CALL TO ORDER Mayor Perkins called the meeting to order INVOCATION Councilwoman Surra gave the Invocation. PLEDGE OF ALLEGIANCE Councilwoman Richmond led the Pledge of Allegiance. Councilwoman Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. AWARDS.PRESENTATIONS AND COMMUNICATIONS Mayor Perkins presented a proclamation for Reach Out Food Bank Food Drive Month. CALL TO THE PUBLIC Harry Ignatovich addressed the council regarding traffic problems at Phelps Drive. Susan Brenton addressed the council regarding the Planning and Zoning Commission request on manufactured homes and made suggestions regarding possible staff research. Scott Butler,attorney representing the manufactured housing industry,addressed the council regarding the Commission proposal to limit manufactured homes. Jim Brinkman addressed the council regarding the Commission proposal to limit manufactured homes. E.Laabs addressed the council regarding the Commission proposal to limit manufactured homes. Keith Stachar addressed the council regarding the Commission proposal to limit manufactured homes. Dave O'Malley addressed the council regarding his request for improvements and rehabilitation of his property. REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 15,1994 PAGE 2 OF 10 Tony Vehon updated the council regarding the proposed sewer system. CITY MANAGER'S REPORT Interim City Manager George Hoffman updated the council on the progress of the new Department of Public Safety building and the Public Library expansion.He informed the council about the event held by the Law Enforcement Rodeo Association on November 5-6 at the rodeo arena;the city staff participation at the 1994 School District sponsored Health Fair;the Main Street's draft survey for the Design Review project;the city departments help at the Veteran's Day Parade on November 12th;the status of the Teen Town Hall focus group; the status of the recruitment for the new city manager;and the city cleanup week.He briefed the council about his calendar of activities. PUBLIC HEARINGS ORDINANCE NO.917,PZ-94-07,REX DAVIS, JEFF SNYDER AND JASON DAVIS,REPRESENTED BY LORRY FRAZIER )Planning Division Mgr. Jim Nakagawa briefed the council on this item.He stated that Planning and Zoning Commission recommended approval of this rezoning and staff concurs with that. Mayor Perkins opened the public hearing.There being no one wishing to speak on this item,she closed the hearing. CouncilwomanSurraMOVEDTHATORDINANCE NO.917 BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilwoman Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. City Clerk Kathy Connelly read,"AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-94-07 FROM GR (GENERAL RURAL)TO CR-1(MH), SINGLE-FAMILY RESIDENTIAL (CONVENTIONAL OR MANUFACTURED HOMES PERMITTED ON 20,000 SQUARE -FOOT MINIMUM LOTS);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY." CouncilwomanSurraMOVEDTHATORDINANCE NO.917,AS READ BY THE CITY CLERK,BE APPROVED AND ADOPTED. REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 15,1994 PAGE 3 OF 10 Councilwoman Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. OLD BUSINESS None. NEW BUSINESS REQUEST FOR CONTINGENCY FUNDS FOR AMERICANS WITH DISABILITIES ACT (ADA),OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION (OSHA)AND FIRE SAFETY IMPROVEMENTS )Interim City Manager George Hoffman briefed the council on this item.He explained that contingency money was needed to make city facilities more accessible and safer for employees and the public in compliance with ADA,OSHA,and fire safety standards. would be enough for that. Councilman Coleman asked if the $20,000 Mr.Hoffman answered that it would. Councilwoman Surra inquired about plans for the restrooms and made some recommendations.She suggested that i f the community swimming pool is also used by the schools for their activities,they should help with funding for the improvements. Mr.Hoffman replied they will ask for that. Councilwoman Surra asked if the flag pole at City Hall could be relocated since it was right on the middle of the sidewalk. Mr.Dobson replied that the sidewalk was going to be widened. Councilwoman Richmond MOVED THAT AUTHORIZATION BE GIVEN TO THE INTERIM CITY MANAGER TO EXPEND UP TO $20,000 IN CONTINGENCY FUNDS TO BRING CITY FACILITIES INTO COMPLIANCE WITH ADA/OSHA/FIRE SAFETY REQUIREMENTS. REQUEST FOR PURCHASE OF COMMUNICATIONS EQUIPMENT FOR NEW PUBLIC SAFETY FACILITY ) )Chief Galloway briefed the council on this item.He stated that this expenditure was budgeted and described the equipment. Councilman Coleman inquired about the repeater equipment. Chief Galloway replied that all of the external equipment outside the building, which includes the repeater except for the tower, will not be replaced;only the dispatch console and the hardware will be replaced. Councilman Coleman inquired about the two repeaters listed and suggested that one of them could be used as an amateur radio repeater for public service and emergency situations. Councilwoman Surra clarified the two repeaters listed were not part of the purchasing package. Chief Galloway replied it would be a good thing to have two repeaters and that he would look into that. Councilman Perkins MOVED THAT AUTHORIZATION BE GIVEN TO EXPEND BOND FUNDS IN THE AMOUNT OF $72,540.14 FOR PURCHASE OF COMMUNICATIONS EQUIPMENT FOR THE NEW PUBLIC SAFETY FACILITY FROM MOTOROLA UNDER ARIZONA DEPARTMENT OF ADMINISTRATION CONTRACT NO.01152AA. Councilman Hendricks SECONDED THE MOTION. VOTE:Unanimous. The motion carried. REQUEST FOR PURCHASE OF POLICE VEHICLES ) )Chief Galloway briefed the council on this item.He explained that they needed to replace some old vehicles. Councilwoman Surra asked if the used vehicles to be purchased were fully equipped for police use. Chief Galloway confirmed that. REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 15,1994 PAGE 5 OF 10 Councilman Hendricks MOVED THAT AUTHORIZATION BE GIVEN TO PURCHASE SEVEN USED 1992 FORD CROWN VICTORIA POLICE PACKAGE VEHICLES FROM THE SUN CITY POSSE AT A COST OF $8,000 EACH. Councilwoman Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. RESOLUTION NO.94-32:CALL OF ELECTION FOR THE 1995 CITY PRIMARY AND GENERAL ELECTIONS )City Clerk Kathy Connelly briefed the council on this item.She explained that even though state law no longer requires a call of election by resolution,it was recommended to continue doing this because it was a good way to inform the public about it. Councilwoman Surra MOVED THAT WE APPROVE RESOLUTION NO.94-32:"DESIGNATING THE ELECTION DATE AND PURPOSE OF ELECTION;DESIGNATING THE DEADLINE FOR VOTER REGISTRATION;AND DESIGNATING THE PLACE AND THE LAST DATE FOR CANDIDATES TO FILE NOMINATION PAPERS." Councilman Coleman SECONDED THE MOTION. VOTE:Unanimous. The motion carried. ECONOMIC DEVELOPMENT AGREEMENT WITH APACHE JUNCTION MAIN STREET PROGRAM,INC. )Interim City Manager George Hoffman briefed the council on this item.He indicated that Mr.Tony Vehon and Mrs. Tonya Williams of Main Street were present. Councilwoman Surra asked if there was any duplication of effort. Mr.Hoffman explained that there was none. Councilman Coleman MOVED THAT THE ECONOMIC DEVELOPMENT AGREEMENT WITH MAIN STREET PROGRAM,INC.FOR FISCAL YEAR 1994-95 BE APPROVED, AND THAT AUTHORIZATION BE GIVEN TO THE INTERIM CITY MANAGER TO EXECUTE THE AGREEMENT. Councilwoman Richmond SECONDED THE MOTION. REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 15,1994 PAGE 6 OF 10 VOTE:Unanimous. The motion carried. She reconvened the meeting. COUNCIL DIRECTION TO STAFF ON PROPOSED LEGISLATION OR ACTIONS Mayor Perkins recessed the meeting. MANUFACTURED HOMES (PLANNING AND ZONING COMMISSION REQUEST TO INVESTIGATE ISSUES RELATED TO M.H.) )Planning Division Mgr. Jim Nakagawa briefed the council on this item.He explained that the Commission asked staff to explore the possibility of limiting manufactured homes to certain areas in the city and they came up with seven options.He stated the Commission chose two of the options and is asking the council to authorize staff to research these. Councilman Coleman stated he would like to know what the requirements for manufactured homes are in other communities concerning this issue. Councilman Coleman. staff research all seven options. Commission's intent. Councilwoman Surra concurred with Councilman Perkins suggested to have Mr.Nakagawa replied that was not the Councilman Perkins explained why he would like to have information on the other options as well. Councilman Hendricks suggested to have a work session and ask the chairman of the Commission to explain their recommendations to the council. Councilman Hendricks council intended to what the Commission request. council wants staff Councilwoman Surra agreed with City Clerk Kathy Connelly asked if the have that work session before giving direction to staff on is requesting,or if they wanted staff to comply with that Councilwoman Surra answered that the to research all of the options. REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 15,1994 PAGE 7 OF 10 Ms.Connelly asked i f the council wanted that information before Planning starts scheduling public meetings on this and advertising costs are incurred. Councilwoman Surra stated she thought this issue was already part of the General Plan meetings. Mr. Nakagawa explained that it was not. Councilman Perkins asked i f the Commission was asking staff to draft an ordinance for this. Mr. Nakagawa answered that they wanted only information at this time in order to be able to make a recommendation in the form of a policy to the council,which later might be implemented with the adoption of an amendment to the Zoning Ordinance or something else. Councilman Perkins stated i t was important to look at information on all of the options before they consider an ordinance. Interim City Manager George Hoffman asked when staff could have this back to the council. Mr.Nakagawa answered i t might take several months. Mr. Hoffman suggested that instead of doing an extensive research,staff set a time to come back with whatever information they can have by then. Councilman Perkins stated that extensive and thorough research needed to be done. Councilwoman Surra suggested that staff distribute information to the council as they gather it for the council to study it and then bring it to a work session for discussion. Councilman Perkins agreed and suggested that when the research is close to completion,Mr.Hoffman inform the council so that they can set up a meeting for that. Mr.Nakagawa explained this was a controversial subject and that he would like to get the input from representatives of the manufactured homes industry. Councilman Perkins MOVED THAT THE FOLLOWING DIRECTION BE GIVEN TO STAFF REGARDING MANUFACTURED HOMES:THAT A THOROUGH AND COMPLETE REPORT BE PUT TOGETHER AND BE DISTRIBUTED TO THE COUNCIL REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 15,1994 PAGE 8 OF 10 AS THEY ATTAIN THE INFORMATION REGARDING THE (PLANNING'S) MEMO DATED NOVEMBER 4, 1994, TO INCLUDE ALL SEVEN AREAS;AND THAT STAFF UTILIZE ANY OUTSIDE GROUPS THAT MAY BE INTERESTED IN HELPING TO ATTAIN THIS INFORMATION; AND WHEN THEY FEEL THEY ARE ABLE,TO COME BACK TO THE COUNCIL WITH A COMPLETION DATE OF THIS PROJECT. Councilwoman Surra SECONDED 'THE MOTION. Councilman Perkins ADDED TO INCLUDE A SURVEY OF NEIGHBORING CITIES AND CITIES OUR SIZE AND WHAT THEY HAVE DONE WITH THIS ISSUE. Councilwoman Surra CONCURRED WITH THE ADDITION TO THE MOTION. VOTE:Unanimous. The motion carried. SELECTION OF MEETING DATES.TIMES.LOCATIONS.AND PURPOSES Councilman Hendricks MOVED THAT AN EXECUTIVE SESSION AT 6:00 P.M. AND A WORK SESSION AT 7:00 P.M. BE HELD ON MONDAY, DECEMBER 5,1994,IN THE CITY COUNCIL CONFERENCE ROOM AND CITY COUNCIL CHAMBERS RESPECTIVELY;AND THAT AN EXECUTIVE SESSION AT 6:00 P.M.BE HELD ON TUESDAY, DECEMBER 6,1994,IN THE CITY COUNCIL CONFERENCE ROOM. Councilwoman Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. INFORMATION AND REPORTS Mayor Perkins informed the council about the Veteran's Day Parade.
