HomeMy WebLinkAbout1994-06-01 City Council Regular MinutesCITY COUNCIL SPECIAL MEETING JUNE 1,1994 The special meeting of the City Council of the City of Apache Junction, Arizona,was held on June 1,1994,at the Apache Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Mayor Perkins called the meeting to order at 7:00 p.m. ROLL CALL Councilmen Present:Mayor Perkins Vice Mayor Barker Councilwoman Richmond Councilman Hendricks Councilman Perkins Councilman Coleman Councilwoman Surra Staff Present:City Manager Michael R.Lee City Clerk Kathleen Connelly City Attorney Glenn Gimbut Lt.Steve Francis City Engineer Gordon Grandy Public Works Supt.Doug Dobson Acting Director of Devel.Servs./ Planning Mgr.Jim Nakagawa Library Director Pam Loui Finance Director Keith Lewis Parks & Rec.Director Jeff Bell Acting Deputy Zoning Admin.Lora Isaacs Personnel Asst.Jackie Trevino FY 1994-95 BUDGET )City Manager Mike Lee gave the council a financial update on city sales tax,revenues,expenses,and financial investments.He suggested the council review the changes they discussed at the last budget session in order to see how that has affected the budget.He asked the finance director to brief the council on that. Finance Director Keith Lewis briefed the council on budget changes due to a 5% merit increase which is an expense, LTAF (Lottery Transportation Assistance Funds)which shows as a surplus due to the fact that it can only be used on streets,and city sales tax which has SPECIAL MEETING OF THE CITY COUNCIL JUNE 1,1994 PAGE 1 OF 19 been good due to the state sales tax and the city sales tax collection program. Councilwoman Surra asked what was the dollar amount on the 5% merit and how that was figured out. Mr.Lewis answered that was figured out on the assumption that everyone were to receive their merit increase on their anniversary day which vary throughout the year,but not everyone is getting the 5%,and the amount is $113,000.He explained the Revenue and Expenditure By Fund table in the budget and indicated that some of the COLA could be worked out from the Highway Users fund because not all of that money is always used and right now it is much higher than it has been in the past. City Manager Mike Lee explained that the cash carry over is high because they budgeted about a full 5% merit increase. Vice Mayor Barker commented that the 5% was high and stated there are some people in the city who are at the top of that merit and she would like to find some way to address that. Mr.Lewis replied this year there are thirteen people who are at the top and would not have any merit increase, and there are some others who can get from one through four percent. Councilman Perkins recalled that at the last budget meeting they discussed the need to review the merit system and how merit is applied.He also stated that the council cannot depend on the merit as a cost of living increase but they needed to address each one separately. Vice Mayor Barker stated that if they were going to look at combining the merit and COLA,she would like the combination of that be no more than 5%. Councilman Perkins asked if that would not be using the merit for COLA again in that sense. Vice Mayor Barker answered she did not think so. Councilwoman Surra added that COLA affects everybody whether they are at the top or not. Councilman Perkins asked if they mean that if they give a 2% COLA,they top merit at 3%. SPECIAL MEETING OF THE CITY COUNCIL JUNE 1,1994 PAGE 2 OF 19 Vice Mayor Barker added that in that way they are looking at the same figure of 5% but still addressing those people who are at the top of the merit increase. City Manager Mike Lee stated that (the 5% merit plus the 2% COLA) would be slightly higher than the 2% COLA and the 3% merit,because the 2% would be through the whole year for every employee but the 5% merit would be for different employees at different times of the year. Councilwoman Surra that it also assumes that everybody gets the 3% merit but they probably will not. Councilman Perkins asked if they were going to follow the scenario of staff's efforts to review the merit system with percentages that can be reached or if they were going to come back every year with different figures. Vice Mayor Barker replied that it is the council's prerogative whether they set up a system or not but it is also the council's job to look at the condition of the budget and in turn look at the kind of raise which is going to be given dependent upon that. Councilman Perkins asked if they were going to direct staff about the merit not to just set a given number but to set a system where the merit increase would be given based on the job description and beyond that.He asked if they were going to change the merit system now or if they were going to use as it is and then implement a new merit system in the upcoming budget year. Councilman Perkins asked if the council never adopted the merit system as is. Mr.Lewis answered not as a percentage figure. SPECIAL MEETING OF THE CITY COUNCIL JUNE 1,1994 PAGE 3 OF 19 City Clerk Kathy Connelly replied yes,by definition in the personnel policies there is a percentage,a number set. Mr.Lee added that city employees who have worked for more than few years have an expectation that if they are evaluated and receive the maximum rating,they will receive a 5%.He agreed that it is the council's prerogative to change that amount based on budget requirements. Vice Mayor Barker stated that if they left that 5% and wanted to add COLA at 1% or 2% or 3%,it would be 8% total which the city cannot afford.She asked if a 3% merit increase would alter the system terribly. Mr.Lee answered no and suggested to be consistent on a percentage from year to year. Councilman Hendricks replied that the economy was not being consistent. Councilman Perkins explained the reason why he brought up this discussion;so that staff understands where this council would like the merit system go.He stated that staff suggested to stay with what is in place today,look at it during this year,and come up with a new merit system to put in place for next budget year. Vice Mayor Barker replied that if they are going to include COLA on top of that in order to take care of the people who have topped out on their merit increase,it is going to be detrimental. Councilwoman Surra agreed with Vice Mayor Barker.She suggested for this year to give employees the merit increase based on the last or current salary and then give them COLA based on the salary before the merit increase,making it a total of 5%.She agreed on the need to revise the merit system and instead of basing that on percentage, she suggested to have a pool of money in the budget to be allotted to departments based on the salary percentage for that department and have the department head allot that money to each employee in his/her department. Councilman Coleman stated that the problem he sees with that method is that it puts employees in direct competition with their co-workers. Councilwoman Surra replied that it would be based on performance and explained further how it might work;that they needed to look at different ways of doing that;and what she suggested was not the only way. SPECIAL MEETING OF THE CITY COUNCIL JUNE 1,1994 PAGE 4 OF 19 Councilman Perkins asked if they were going to budget those funds at the beginning of the year because they think they have them or at the end of the year because they know they have them. Councilwoman Surra answered that they would need to be make projections in that area too. Councilman Perkins suggested to not do that this year because he thinks there are funds available to do both the merit and COLA,and the merit system should be revised later. Councilwoman Surra agreed with Councilman Perkins but disagreed with a 5% merit plus COLA.Instead,she suggested that both should be within the 5% which has already been projected. Councilman Perkins replied that according to the figures they can do a 5% merit and a 2% COLA through the year. Councilwoman Surra replied she did not understand why they have to spend everything that comes in. Councilman Perkins emphasized that city employees have not received a merit increase in three years and they were expecting it this year;that the funds are available and they may have to spend everything but they need to take care of that. Councilwoman Surra replied that was not being financially responsible. Mr.Lee explained that the contingency fund had been increased this year. Councilman Perkins insisted he did not see a problem with a 5% merit and a 2% COLA this year. Vice Mayor Barker stated she would prefer to give the same thing on an annual basis because we have the funds. She asked what was the percentage increase in the budget this year. Mr.Lewis answered it was about 5%. Vice Mayor Barker asked how many new positions were added this year. Mr.Lee answered there were about five or six. Mr.Lee answered no but it has stabilized in the last two years. Councilwoman Richmond stated insurance should be taken into consideration as something employees are receiving which is an increase coming out of the budget and it is a benefit . Mr.Lee added that the city pays about 47% to 48% of employee's dependent coverage.He recommended the council for this year to leave a merit increase up to 5% and not to include COLA,and he explained that employees who have topped out on the merit increase were told,when they were hired,that would eventually happen. Vice Mayor Barker stated if that is left in place,a lot of employees would get the 5%. Mr.Lee replied it would be more difficult for department heads not to give employees the full 5% if there is no COLA,but management will continue to encourage them to use the merit system the way it is intended;to reward employees based on performance. Councilman Hendricks asked if people who are topped out on their salaries will get nothing. Mr.Lee answered that was right unless they get reclassified or promoted. Councilwoman Surra asked if their salary range never moved from the day they were hired. Mr.Lee answered it was moved at the time they did the wage and salaries study about five years ago which resulted in a reclassification for a lot of positions.He added that it is probably time to do that again but it is of no use if they are going to change the merit system. Councilwoman Surra stated she did not understand why we would not want to do that regardless of the merit system;if the job is technically not competitive with the rest of the world, then raise that lower base. Mr.Lee replied they could not do that until they know what kind of a merit system they are going to have. Councilwoman Surra disagreed with that. City Clerk Kathy Connelly answered that was for newspaper ads such as "Congratulations Class of 1994"and the Lost Dutchman Days program. done as a city or as Mayor and Council. Vice Mayor Barker asked if that is Mr.Connelly answered that it is in the Mayor and Council budget but it is done as a city and it has been in their budget for many years,but it can be in non -departmental. Vice Mayor Barker asked about the Replace Sound System Equipment line item. Ms.Connelly answered that was a guess on what it might cost to replace that and informed the council about quotes from Troxell Communications on some improvements to the council chambers such as lighting and sound system. Ms.Connelly replied she is not familiar with the technology out there so she is at a disadvantage and at their mercy. Councilman Hendricks suggested that if this equipment is being damaged due to cigarette smoke,we should ban smoking in this building. Ms.Connelly stated that the actual guts to the sound system is in the jury room and that is also the court's smoking room;also the guts to the telephone system to this building is in there. Councilman Hendricks suggested to ask people to go smoke outside. Ms.Connelly commented that people waiting to see the judge need to be monitored so that they do not try to play with the sound system.She added that according to Troxell the new microphones were removable. Councilwoman Surra asked if there was another company that can do that. Ms.Connelly answered Troxell is the company recommended by Triax Cable and the one who came up when we contacted other cities. Councilwoman Surra asked if there was going to be a revised figure for that to be placed in the budget or if they can put that figure as is in the budget. Ms.Connelly answered they could put that in the budget by motion. Planning Division Mgr.Jim Nakagawa added that figure excluded the cost for having to rewire the hardware. Ms.Connelly replied that the cost for the sound system includes their installation and wiring but the lighting cost does not include the wiring and they suggested we use our own electrician to do that. Councilwoman Surra asked if all that is to enhance the lighting in the room. SPECIAL MEETING OF THE CITY COUNCIL JUNE 1,1994 PAGE 9 OF 19 Ms.Connelly answered yes but that is not so bad. Councilwoman Surra asked if it might make a difference if the video camera is placed further back. Ms.Connelly answered that it might. Councilwoman Surra asked if they wanted to do that and if lighting was a problem for any other function which is held in the council chambers. Ms.Connelly answered no as far as she knows and added that actually the lighting was a small cost. Councilman Perkins asked if we have attempted to play a tape on cable to see at the kind of quality we can get and if this is something we need to do right now or if the city can get by with what we have now for the public.He added he did not foresee the council using this chambers for ever and suggested to delay this expense for something more permanent. Councilwoman Surra asked if he was talking about the sound system. Councilman Perkins answered he was talking about everything. Vice Mayor Barker replied that if that had to be done here anyway,they might as well go ahead. Councilman Perkins stated they may just need to repair the sound system instead of replacing it. Vice Mayor Barker stated that what we have does not prohibit showing something on the air and we may not be able to do something professional right away. Councilman Perkins reiterated that video taping of council meetings did not have to be high quality. Councilwoman Surra stated that the sound system was not only important for video taping but for the record of not only council meetings but for court proceedings. Ms.Connelly added that there are other boards and commission which use this sound system. SPECIAL MEETING OF THE CITY COUNCIL JUNE 1,1994 PAGE 10 OF 19 Councilwoman Surra stated they should fix the sound system to make sure there are good,clear recordings for the record. Ms.Connelly stated that what we have needs to be repaired and protected. Vice Mayor Barker stated it needs to be something movable. Councilman Perkins agreed that smoking should be taken away from the sound system. Ms.Connelly stated she would contact Troxell to see if they could offer an intermediate proposal.She suggested for the future council chambers they consult an expert on design and acoustics. have needs to be repaired and protected. be something movable. The council moved on to discuss Personnel budget. Vice Mayor Barker asked about the Printing,Binding line item. Personnel Asst.Jackie Trevino answered that was for the Policies and Procedures. Councilman Hendricks asked about the Travel,Training,Conferences line item. Ms.Trevino answered they are going to do a lot of in-house training and films on changes in federal law and other areas of concern. Vice Mayor Barker commented on an across-the-board budget of over $50,000 a year for Travel,Training,and Conferences,which comes up to $333 a piece and that includes all of the council members. City Clerk Kathy Connelly suggested the council to take advantage of that in their budget. Vice Mayor Barker agreed with that. Councilman Perkins asked if there was no office space for a full time Prosecutor or Assistant City Attorney in the new police building. SPECIAL MEETING OF THE CITY COUNCIL JUNE 1,1994 PAGE 11 OF 19 City Attorney Glenn Gimbut suggested to look at this in January 1995 for the new budget year,after the new police building is built and there will be space in the old building for that. Councilman Perkins stated he brought this up because Mr.Gimbut requested an increase on his budget for that purpose and that needed to be considered. Vice Mayor Barker agreed with Mr. Gimbut's suggestion. Vice Mayor Barker noticed a vehicle budgeted in Non -Departmental and asked who's vehicle that was. Mr.Lewis explained that it would be used as a pool car. Councilman Hendricks asked if in the discussion of salary increases they included the city attorney. Mr.Lewis answered no. Councilman Hendricks asked to address that matter now and asked if the city attorney's salary has been increased. City Attorney Glenn Gimbut answered not since he began with the city,except a 2% COLA. Councilman Perkins asked if he is entitled to COLA and if he receives it. Mr.Lewis stated that COLA is given automatically for the city manager and the city attorney. Councilman Hendricks stated he brought this up so that nobody is left out from receiving a salary increase. Vice Mayor Barker commented that the city attorney's pay was set by contract and that this should be done at the time of contract negotiations. Vice Mayor Barker recalled council's discussion with Main Street about the median,park,and entry signs,and asked if the funds for those things were already in. Mr.Lee answered that funds for those things will come out of the streets budget. SPECIAL MEETING OF THE CITY COUNCIL JUNE 1,1994 PAGE 12 OF 19 Vice Mayor Barker asked why then their funds were raised in the Non -Departmental budget. Mr.Lee answered that was our three- year commitment for administrative costs. Vice Mayor Barker asked about Other Services in Non -Departmental. Mr.Lewis answered that line was for emergency situations when certain things come up which have not been budgeted, instead of using contingency money. Vice Mayor Barker stated it was good to have that kind of savings. Councilman Hendricks asked if we used that fund for the Chamber of Commerce when they asked for additional money. Mr.Lewis agreed on that. Councilman Perkins suggested to address the Magistrate Court in case they wanted to move funds over for that department in Non Departmental. Councilman Hendricks stated that according to Mr.Lee the new presiding magistrate was going to be able to give input on the budget at the end of the month. Councilman Hendricks asked about the Wastewater Treatment line item. Mr.Lewis answered he was asked to put this in there for what he thought was a study on wastewater treatment which the city was going to do. council requested that. remember. the sewer hookup fees. Development Services and maybe Parks. Councilman Hendricks asked about the Mr.Lewis answered that was for Mr.Lee itemized those expenses. Vice Mayor Barker asked about Planning Division Mgr.Jim Nakagawa Councilwoman Surra asked how many Mr.Nakagawa answered probably just Councilwoman Surra replied that anything done in Planning on their MacIntosh is not going to be read by any of the other departments. Mr.Nakagawa stated it is not necessarily so because they have both software and hardware tools available to read it. Councilwoman Surra suggested to standardize the computer system in the city. Mr.Nakagawa explained that his experience with computers convinced him to go with MacIntosh. Councilwoman Surra commented in favor of having computer equipment that is compatible. Ms.Connelly explained a problem we encountered when the new phone system was installed.We had considered electronic mail but because people were using different types of equipment,it would have to be changed to something uniform in order to be able to use the Email system,so we did not pursue it. Mr.Lewis stated he tries to standardize equipment for maintenance service reasons also. Mr.Nakagawa explained that MacIntosh is faster and easier to use. SPECIAL MEETING OF THE CITY COUNCIL JUNE 1,1994 PAGE 14 OF 19 Mr.Lee stated that the Economic Development Commission was given council direction to come up with an economic development plan and hopefully on June 21 the council will have a recommendation on that.He further briefed the council on funds budgeted for that purpose and the possibility of hiring a full-time development services director with economic development background to fill the vacancy in that office. Vice Mayor Barker asked if the money budgeted is an option while they wait for the commission's recommendations. Mr.Lee explained that this funding will not affect the contract with the Chamber of Commerce. Vice Mayor Barker asked about the Parks and Recreation Administration budget and what the Office Equipment line item was. Parks & Rec.Director Jeff Bell answered it was for a computer scanner. The council further discussed Mr. Bell's computer needs and budgeted money for office equipment for his department. Councilwoman Surra asked why that was not included last year. Mr.Bell explained that they overspent other line items and that made the bottom line come up. Councilwoman Surra asked if he used capital money for other expenses last year. Mr.Bell answered no. Mr.Lee stated that when they approve the budget for each department they approve the bottom line for each line item so there is some flexibility;if they need more money in one line item,they can take it from another line item,as long as it does not go over the total budget. Vice Mayor Barker clarified that the $3,000 in Administration is for the folding tables and chairs and the $4,000 in Recreation is for scanner,software and a printer. Councilman Hendricks asked if Parks & Recreation Administration was also asking money for a cellular phone and if there was a pool of phones. The council discussed the extra phone at the court and the possibility of making it available to others. Vice Mayor Barker asked about the Parks Maintenance Coordinator position;Other Professional Services; Subscriptions and Memberships;and Travel,Training,Conferences. Mayor Perkins asked about Parks's Small Tools and Equipment and Mr.Bell answered the mayor's questions. City Engineer Gordon Grandy requested $1,000 for a surveyors level.The council approved of it. The council discussed the Public Safety Administration budget.Lt.Francis answered the council's questions. Councilwoman Surra asked about the Clerks,Dispatcher Assistant,and Administrative Clerk II positions. Personnel Assistant Jackie Trevino explained that. Mayor Perkins enquired about the endurance of dispatchers in the police department.Lt.Francis answered that question. Councilwoman Surra asked if there was a new job description for the proposed clerk position.Mr.Trevino answered she thought there was one. Councilman Hendricks asked about the rent line item in Detective's budget.Lt.Francis and Mr.Lee answered that. Lt.Francis explained the Overtime line item. Mayor Perkins commented on the compensatory time in general and disagreed with the way that is being handled. Lt.Francis offered the council the figures for compensatory time in the police department for last year.The council agreed on that. Councilwoman Surra commented that overtime is documented in payroll but compensatory time is not very well kept. She spoke in favor of paid overtime over comp time and stated that should be applied equally throughout city departments. SPECIAL MEETING OF THE CITY COUNCIL JUNE 1,1994 PAGE 16 OF 19 Mr.Lee asked about comp time in the police department.He stated it should not be carried over the work week when it is accrued. Councilman Perkins asked if the council did not discuss that issue about three years ago and it was agreed that it was going to change. Ms.Trevino answered that the city has established policies regarding that. Lt.Francis stated he could change the comp time with overtime in his department but there may not be money to pay for all that. Councilwoman Surra suggested that problem could have been brought up to the city manager and a request for money could have been submitted at this budget meeting for approval. Lt.Francis replied he was not aware of the right way to handle comp time.Ms.Trevino replied there is a difference in practices and policies. Vice Mayor Barker suggested the city manager meet with the Lt.Francis about that problem and make a recommendation to the council. Councilman Perkins stated they need to look at the comp time that is being accrued and determine the need for additional personnel. Councilwoman Surra stated they could have determined the need for more personnel if overtime had been paid and they could see how much that was. Vice Mayor Barker suggested that communication with the city manager had to be improved to prevent this problem from happening in the future.The council decided this may be a problem with other departments as well. Public Works Supt.Doug Dobson explained how he applies comp time in his department. Mr.Lee replied that is fine as long as they comply with the Fair Labor Standards Act. City Attorney Glenn Gimbut stated that FLSA would treat different areas in a different manner;for example law enforcement is treated different than other people.He suggested for all SPECIAL MEETING OF THE CITY COUNCIL JUNE 1,1994 PAGE 17 OF 19 department heads to meet with the city manager to clarify what the law says in that area. Vice Mayor Barker suggested to move on with the budget.The council had no more questions on the budget. Mr.Lee explained Street Construction in the Public Works Streets budget. Mr.Lewis clarified the 3% merit based on current pay scale and 2% COLA based on current pay scale and not on top of the 3% merit;and $1,000 for the surveyor's level. Councilwoman Surra asked Mr.Lee to provide figures on the police department's accrued comp time along with his recommendation,to see if another person is needed there. Mayor Perkins stated she had asked for a date for the next budget discussion. Ms.Connelly suggested they could pick a date tonight or at their next meeting (June 21). Vice Mayor Barker suggested to do it Tuesday night after Mr.Lee's recommendations or any additional information he might be able to give the council prior to that meeting,as well as the input from the new Presiding Magistrate.
