proposals for the impact fees. Development Services Director Larry Harmer answered that July 18 was the estimated date or before then. Vice Mayor Barker MOVED THAT THE FOLLOWING DIRECTION BE GIVEN TO STAFF REGARDING THE REVIEW AND REVISION OF THE DEVELOPMENT GUIDE AND OTHER INFRASTRUCTURE DEVELOPMENT REGULATIONS AND STANDARDS OF THE CITY:THAT A COMPREHENSIVE INTEGRATED GUIDE BE BROUGHT BACK TO THE COUNCIL ON JULY 18. Councilmember Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. SELECTION OF MEETING DATES,TIMES,LOCATIONS,AND PURPOSES Vice Mayor Barker MOVED THAT AN EXECUTIVE SESSION AT 6:00 P.M.AND A WORK SESSION AT 7:00 P.M.BE HELD ON MONDAY,JUNE 5,1995,IN THE CITY COUNCIL CONFERENCE ROOM AND CITY COUNCIL CHAMBERS RESPECTIVELY;AND THAT AN EXECUTIVE SESSION AT 6:00 P.M.BE HELD ON TUESDAY,JUNE 6,1995,IN THE CITY COUNCIL CONFERENCE ROOM. Councilmember Hendricks SECONDED THE MOTION. VOTE:Unanimous. The motion carried. INFORMATION AND REPORTS None.
