HomeMy WebLinkAbout1993-10-19 City Council Regular MinutesCITY COUNCIL REGULAR MEETING OCTOBER 19,1993 The regular meeting of the City Council of the City of Apache Junction, Arizona,was held on October 19,1993 at the Apache Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Mayor Perkins called the meeting to order at 7:00 p.m. INVOCATION City Manager Mike Lee gave the Invocation. PLEDGE OF ALLEGIANCE Councilman Hendricks led the Pledge of Allegiance. ROLL CALL Councilmen Present:Mayor Perkins Vice Mayor Barker Councilwoman Richmond Councilman Hendricks (Councilmen Perkins,Coleman,and Cox were absent.) Councilwoman ichMond,SECONDED THE MOTION. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 19,1993 PAGE 1 OF 8 VOTE:Unanimous. The motion carried. AWARDS,PRESENTATIONS AND COMMUNICATIONS None. CALL TO THE PUBLIC Mr.Jimmy Eidson addressed the Council regarding the number of police officers necessary to provide adequate law enforcement for the city and also spoke in opposition to the pending application for an adult boutique. Mr.Sam Hadden Addressed the Council in opposition to the pending application for an adult boutique located within city limits. Mr.John Morgal addressed the Council regarding allegations that the City has held up his business license for 10 years. Mr.Wally Taylor addressed the Council regarding allowing the citizens the right to vote on the City Magistrate. CITY MANAGER'S REPORT City Manager Mike Lee informed the Council that a Building Inspector I was selected;that the City has been understaffed in that area for some time;and that thanks to John Austin who has been the Acting Building Official,we have been able to keep things going. Mr.Lee informed,the Council that at the next Council meeting the City will be presenting awards to board and commission members who have retired from their position as of July 1,1993.This is part of our continuing efforts to recognize the efforts of our volunteers,to encourage them to continue being involved,and to motivate others to be willing to serve in these positions. That was the reason for having the volunteer picnic and also those who fulfill their terms each time will receive a certificate recognizing their work. PUBLIC HEARINGS APPLICATION FOR A NEW LIQUOR LICENSE SUBMITTED FOR MARIA'S ITALIAN FOOD RESTAURANT )City Clerk Kathleen Connelly briefed the Council on this item.She stated that this business will be at what used to be the Disabled American Veterans facility;that correspondence on this application was received from the Police Department and the Building Division,but the Fire Department was not able to make an inspection because REGULAR MEETING OF THE CITY COUNCIL OCTOBER 19,1993 PAGE 2 OF 8 the building is closed.They will make an inspection for their own purposes once the facility is open. Mayor Perkins opened the public hearing.There being no one wishing to speak on this item,she closed the public hearing. Vice Mayor Barker MOVED THAT THE NEW LIQUOR LICENSE APPLICATION,SERIES 12,FOR MARIA'S ITALIAN FOOD RESTAURANT BE RECOMMENDED FOR APPROVAL TO THE ARIZONA DEPARTMENT OF LIQUOR LICENSES AND CONTROL. Councilman Hendricks SECONDED THE MOTION. VOTE:Unanimous. The motion carried. APPLICATION FOR A SPECIAL EVENT LIQUOR LICENSE SUBMITTED FOR THE AMERICAN LEGION POST #27 FOR A VETERANS DAY EVENT ) )City Clerk Kathy Connelly briefed the Council on this item. to speak on this item. Mayor Perkins invited the applicant Mr.Howard Frain,1001 S.Idaho Rd., stated that this application was for a one -day open house honoring the veterans and to invite the non -veterans to join them in their celebration.He added that it will be an indoor event. Mayor Perkins closed the public hearing since there was no one else wishing to speak on this item. Councilman Hendricks MOVED THAT THE SPECIAL EVENT LIQUOR LICENSE FOR THE AMERICAN LEGION POST #27,BE RECOMMENDED FOR APPROVAL TO THE ARIZONA DEPARTMENT OF LIQUOR LICENSES AND CONTROL. Vice Mayor Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 19,1993 PAGE 3 OF 8 APPLICATION FOR A SPECIAL EVENT LIQUOR LICENSE SUBMITTED BY THE CHAMBER OF COMMERCE FOR THE OLD WEST FESTIVAL )City Clerk Kathy Connelly briefed the Council on this item.She stated that the Fire Department again in this case was not able to make an inspection because things have not been set up yet. hearing. Mayor Perkins opened the public Ms.Jeanne Jacobs,541 S.Cortez Rd.,stated that this application is for beer only at Prospector Park on December 4th,from 8:00 a.m.to 8:00 p.m.;there will be a beer truck and security will be provided by the Arizona Rangers and by local police.She stated that this event will be enclosed in the park alone;no beer will be taken out of the park at any time;there will be no vehicles allowed inside the park except parking for the merchants,the handicapped,and the police. She stated that they are looking at bus transportation or possibly transportation from the local trolley service,which has not been confirmed yet. Mayor Perkins closed the public hearing since there was no one else wishing to speak on this item. Councilwoman Richmond MOVED THAT THE SPECIAL EVENT LIQUOR LICENSE SUBMITTED FOR THE CHAMBER OF COMMERCE,BE RECOMMENDED FOR APPROVAL TO THE ARIZONA DEPARTMENT OF LIQUOR LICENSES AND CONTROL. VOTE:Unanimous. The motion carried. OLD BUSINESS None. NEW BUSINESS None. COUNCIL DIRECTION TO STAFF ON PROPOSED LEGISLATION OR ACTIONS MONUMENTAL TYPE IDENTIFICATION SIGNS )City Engineer Gordon Grandy introduced Mr.Bob DeBow to speak to the Council on this item. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 19,1993 PAGE 4 OF 8 Mr.Bob DeBow,Vice Chairman of Main Street,Inc.,4375E.Superstition Blvd.,stated that this is one more project in developing Main Street,to develop a new entry way sign into our community. He asked for the Council's blessing on this project. design for the entry sign to the Council. Mr.Grandy showed and described the Mr.DeBow added that the letters will be of bronze and that they would like the entry sign at three locations; the first one being on the west side of town and as time goes by,Idaho or Goldfield coming in from the east,and eventually at the entry from the lakes. He stated that this is part of a total concept from Main Street which includes redesign of the median,curbs and sidewalks,and eventually the final project which is the park in front of the Grand Hotel. Mayor Perkins thanked Mr.Gil Verley of World Signs for the present "Welcome to Apache Junction"signs and stated that some people have asked her why those signs were put where the banner posts are,and she asked why the signs west of Meridian were put that far back. Mr.Grandy answered that i t is not too far from Meridian;i t is 300 feet. Mr.DeBow stated that the signs cannot be put directly on the intersection because they will block the traffic view. Councilman Hendricks asked if the "Welcome to Apache Junction"sign west of Meridian will be moved to another location temporarily. Mr.Grandy answered that they did not discuss that but they could probably find a suitable location like on State Route 88. Councilman Hendricks suggested to move that existing sign to one of the other locations until we fund the other signs. City Manager Mike Lee agreed with that. Mr.DeBow agreed with Councilman Hendrick's suggestion also. Vice Mayor Barker asked if the funding for the signs will be done by ADOT as i t is being suggested. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 19,1993 PAGE 5 OF 8 Mr.Grandy answered that there could be other suggestions if there are donations or something like that.He stated the preferred method is to use ADOT funds because this is not a restricted use for this particular thing;it is in the right-of-way and we can consider this project as part of the landscaping or enhancement to the median and ADOT may be agreeable to that. Mayor Perkins stated that she asked Mr.Grandy earlier if ADOT funds could be used for paving some of our streets and he answered no to that. Vice Mayor Barker MOVED TO DIRECT STAFF TO PROCEED WITH THE CONSTRUCTION OF A CITY ENTRY SIGN TO BE LOCATED IN THE MEDIAN OF WEST APACHE TRAIL IN FRONT OF K -MART. Councilman Hendricks SECONDED THE MOTION. VOTE:Unanimous. The motion carried. SELECTION OF MEETING DATES,TIMES.LOCATIONS.AND PURPOSES Vice Mayor. Barker MOVED THAT AN EXECUTIVE SESSION BE HELD AT 6:00 P.M.AND A WORK SESSION AT 7:00 P.M.ON MONDAY,NOVEMBER 1,1993,IN THE CITY COUNCIL CONFERENCE ROOM AND CITY COUNCIL CHAMBERS RESPECTIVELY:AND THAT AN EXECUTIVE SESSION BE HELD AT 6:00 P.M.ON TUESDAY,NOVEMBER 2,1993,IN THE CITY COUNCIL CONFERENCE ROOM. Councilwoman Richmond SECONDED THE MOTION. VOTE:Unanimous. The motion carried. INFORMATION AND REPORTS City Attorney Glenn Gimbut informed the public in reference to concerns raised about the adult boutique that the Planning and Zoning Commission will be meeting on October 26th to consider changes to the Zoning Ordinance about adult uses to strengthen our City Code in that area.
