CALL TO ORDER Mayor Coleman called the meeting to order at 7:00 p.m. INVOCATION Councilmember Surra gave the Invocation. PLEDGE OF ALLEGIANCE Councilman Perkins led the Pledge of Allegiance. Vice Mayor Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. AWARDS,PRESENTATIONS AND COMMUNICATIONS None. CALL TO THE PUBLIC Mr.Robert Hunter addressed the Council regarding a continual problem with the sewer district and requested a meeting with the City Manager and appropriate city staff to further discuss the problem. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 3,1995 PAGE 2 OF 8 Mr.Chris Udall,representing Congressman J.D.Hayworth,offered their assistance with federal issues. Mr.Rick Gardner complimented the Engineering Department and Theryn Hansen for assisting him with a telephone line installation problem with U.S.West Communications. CITY MANAGER'S REPORT City Manager Curtis Shook updated the council about the Water Utilities Community Facilities District.He stated that District officers had signed the proper financing documents for the city to take part in the auction to purchase Consolidated Water on October 16. Mr.Shook stated with regards to the meeting of the City Council and the Planning and Zoning Commission that he would follow up on a number of the things they discussed.He stated that within six or eight weeks they would plan another meeting regarding a few more specific areas. Mr.Shook informed the council that the city's recreation programs are moving right along.He stated that according to Mr.Bell the football program was not possible but they will look for ways to do it.He informed the council that distribution of the Citizen has been changed to include delivery door to door. PUBLIC HEARINGS SPECIAL EVENT LIQUOR LICENSE FOR FRATERNAL ORDER OF POLICE MESA LODGE #9,INC. )City Clerk Kathy Connelly stated the event will take place at the rodeo grounds and it was for the Law Enforcement Rodeo Association Memorial Rodeo. Mayor Coleman asked if the applicant or spokesman wished to speak to the council. Mr.David Furnas,representing the Law Enforcement Rodeo Association,stated that the proceeds from the rodeo would go to the Apache Junction,East Valley,Special Olympics.He stated that last year the rodeo was a success and this year the Law Enforcement Association which consists of police officers and fire fighters throughout Arizona,California,New Mexico,Nevada,have requested that Finals for the Western Region be held here on November 4-5,1995.He stated that security will be provided by police officers from Mesa and Apache Junction. Mayor Coleman opened the public hearing.There being no one wishing to speak on this item,he closed the hearing. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 3,1995 PAGE 3 OF 8 Councilmember Barker commented she was delighted about the increase in use of the rodeo facilities. Mr.Gary Mulholland addressed the council regarding the event. Vice Mayor Richmond MOVED THAT THE SPECIAL EVENT LIQUOR LICENSE APPLICATION FOR THE LAW ENFORCEMENT RODEO ASSOCIATION MEMORIAL RODEO BE RECOMMENDED FOR APPROVAL TO THE ARIZONA DEPARTMENT OF LIQUOR LICENSES AND CONTROL. Councilmember Surra SECONDED THE MOTION. VOTE:Unanimous. The motion carried. ORDINANCE NO.934,PZ-95-01,AMENDMENT TO ART.19 OF THE ZONING ORDINANCE )Planning Manager Jim Nakagawa stated this was a follow up on previous council direction to staff.He stated that the council wished a requirement that new planned development multi- family and commercial projects provide security lighting for the various parking areas and walkways.He stated that the Planning and Zoning Commission on August 22 recommended approval of this amendment to the Zoning Ordinance. Mayor Coleman opened the public hearing.There being no one wishing to speak on this item,he closed the hearing. Councilmember Surra MOVED THAT ORDINANCE NO.934 BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Vice Mayor Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. City Clerk Kathy Connelly read,"AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING SECTION 19.0106,REQUIRING OUTDOOR SECURITY LIGHTING FOR COMMERCIAL AND MULTI- FAMILY PLANNED DEVELOPMENTS:REPEALING ANY CONFLICTING PROVISIONS:AND PROVIDING FOR SEVERABILITY." REGULAR MEETING OF THE CITY COUNCIL OCTOBER 3,1995 PAGE 4 OF 8 Councilmember Surra MOVED THAT ORDINANCE NO.934,AS READ BY THE CITY CLERK,BE APPROVED AND ADOPTED. OLD BUSINESS AMENDMENT TO EXPANSION OF SUPERSTITION MOUNTAIN COMMUNITY FACILITIES DISTRICT NO.1 SERVICE AREA )Development Services Director Larry Harmer explained that SMCFD brought to their attention that the council has the ability to expand the service area as opposed to the boundaries.He stated the wording was important and this motion will clean up a couple of previous motions made by the council. Councilmember Hendricks asked if the city will continue having problems with the district. Mr.Harmer answered that regarding distribution of service agreements outside city limits was been clarified between the district and the city. Councilmember Durbala MOVED THAT AMENDMENT TO THE SUPERSTITION MOUNTAIN COMMUNITY FACILITIES DISTRICT SERVICE AREA TO INCLUDE THOSE PROPERTIES LISTED ON EXHIBIT A (AS ATTACHED)WHICH ARE CONTAINED WITHIN THE INCORPORATED LIMITS OF THE CITY OF APACHE JUNCTION,BE APPROVED. Councilmember Hagner SECONDED THE MOTION. VOTE:Unanimous. The motion carried. NEW BUSINESS None. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 3,1995 PAGE 5 OF 8 COUNCIL DIRECTION TO STAFF ON PROPOSED LEGISLATION OR ACTIONS AMENDMENT TO CITY CODE REGARDING ORGANIZATION AND RESPONSIBILITIES OF THE DEVELOPMENT SERVICES DEPARTMENT )Development Services Director Larry Harmer explained that definition,distribution of duties and responsibilities among the various divisions have changed since he started with the city.He proposed amending the City Code to conform with current operations of the department. Councilmember Surra MOVED TO DIRECT STAFF TO PREPARE AN UPDATE TO THE APACHE JUNCTION CITY CODE ARTICLE 3-9ENTITLED"DEPARTMENT OF DEVELOPMENT SERVICES It TO REFLECT THE CURRENT OPERATION AND INTENT OF THAT DEPARTMENT AND BRING SAID UPDATE TO THE CITY COUNCIL AT A PUBLIC HEARING FOR REVIEW AND POSSIBLE ADOPTION. Councilmember Hagner SECONDED THE MOTION. VOTE:Unanimous. The motion carried. RESOLUTION TO ARIZONA DEPARTMENT OF TRANSPORTATION ALLOWING FOR ADDITIONAL SIGNAGE ON THE FREEWAY )Councilmember Barker stated that in order to move forward with their desire to have some type of signage on the freeway even though that is not currently part of their policy,they needed to take a united stand to ADOT.She suggested having specific signage that would include the business names. Councilmember Barker MOVED THAT THE FOLLOWING DIRECTION BE GIVEN TO STAFF REGARDING A REQUEST TO ARIZONA DEPARTMENT OF TRANSPORTATION TO ALLOW FOR ADDITIONAL SIGNAGE ON THE FREEWAY: THAT A REQUEST BE FRAMED TO REFLECT CONVERSATION FROM THE WORK SESSION. Councilmember Hendricks SECONDED THE MOTION. SELECTION OF MEETING DATES,TIMES,LOCATIONS,AND PURPOSES Councilmember Barker MOVED THAT AN EXECUTIVE SESSION AT 6:00 P.M.AND A WORK SESSION AT 7:00 P.M.BE HELD ON MONDAY,OCTOBER 16,1995,IN THE CITY COUNCIL CONFERENCE ROOM AND CITY COUNCIL CHAMBERS RESPECTIVELY;AND REGULAR MEETING OF THE CITY COUNCIL OCTOBER 3,1995 PAGE 6 OF 8 THAT AN EXECUTIVE SESSION AT 6:00 P.M.BE HELD ON TUESDAY,OCTOBER 17,1995, IN THE CITY COUNCIL CONFERENCE ROOM. Vice Mayor Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. Councilmember Durbala asked if a public notice regarding a possible quorum of the council at the October 16 auction of Consolidated Water was needed. City Attorney Glenn Gimbut explained that as long as council members are aware that when there is a quorum at a public presentation they should not be discussing city business,there is no need for a posting.
