CALL TO ORDER Mayor Perkins called the meeting to order at 7:00 p.m. INVOCATION Councilman Perkins gave the Invocation. PLEDGE OF ALLEGIANCE Councilman Hendricks led the Pledge of Allegiance. CALL TO THE PUBLIC W.Dean Thorpe addressed the Council in opposition to any proposed pad tax or tax on winter visitors. Keith Stachar addressed the Council in opposition to any additional pad tax on winter visitors. Frank Kennemur addressed the Council in support of a pad tax on winter visitors. John Insalaco addressed the Council in opposition to a pad tax on winter visitors. Rob Schulenberg and Ruth Hart thanked the Mayor for the city proclamation supporting the Tough Love program. Gary Mulholland addressed the Council regarding upcoming Lost Dutchman Days and announced that Parks and Recreation Director Jeff Bell had been selected as the 1994 Honorary Lost Dutchman. Steve Crane addressed the Council regarding failure of the Zoning Division to follow up on his complaints and enforce city zoning regulations; problems with city ordinances regarding pre -HUD mobiles on private lots; REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 1,1994 PAGE 2 OF 16 problems with speeding on Ironwood and Superstition;problems with the way in which the Police Department handled the theft of his bicycle. CITY MANAGER'S REPORT City Manager Mike Lee reported that the rodeo grounds is fifty percent completed and it should be useful for Lost Dutchman Days.He gave a financial report and stated that expenditures,although they were within budget,are barely breaking even with what was budgeted;that about revenues,compared with the long trend over the past few years,we still need to find some other solutions to increase revenues even more or find ways to decrease expenditures. PUBLIC HEARINGS SPECIAL EVENT LIQUOR LICENSE APPLICATIONS BY ROTARY CLUB FOR LOST DUTCHMAN DAYS ) )City Clerk Kathy Connelly reminded the Council that at the last meeting they looked at identical Special Event Liquor License Applications for the Chamber of Commerce;that at that time the Chamber indicated that Rotary Club may sponsor these licenses for the Chamber and so that is what has happened.She added that we have received the certificate of insurance naming the City as an additional insured. Ms.Carol Doty,Director of the Chamber of Commerce,stated that Rotary Club can in fact apply for the license at no charge for the liability premium so the Chamber is saving a considerable amount of money by doing this;that the club is also going to man the beer trucks and receive a percentage from the sale;and that the State is holding off on the Chamber's applications. Mayor Perkins opened the public hearing;there being no one wishing to speak,she closed the public hearing. Councilman Perkins MOVED THAT THE SPECIAL EVENT LIQUOR LICENSE APPLICATIONS FOR ROTARY CLUB FOR THE 1994 LOST DUTCHMAN DAYS,BE RECOMMENDED FOR APPROVAL TO THE ARIZONA DEPARTMENT OF LIQUOR LICENSES AND CONTROL. VOTE:Unanimous. The motion carried. ORDINANCE NO.886:AMENDING CITY CODE SECTION 8-5-1 AND ARTICLE 8-10 CART VENDORS )City Clerk Kathy Connelly briefed the Council on direction given to staff on December 7th to amend this section REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 1,1994 PAGE 3 OF 16 of the Code to allow for something a bit larger and a bit different from cart vendors.She further explained the changes to the Council. Vice Mayor Barker asked what is the difference in changing it from cart vendors to temporary food and beverage concession trailer vendors;if the word "trailer" makes the difference. Ms.Connelly read the definition of cart vendors and stated that the difference was the "temporary basis" which is seven consecutive days. Vice Mayor Barker asked if "concession trailer vendors"is the other difference. Ms.Connelly affirmed that and stated that the temporary basis does not only apply to cart vendors but also to permanent businesses to set up at secondary locations;so somebody who might be a full-time business can also have a part-time swap meet park operation.She stated there is another section of the Code that explains what temporary basis means for a full-time,non -food -and -beverage vendor. Vice Mayor Barker stated she recalled a discussion where a vendor spoke at Call to the Public or at some other point during the meeting,who said that the size of their portable vending cart was "x"and that our ordinance prohibited that size,which was the size that the majority of those types of vendors normally had,and she remembers that precipitating this issue. Ms.Connelly replied there were two people;a man who had a much larger vehicle and a woman who had a hot dog cart that was larger than what the ordinance allows and those are two different things. Vice Mayor Barker stated she understood that the idea was to give some extra footage to the definition so that we could accommodate what appeared to be some common statistics in vending carts;that she did not realize some of these changes were also part of that. Ms.Connelly reminded the Council they talked about some time limitations;that there was some hesitation on the part of the Council not to allow the larger vehicles on an ongoing basis;that there were also some internal problems with explaining to cart vendors what the rules and regulations were;and that part of the Council direction to staff was to look at this ordinance and make other recommendations on basically cart vendors.She further explained the changes. Vice Mayor Barker stated she was now understanding the amendments to the ordinance. REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 1,1994 PAGE 4 OF 16 Ms.Connelly explained that since this ordinance has been in the Code,about two years,there have been lots of little things that were difficult to explain,so staff looked at this as an opportunity to make the changes. Vice Mayor Barker asked if this ordinance is now in a way that will help us out and give us the opportunity to simply revisit it,maybe once a year or every two years to update it,rather than revamping it again. Ms.Connelly affirmed that and stated that the problems were that the ordinance had been written so strictly to accommodate one particular vendor,but these changes make it more universal,it broadens the categories,it accommodates small and large cart vendors;and it also allows the permanent businesses a greater opportunity for promotional events. Vice Mayor Barker stated this ordinance has some consistency all the way around. Ms.Connelly agreed with that and asked the Council not to customize it because that will take them back to where they were before. Councilman Perkins asked increased fees a certain percent that we do not have to revisit it Ms.Connelly replied she of the Town of Gilbert vendor license application and their fee is year with an annual renewal of $100.00 and they also have a $50.00 refundable application fee. Vice Mayor Barker stated should revisit all of our fees and do a schedule change. Ms.Connelly stated that the ordinance the term "cart vendor" was replaced with "temporary beverage vendor"and if it happens that we have two types of busin are almost identical,then we can create two sets of rules,but we an opportunity to have just one section that deals with everything intent is real clear. worked on this ordinance feel that way. if we again. saw a copy $150.00 per non- that we in most of food-and- esses that saw this as Vice Mayor Barker asked if the Ms.Connelly replied that those who Vice Mayor Barker stated that also those who come in and the Council should read the same intent. Mayor Perkins asked if there was no time limit on a permanent location such in the case of a private business which decides they want a hot dog vending cart on their property. Ms.Connelly answered that this ordinance does not allow for that to happen;that she would have do defer i t to Zoning to see if there would be other problems like if that would become a second structure on the property,or if it would require a special use permit. Planning Division Mgr.Jim Nakagawa stated that Zoning would not allow a business in a residential area,so it would not be zoned properly. Mayor Perkins stated that her neighbor has a hot dog vending cart who talked to a person who indicated that they might have a permanent one,so she was bringing this up so that the person will know what the requirements are. Councilman Coleman MOVED THAT ORDINANCE NO.886 BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Vice Mayor Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. City Clerk Kathy Connelly read,"AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE CHAPTER 8 BUSINESS,ARTICLE 8-5 BUSINESS OCCUPATIONAL LICENSE TAX,SECTION 8-5-1 DEFINITIONS AND ARTICLE 8-10 CART VENDORS;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. Councilman Coleman MOVED THAT ORDINANCE NO.886 AS READ BY THE CITY CLERK BE APPROVED AND ADOPTED. Vice Mayor Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 1,1994 PAGE 6 OF 16 OLD BUSINESS RECONSIDERATION. OF APPROVAL OF ADDITIONAL COMPENSATION FOR MEYER,HENDRICKS,VICTOR, OSBORNA MALEDON FOR LEGAL SERVICES )Councilman Hendricks stated that since the last Council meeting when this request was denied,he has received infOrmationAbout the services the law firm provides the City at no charge; that there are questions of whether or not there mightliave been mis- understandings aobut the maximum fee for legal assistance to the City. Mayor Perkins called for a motion. Councilman Hendricks MOVED THAT WE RECONSIDER THE PREVIOUS ACTION REGARDING THE APPROVAL OF ADDITIONAL COMPENSATION FOR MEYER,HENDRICKS,VICTOR,OSBORN & MALEDON FOR LEGAL SERVICES. Vice Mayor Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. Council members commented in favor of this item. Councilman Coleman stated he read in the newspaper that he had voted in opposition of this item.He clarified that he voted opposing the denial of this item because he was in favor of the additional compensation. Councilman Hendricks MOVED THAT THE REQUEST FOR $1,581.42 FOR ADDITIONAL COMPENSATION BY THE LAW FIRM OF MEYER, HENDRICKS,VICTOR,OSBORN & MALEDON,BE APPROVED. Vice Mayor Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. Mayor Perkins recessed the meeting at 8:00 p.m.She reconvened the meeting at 8:15 p.m. REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 1,1994 PAGE 7 OF 16 NEW BUSINESS HOUSING REHABILITATION GUIDELINES FOR COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) IGA #148-92 AND HOME FISCAL YEAR '93 APPLICATION )Housing & Grants Coord.John Flumerfelt stated this is one of the steps in the process of obtaining a housing rehabilitation grant.He explained there are two grants;one was a CDBG application which we successfully obtained and another one for a home application which we have not obtained yet.He stated that this set of guidelines will be for the period when we administer these two grants which will be about the next eighteen months;that the amounts on these applications have been the same as in the past but construction costs indicate that we should raise the limits.He explained that the home application includes ways for replacing mobile homes beyond repair of qualified people. Vice Mayor Barker MOVED TO APPROVE THE CITY OF APACHE JUNCTION,ARIZONA,HOUSING REHABILITATION PROGRAM PLAN AND GUIDELINES,CDBG IGA #148-92/HOME FY93. Councilwoman Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. CONSIDERATION OF REQUEST TO CHAMBER OF COMMERCE AND MAIN STREET TO STUDY AND MAKE RECOMMENDATIONS IN RESPONSE TO A CITIZEN'S REQUEST ON PAD TAX )Asst.City Manager George Hoffman briefed the Council on this item.He stated that the proposal to implement a pad tax could affect our winter visitors and thus tourism,which in turn could affect our primary economic base.He suggested that this should not be decided upon without careful consideration and study and encouraged the Council not to affect their primary economic base without consulting our economic development partners.He recommended that the Council direct the City Manager to contact the Chamber and Main Street to request that together they consider Mr.Kennemur's proposal;that they work with other concerned businesses to include in -city RV and mobile home parks owners and/or managers and citizens,and that they make recommendations back to the City Manager for Council consideration. Mr.Hoffman referenced an article in the Independent newspaper where Mr.Kennemur threatened the City with an initiative on the pad tax if the Council did not act upon it within sixty days.He explained that the Chamber and the business community are in the REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 1,1994 PAGE 8 OF 16 midst of the Lost Dutchman Days and Main Street is embarking on several projects,so he was concerned that the ultimatum may not be met. Councilman Perkins stated that about two years ago the Council asked the Chamber and our Economic Development Commission to study the pad tax and come back with their recommendations;that the answer to that issue was a "no"and he asked if referring this issue back to the same people would give a different answer this time. Mr.Hoffman answered he would not prejudge that but he would say that the relationship between the City and the business community has improved substantially since then;and that he thought there are some questions we have not explored. Councilman Perkins asked if we are deviating from our goal that tourism is our number one base industry and if we really expect a different answer than that coming back from the business owners who depend on the winter visitors.He further explained there might be a detriment in pursuing that issue. Mr.Hoffman stated the Chamber has talked about the need for sources of revenue that could support economic development and that would make a difference in their analysis,but whether or not their recommendation would be different,he did not know.He stated this is not something the Council has set forth as something we are seeking to advance but something that an individual,admittedly representing other citizens,has brought to the Council's attention;and that we should at least ask the question to our partners in economic development. Councilman Perkins stated he would rather direct the City Manager at this time;that he would like to meet with our economic partners on a one-to-one basis and put that on the Council and staff retreat agenda for discussion to see if there is enough support from the Council to pursue that issue. Mr.Hoffman asked if the Council did not have an interest in that issue right now,then why go forward. Councilman Perkins replied that he was speaking for himself only and not for all the Council. Vice Mayor Barker agreed with Councilman Perkins that extensive work was done already on that issue;so i f both the Chamber and Main Street or either one of them is interested in this, then they need to communicate with one another,and if this is something they would like to pursue,then they can work on their own without us. REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 1,1994 PAGE 9 OF 16 Mr.Hoffman replied that to his knowledge,neither of those groups is interested in initiating this issue as a public policy consideration. Vice Mayor Barker agreed on that and she stated that right now we have really important things to do which have already started and we do not need this. Mr.Hoffman recommended that if the Council would think about adopting a pad tax,not to do it without study. Councilman Hendricks suggested that the information that is available on this issue be turned over to Mr.Kennemur and the other people who are interested in this. Vice Mayor Barker added that information is public record and all they need to do is come in to City Hall and request it;and that if the citizens of this community would like to put something like the pad tax in an initiative,that is a public way of handling this issue. Councilman Hendricks stated those people might change their mind by looking at that information. Councilman Coleman pointed out that the last time the Council looked into this pad tax it was determined that it was not a pad tax but a rental tax,a license fee. Mayor Perkins stated that she was receiving many phone calls about this issue and one caller informed her that he leaves his RV here year round and he pays $444.00 a year for personal property on that and she questioned whether the people who are requesting this tax are aware of that;that if there is any information on that,it should be sent to Mr.Kennemur. Councilman Perkins replied that information was included in the previous study. was some tax summaries from the County, areas that had this type of tax and the they called it,and how they applied it. Mr.Hoffman asked about the study. Vice Mayor Barker answered that i t local and State,as well as a list of kind of revenue they got from it,what Councilman Perkins stated that by State Statute we could not have a pad tax. REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 1,1994 PAGE 10 OF 16 Mayor Perkins stated she did not know there was a State Statute that did not allow that. Councilman Coleman recalled that this tax would have to be collected by the City so a new bureaucracy would be created;because it did not follow the State Model Tax Code,the State would not collect it for us. Mayor Perkins asked if anyone has met with these people who are requesting this tax to give them that information. Mr.Hoffman answered that this would be an opportunity to do that.He stated that the premise appears to be that "winter visitors do not pay their way."He asked if anyone recalled if that question has been studied. Vice Mayor Barker answered that the issue was never tackled;that the Council asked the Chamber of Commerce about three years ago if they could come up with some facts about it but they were never able to do that.She asked Capt.Scott if the police department kept track of police necessity during the winter months. City Manager Mike Lee answered that all of the departments did that but we were unsure about the outcome and how accurate i t really was. Vice Mayor Barker added that information is also part of the whole information packet. City Manager Mike Lee affirmed that. Mr.Hoffman volunteered to share that information with Mr.Kennemur and stated he was curious about whether or not,if this tax did not work,these people would not look at another one. to clarify his statement. simply come back with another kind of tax that would impact Statutes say we cannot have a be an initiative. Vice Mayor Barker asked Mr.Hoffman Mr.Hoffman clarified they might proposal;instead of the pad tax,some other winter visitors. Mayor Perkins stated that if State pad tax,then why worry that there is going to REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 1,1994 PAGE 11 OF 16 Councilman Perkins replied that State Statutes did not say we could not have a pad tax but if we put one on, we have to collect it ourselves. Mayor Perkins suggested that the information be provided to Mr.Kennemur who was genuinely concerned about City revenues. Councilman Perkins expressed interest in an in-depth study by the City on the question of whether or not people are paying their fair share.He stated that revenues do not increase as much as the population during the winter months so maybe it is time for an in-depth study to find the answers and not just say that "people are not paying their way so let's tax some more." Mr.Hoffman agreed with Councilman Perkins and further commented on what the results of a study might be. Vice Mayor Barker also commented on the study. Councilman Perkins suggested that if the Council really wanted to answer that question,maybe we need to allocate some money for a consulting firm that would do it. Councilman Hendricks agreed that eventually we should do that,but right now we should relay the information to Mr.Kennemur who by the way is a new resident for about a year. Mayor Perkins agreed on that and commented that good communication was important. Vice Mayor Barker MOVED THAT THE CITY MANAGER BE DIRECTED TO DIRECT THE ASSISTANT CITY MANAGER OR SOME OTHER STAFF MEMBER TO SPEAK WITH MR.KENNEMUR AND OFFER HIM ACCESS TO THE INFORMATION THAT THIS COUNCIL HAS PREVIOUSLY GATHERED ON THIS PARTICULAR TOPIC;AND THAT A DISCUSSION OF THIS TYPE OF INFORMATION THAT COUNCILMAN PERKINS WAS TALKING ABOUT BE PUT ON THE AGENDA FOR THE COUNCIL RETREAT SO THAT WE CAN THINK ABOUT THIS AND POSSIBLY THINK WE MIGHT DO SOMETHING. Councilman Hendricks SECONDED THE MOTION. Councilman Coleman offered the amendment that the item on the retreat agenda include a discussion of all types of possible revenue sources. The Council clarified that it was already intended into the original motion. REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 1,1994 PAGE 12 OF 16 VOTE:Unanimous. The motion carried. RESOLUTION NO.94-04:INTERGOVERNMENTAL AGREEMENT TO ACCEPT LIBRARY SERVICES AND CONSTRUCTION ACT TITLE II GRANT FUNDS ) )Library Director Pam Loui briefed the Council on this item. Councilman Perkins MOVED THAT RESOLUTION NO.94-04,APPROVING AN INTERGOVERNMENTAL "PROJECT AGREEMENT" WITH THE ARIZONA STATE DEPARTMENT OF LIBRARY,ARCHIVES AND PUBLIC RECORDS TO ACCEPT $280,000.00 PROVIDED BY THE LIBRARY SERVICES AND CONSTRUCTION ACT,AS AMENDED, BE APPROVED. Councilman Hendricks SECONDED THE MOTION. VOTE:Unanimous. The motion carried. COUNCIL DIRECTION TO STAFF ON PROPOSED LEGISLATION OR ACTIONS PUBLIC INFORMATION FOR CITIZEN REVIEW BOARD REFERENDUM VOTE )Asst.City Manager George Hoffman stated there was an inquiry from the Council about the public information on that referendum.He recommended that because of the special interest that has been shown on this issue,it would be best to limit the kind of information to actual and factual information. Vice Mayor Barker asked if that is not what we usually do,give objective information. City Clerk Kathy Connelly explained the requirements in the State Statute. Mr.Hoffman contrasted this issue with Home Rule where a citizen might ask a question and then we provide an answer.He encouraged the Council not to use that kind of format. Vice Mayor Barker stated that we • should provide nothing else than the facts and according to State law. Mr,Hoffman asked if the Council wanted to have public information in addition to that which the City Clerk's REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 1,1994 PAGE 13 OF 16 office provides,such as might appear in a public foldout within the Citizen or in the local newspaper. Vice Mayor Barker answered that this issue is a referendum enacted by the citizens and it is not the City's place to either publicize it or not,but to do what the State mandates in an election. Councilman Perkins asked about that information. Ms.Connelly clarified what the State requirements are. Vice Mayor Barker stated the City has meet its obligations at that point and any organizations that wanted to do their own thing,it was their prerogative to do so. Vice Mayor Barker MOVED THAT THE FOLLOWING DIRECTION BE GIVEN TO STAFF REGARDING PUBLIC INFORMATION FOR THE CITIZEN REVIEW BOARD REFERENDUM VOTE,THAT ONLY THAT INFORMATION WHICH IS MANDATED BY STATE AND ONLY THOSE PROCEDURES WHICH ARE MANDATED BY STATE SHALL BE PERFORMED BY THE CITY. Councilman Hendricks SECONDED THE MOTION. VOTE:Unanimous. The motion carried. SELECTION OF MEETING DATES,TIMES,LOCATIONS,AND PURPOSES Vice Mayor Barker MOVED THAT AN EXECUTIVE SESSION AT 6:00 P.M.AND A WORK SESSION AT 7:00 P.M.BE HELD ON MONDAY,FEBRUARY 14,1994,IN THE CITY COUNCIL CONFERENCE ROOM AND CITY COUNCIL CHAMBERS RESPECTIVELY;AND THAT AN EXECUTIVE SESSION AT 6:00 P.M.BE HELD ON TUESDAY,FEBRUARY 15,1994,IN THE CITY COUNCIL CONFERENCE ROOM;AND THAT AN EXECUTIVE SESSION FOR THE PURPOSE OF THE CITY MANAGER'S PERFORMANCE REVIEW BE HELD ON TUESDAY,FEBRUARY 15TH AT 6:00 P.M.AT THE CITY COUNCIL CONFERENCE ROOM.
