SPECIAL MEETING
AUGUST 7,1995
The special meeting of the City Council of the City of Apache Junction,
Arizona,was held on August 7,1995 at the Apache Junction City Council
Chambers pursuant to the notice required by law.
CALL TO ORDER
Mayor Coleman called the meeting to order at 7:00 p.m.

ARROYO VERDE SUBDIVISION (SD -95-01)
FINAL PLAT )City Manager Curtis Shook briefed
the council on this item and recommended approval based on staff's
recommendation.
Councilmember Durbala asked if all
utilities will be underground.
City Engineer Gordon Grandy
confirmed that.
Councilmember Durbala inquired about
the staff's concerns on compliance with some of the regulations.

Mr.Shook explained that staff has
been able to fashion an instrument that will protect the city from non-
compliance.
Mr.Grandy explained that the method
would be that the project will be done in phases;the first phase will provide
assurances from a financial institution that money has been set aside to
complete all of the utilities and street improvements;however,all the phases
will be recorded at the same time along with phase I and there will be an
agreement with the developer stating that the city will not issue any building
permits for any of the lots in phase I I or III until such time as other proper
assurances are provided.
City Attorney Glenn Gimbut added
there is also a written agreement from Lennar Homes stating that they will
indeed build and provide all of the infrastructure improvements for the whole
subdivision.He stated that such written promise could be enforced and that
the agreement will be recorded.
Mr.Grandy stated that as an option
for more security on behalf of the city,they considered the possibility of
placing liens on the lots for phases I I and III,but that is not necessarily a
pursuit by staff.
Mr.Gimbut explained that the liens
option would hurt the developer and would not provide the city with adequate
assurances.
Mr.Grandy stated that the developer
is in agreement with the conditions stated above.
Councilmember Durbala MOVED THAT THE
FINAL PLAT FROM LENNAR HOMES FOR THE ARROYO VERDE SUBDIVISION,SD -95-01,BE
APPROVED WITH THE CONDITION THAT IT WILL NOT BE RECORDED UNTIL THE IMPROVEMENT
PLANS AND ASSURANCES ARE APPROVED BY THE CITY ENGINEER.
Vice Mayor Richmond SECONDED THE
MOTION.
VOTE:Unanimous.
The motion carried.
IRONWOOD COVE (SD -94-01)SUBDIVISION
FINAL PLAT )City Manager Curtis Shook briefed
the council on this item.He recommended approval of this based on staff's
recommendations.

City Engineer Gordon Grandy stated
that this included only the landscaping plans for approval;everything else
has already been approved.
Vice Mayor Richmond commented that
the lots were small and narrow.
Councilmember Durbala asked if the
utilities will be underground.
Mr.Grandy confirmed that.
Mr.Steve Ray,developer,stated
that the size of the lots was appropriate for the cost.
Councilmember Surra MOVED THAT THE
FINAL PLAT FOR IRONWOOD COVE SUBDIVISION,SD -94-01,BE APPROVED WITH THE
CONDITION THAT IT WILL NOT BE RECORDED UNTIL TITLE TO THIS PROPERTY IS VESTED
IN SRC HOMES,INC.;THE IMPROVEMENT PLANS AND ASSURANCES ARE APPROVED BY THE
CITY ENGINEER;AND MINOR REVISIONS ARE MADE TO THE FINAL PLAT.
Councilmember Durbala SECONDED THE
MOTION.
Planning Manager Jim Nakagawa stated
that Ellsworth Ray,not SRC Homes,will be subdividing the development.
Councilmember Surra AMENDED THE
MOTION THAT "TITLE TO THIS PROPERTY BE VESTED IN ELLSWORTH RAY."
Mr.Ray clarified that the it has
already been vested under Ellsworth Ray.
Councilmember Durbala SECONDED THE
AMENDMENT.
VOTE:Unanimous.
The motion carried.
RESOLUTION NO.95-21:AUTHORIZATION TO
REQUEST AN EXTENSION OF DEPT.OF
COMMERCE HOME PROGRAM IGA #I41-93
)Development Services Director
Larry Harmer explained that the city was able to assist more homes than
planned with the grant and have surplus money.He stated this contract would
have ended last July,but the Dept.of Commerce will extend it to September 15
if the council endorses this resolution.He added that this way the city will
be able to expend the money for the benefit of the community.

Vice Mayor Richmond MOVED THAT
RESOLUTION NO.95-21,"AUTHORIZING THE SUBMISSION OF AN AMENDMENT TO COMMERCE
HOME CONTRACT NO.141-93 AND AUTHORIZING THE MAYOR TO SIGN A CONTRACT
AMENDMENT,"BE APPROVED.
Councilmember Surra SECONDED THE
MOTION.
VOTE:Unanimous.
The motion carried.
AUTHORIZATION TO TRANSFER $80,000 FROM
THE CONTINGENCY FUND TO THE WATER
UTILITIES COMMUNITY FACILITIES DISTRICT )
)Councilmember Surra MOVED TO
AUTHORIZE THE CITY MANAGER TO TRANSFER $80,000 FROM THE CONTINGENCY ACCOUNT TO
THE WATER UTILITIES COMMUNITY FACILITIES DISTRICT.
Councilmember Hendricks SECONDED THE
MOTION.
VOTE:Unanimous.
The motion carried.
