CALL TO ORDER Mayor Damiano called the meeting to order at 7:00 p.m. INVOCATION Father Maloney gave the Invocation. PLEDGE OF ALLEGIANCE Vice Mayor Eidson led the Pledge of Allegiance. REGULAR MEETING OF THE CITY COUNCIL JULY 16,1991 PAGE 2 Councilwoman Alger seconded the VOTE:Unanimous The motion carried. Introduction of Distinguished Visitors and Guests None. AWARDS,PRESENTATIONS AND COMMUNICATIONS VFW Superstition Mountain Post 9399 Commander George Diehl,Sr.,presented an award to Sergeant Rick Salmon and Sergeant Steve Francis for their dedicated service to the City.Commander Diehl also commended the Police Department. CALL TO THE PUBLIC Captain Henry Aalders,Salvation Army,614 N.Rennick,Apache Junction, addressed the Council expressing the social needs of the people in the community due to economical hardships,and stated that due to the cut in funding from the City there will be 12 families the Salvation Army will be unable to help with rent and 40 families with utilities or 80 families with food and 200 families with medication. CITY MANAGER'S REPORT City Manager Michael R.Lee reported that every summer there are many complaints of dust from the unpaved roads,and that the City does put Raybinder on residential streets at no labor cost to the citizen,but does require a dona- tion from the citizen at approximately $1 per linear foot for materials.Mr.Lee added that improvements will be made on Manzanita Street due to previous com- mitments and other then that,the Raybinder policy will be complied with. Mr.Lee informed the Council that the Magistrate Court has been approved for a $53,000 grant for the judicial enforcement program,enabling the City to hire a police officer for the purpose of finding those who are behind on fine payments. ITEM NO.10 DIRECTION TO STAFF REGARDING THE ESTABLISHMENT OF HOSPITALITY INDUSTRY LEVIES. City Clerk Kathleen Connelly stated that at a previous work session Council has discussed the possibility of adopting a levy or fee that could be imposed on certain segments of industry within the City limits,specifically,on busi- REGULAR MEETING OF THE CITY COUNCIL JULY 16,1991 PAGE 3 nesses contained within the hospitality industry such as RV,travel trailer spa- ces,hotel/motel rooms and apartments.Ms Connelly clarified that this levy is not the one commonly known as the "bed tax";the City's authority to impose this levy is found in Title 9 which is the general taxation powers of the City;any revenues received could be spent on any purpose that the Council desires;Pinal County cannot adopt this type of tax;and that Pinal County and most of Apache Junction are excluded from the "Cactus League"tax recently authorized by the State; Mayor Damiano stated that across the nation,more than 70% of cities and towns are in worse financial shape this year than there were last year,that the Council does not want to impose a property tax,so to impose some kind of levy on short-term,transient -type rentals would allow the seasonal visitors to help share in the cost of city services,and would be a means to maintain services. Mayor Damiano related some of the accomplishments of the City in the past few years through funds,and concluded his comments by saying that he does not believe a levy such as this will drive people away from Apache Junction. Father Charles T.Maloney,306 E.16th Avenue,Apache Junction,stated that Apache Junction does not have just "all-around"citizens or just "part-time" citizens,but citizens of at least six months a year who have poured money into the community,and spoke in opposition to the hospitality levies. Father Maloney suggested not rushing into this decision,but researching other alternatives first. Mrs.Midge Conway,902 S.Ocotillo,Apache Junction,stated that Mayor Damiano said most of what she had planned to say,except that unless Apache Junction has an attraction for people to come to,the freeway will not be a benefit,and there has not been a substantial alternative to this levy offered by anyone. Ms Nancy Koerner,1026 N.Goldfield,Apache Junction,addressed the Council stating that it would probably only cost a person $7 -$12 a month for this levy to help the community put in a few things that will benefit them as well as the whole community. Councilman Perkins asked if direction is given to staff to draft an ordi- nance,how would the rest of the Council feel about that,and suggested that the money from this levy be spent on projects that will promote the tourism industry and not used to balance the budget,with the biggest project being the deve- loping of the equestrian trails. Councilwoman Barker agreed and stated that i f the community wants to have a large number of winter residents,there needs to be things promoting their wanting to be here,and the money should be designated for a specific project on an annual basis such as the equestrian trails.Councilwoman Barker suggested a Committee of citizens such as those involved with RV Parks,business people,to recommend projects that would become a tourist attraction. REGULAR MEETING OF THE CITY COUNCIL JULY 16,1991 PAGE 4 Vice Mayor Eidson pointed out that Parks and Recreation would be the only area that would have tourist type projects. Councilwoman Barker suggested projects such as a municipal golf course, and developing the rodeo grounds to national standards. Vice Mayor Eidson suggested that the levy may be easier to calculate at a percentage rather than a set fee,i f this is to proceed.Vice Mayor Eidson added that having talked to County Supervisor Roy Hudson,he knows that the County has not considered anything like this. Vice Mayor Eidson asked how long it would take for this to go into effect, it were passed. Ms Connelly replied that it would take about 60 days,as the State requires a 60 day notice. Vice Mayor Eidson pointed out that after the City passed this it would take the State 60 days to get set up to collect the taxes. Ms Connelly explained that this would be sent simultaneously to two agen- cies,the Model Tax Code Commission -they make sure i t conforms with the tax code structure,and the Arizona Department of Revenue as the tax collecting authority to implement their system and forms. Vice Mayor Eidson suggested that the Chamber of Commerce be involved with making recommendations on this process. Councilman Coleman pointed out to Father Maloney that this proposal would exempt those who are here for six months or longer or who pay for their pad for six months or longer. Councilman Coleman suggested feasible projects to fulfill City needs as being more sidewalks,street lights,equestrian/bike/walking trails,as things that could be of benefit to all of the citizens,year around and part-time as well. Father Maloney asked the City Attorney about taxing RV's but not taxing park models. City Attorney Glenn Gimbut explained that the ordinance can be designed as broad or as narrow as the Council wishes,and also that a park model is not towed around but the owner would pay rent for the space all year long. Father Maloney pointed out that many RV owners do the same. Mr.Gimbut agreed,so the transient visitors would only be taxed,not someone who is paying rent year-round. Councilman Coleman agreed that this is the intent. REGULAR MEETING OF THE CITY COUNCIL JULY 16,1991 PAGE 5 Mr.Mark Cox,owner of RV Unlimited,10934 E.Apache Trail,stated that although he is not located in Apache Junction,most of his business is in Apache Junction,and further stated that the tax should be on everyone,even year around residents,not just one particular group. Vice Mayor Eidson explained that this discussion is for direction to the city manager to draft an ordinance for future action,this tax will not be imposed tonight. Vice Mayor Eidson stated that he wanted a committee to look into this prior to the Council taking action. Mr.Joe Filkowski,1630 W.Apache Trail,manager of an RV park,spoke in opposition to the tax. Mrs.Cora Blatterspiel,760 E.Mesquite,Apache Junction,addressed the Council stating that the people who live here all year round pay real estate taxes and other taxes,so this would be a way to increase the library services. Councilwoman Alger stated that there have been a lot of good points made tonight,and requested that this be reviewed and discussed further before taking action,and added that i f the tourists are to be taxed then the money should go back into the tourism industry. Councilwoman Barker stated that there should be an assortment of people representing a variety of the community on the committee. Councilman Perkins commented that the committee should also do an investiga- tion on how many of the towns that the winter visitors come from have bed taxes similar to this. Councilman Cox pointed out that when the last tax was imposed people left for awhile,but they came back eventually. Councilwoman Alger MOVED THAT DIRECTION BE GIVEN STAFF AND THE ECONOMIC DEVELOPMENT COMMISSION,THROUGH THE CITY MANAGER,TO EXAMINE THIS ISSUE TO ESTABLISH HOSPITALITY INDUSTRY LEVIES.I WOULD LIKE SOME OF THE SPECIFICS INVOLVED LOOKED AT,SUCH AS,THE ACTUAL NUMBER OF RV SPACES USED IN OUR COMMUNITY FOR RENTAL OF LESS THEN SIX MONTHS ANUALLY.I WOULD LIKE SOME SPECIFIC PROJECTS DISCUSSED FOR USE OF THIS MONEY -THINGS THAT RELATE TO THE TOURIST INDUSTRY,AT LEAST PART OF THIS MONEY SHOULD GO THERE.THE RATE.I WOULD LIKE IT BACK NOT LATER THAN THE FIRST MEETING IN NOVEMBER.I WOULD LIKE TO REQUEST THAT THE CHAMBER OF COMMERCE DO SOME COMMITTEE -FORMING ALSO,IF THEY CHOOSE TO, TO ASSIST US,BUT I WOULD LIKE OUR ECONOMIC DEVELOPMENT COMMISSION TO LOOK AT THIS,AND TO LOOK AT THESE SPECIFIC QUESTIONS.I WANT TO LOOK AT ECONOMIC IMPACTS.I WOULD ALSO LIKE TO HAVE SOME CITY SERVICES INCLUDED IN IT WHEN WE LOOK AT THE IMPACTS.IF WE CAN TRY AND DETERMINE WHAT SOME OF OUR COSTS ARE IN RELATING TO SERVICES TO THE WINTER VISITORS.IF THERE IS ANY WAY TO DETERMINE A NUMBER OF WINTER VISITORS VERSUS WINTER RESIDENTS OVER SIX MONTHS,I WOULD LIKE REGULAR MEETING OF THE CITY COUNCIL JULY 16,1991 PAGE 6 TO SEE SOME OF THAT INFORMATION,AND ANYTHING ELSE THAT MIGHT HELP US BE BETTER SITUATED WITH KNOWLEDGE ON THIS QUESTION.AND,I WOULD ALSO LIKE TO SEE US DO SOME PUBLIC EDUCATION WHILE THIS IS BEING STUDIED TO HELP ANSWER SOME OF THE QUESTIONS ABOUT IT BEING FOR OVER SIX MONTHS RESIDENTS,AND ANYTHING ELSE THAT MIGHT NEED CLARIFICATION. Councilwoman Barker seconded the motion. Councilman Perkins commented that four months is far too long. Councilwoman Alger stated that the winter visitors should have some input and the year-round residents don't have the right to make this decision for them. Councilman Cox pointed out that the people who live here year-round voted the Council into office,and it's those people who should make the decision. Councilwoman Alger stated that the Council is supposed to do what's best for Apache Junction,and making this decision too quickly,may not be the best thing for Apache Junction. Councilman Perkins amended the motion THAT THE DATA THAT THE ECONOMIC DEVELOPMENT COMMISSION AND STAFF DEVELOP IS BROUGHT BACK TO THE COUNCIL AT THE SECOND WORK SESSION IN SEPTEMBER. Councilman Cox seconded the amendment. Vice Mayor Eidson asked i f this would allow something to go into effect by by the first of the year. Ms Connelly replied that direction could be given by the second meeting in October,i t could be in effect by January of 1992. Vice Mayor Eidson asked Mr.Hoffman i f this can be accomplished. Mr.Hoffman replied that i f this is an important issue to the Council,the resources can be found to get the work done. REGULAR MEETING OF THE CITY COUNCIL JULY 16,1991 PAGE 7 Mayor Damiano recessed the meeting at 8:15 p.m. Mayor Damiano reconvened the meeting at 8:30 p.m. PUBLIC HEARINGS PROPOSED ORDINANCE NO.780,PZ-1-91, IDAHO FREEWAY ASSOCIATES )Senior Planner Jim Nakagawa briefed the Council on the request for rezoning from GR to C-3 of a 4.7 acre parcel on the northeast corner of Idaho Road and the Superstition Freeway,and pointed out that to the north of the site is the Countryside Trailer Park with the freeway abutting the property to the south,and vacant property on the west and east sides.Mr.Nakagawa stated that the General Plan designates this area for an RV park use,however,there is a General Plan guideline that permits commercial uses at the intersection of arterial or major roads.Mr.Nakagawa further stated that staff recommends approval with the stipulation that there be dedica- tion of an east -west roadway,but that the applicant takes exception to the roadway dedication at this time and would rather the dedication be required at the time of development. Mr.Nakagawa added that staff recom- mended to the Planning and Zoning Commission that this be done as a planned development due to this commercial use abutting a travel trailer park,and that the Commission did recommend approval of the rezoning by planned development, and with an amendment to Stipulation No.2 that would require the dedication of rights -of -way prior to development or splitting of this property. Mr.John Slentz,1632 N.Chestnut Circle,Mesa,applicant,stated that the rezoning was requested in order to bring a commercial site to Apache Junction,which would be a benefit to the community.Mr.Slentz added that this is a partnership with Empire Southwest developers. Mayor Damiano asked why i t is necessary for the applicant to dedicate the rights -of -way,and does Countryside Trailer Park also have to give up right-of-way at that location. Mr.Nakagawa explained that Countryside is not seeking rezoning,and that the City's ability to acquire roadway dedications occur only at certain times,rezoning being one,but that there could be sufficient room for a roadway with this dedication alone. Vice Mayor Eidson asked i f the applicant's question regarding reversion of the right-of-way should the property not be developed within two years has been answered satisfactorily. Mr.Slentz replied that staff has, and that an agreement to make the dedication at the time of development was made. REGULAR MEETING OF THE CITY COUNCIL JULY 16,1991 PAGE 8 Mayor Damiano asked i f there was anyone who wished to speak in favor of or in opposition to the case.There being no one wishing to address the Council,Mayor Damiano closed the hearing to the public. Vice Mayor Eidson asked i f the ordi- nance covers the reversion stipulation. Mr.Nakagawa replied that the ordi- nance includes the reversion clause,which is also in the Zoning Ordinance,but that the applicant was objecting to the stipulation requiring roadway dedication at this time,which would need to be modified to ask for roadway dedications prior to any development of the property. Vice Mayor Eidson MOVED THAT ORDINANCE NO.780,BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. motion. VOTE:Unanimous The motion carried. follows: Councilwoman Barker seconded the City Clerk Kathleen Connelly read as ORDINANCE NO.780,AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE BY AMENDING THE ZONING DISTRICT MAP, CITY OF APACHE JUNCTION,ARIZONA,IN APPROVING REZONING CASE PZ-1-91 BY CHANGING THE ZONING DISTRICT CLASSIFICATION FOR A 4.7 ACRE PARCEL ON THE NORTHEAST CORNER OF THE INTERSECTION OF IDAHO ROAD AND THE SUPERSTITION FREEWAY FROM GR (GENERAL RURAL)TO C-3/PD (GENERAL COMMERCIAL BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. Councilwoman Alger MOVED THAT ORDINANCE NO.780,AS READ BY THE CITY CLERK,BE APPROVED AND ADOPTED WITH THE FOLLOWING AMENDMENT: IN SECTION I ,NO.2 DELETE THE WORDS "TO CITY COUNCIL APPROVAL OF THE BASE REZONING",AND INSERT "TO ANY DEVELOPMENT OF OR ANY DIVISION OF THE SUBJECT PROPERTY". Councilwoman Barker seconded the motion. REGULAR MEETING OF THE CITY COUNCIL JULY 16,1991 PAGE 9 VOTE:Unanimous The motion carried. the best use for this property. OLD BUSINESS Mayor Damiano commented that this is None. NEW BUSINESS EMPLOYEE HEALTH INSURANCE AND HEALTH INSURANCE CONTRACTS )Assistant City Manager George Hoffman explained that this action will allow the City Manager to enter into a contract for city employee health insurance,and establishes the percentage of city contribution for employee dependant health insurance coverage. Councilman Perkins asked i f staff has looked into the possibility of giving employees COLA rather than contri- buting to dependant coverage. Mr.Hoffman replied that this was not looked at this time,that contributing a percentage imparts substantial assistance to the employee in terms of a benefit,and that total compensation will be looked at as a trade-off between salary and insurance coverage assistance. Councilman Perkins asked i f there has been any research into all employees sharing in the benefit,not just those who are married with children. Mr.Hoffman replied that there is a lot of research and work to be done,and will be done as soon as possible,and asked i f this is something Councilman Perkins is partial to. Councilman Perkins pointed out this is would only be equitable for all employees,as the single employee is not getting anything,and suggested giving all employees a flat amount such as $1,500 to put towards anything they want -possibly health coverage. Mr.Hoffman stated that City Manager Michael R.Lee had suggested talking to the employees to see how they feel about the different options,and reiterated Mr.Lee's emphasis on how long the City will be able to sustain that level of contribution. REGULAR MEETING OF THE CITY COUNCIL JULY 16,1991 PAGE 10 Councilman Perkins commented that to give employees a flat amount will be cheaper for the City in the long run. Vice Mayor Eidson asked what percen- tage of health insurance coverage is paid by the city now. Mr.Hoffman replied that the City pays 100% of the employee coverage,and 1/3 of the dependent coverage,and that this proposal would increase that up to 52%. Mr.Hoffman explained that the reason for the 52%suggested increase,is that neither the city nor the employees were prepared for this large increase in health insurance premiums. Mr.Lee pointed out that in spite of the 52% contribution by the City,the employees will still be paying $32 more per month then they were paying. Councilman Perkins MOVED THAT THE CITY MANAGER BE AUTHORIZED TO ENTER INTO A CONTRACT WITH BLUE CROSS/BLUE SHIELD FOR CITY EMPLOYEES;THAT THE CITY PROVIDE HEALTH INSURANCE TO ITS EMPLOYEES;AND THAT THE CITY CONTRIBUTE UP TO 52% PERCENT TOWARDS EMPLOYEE DEPENDENT HEALTH INSURANCE COVERAGE. Councilman Coleman seconded the motion. VOTE:Unanimous The motion carried. COUNCIL DIRECTION TO STAFF ON PROPOSED LEGISLATION OR ACTIONS: DIRECTION TO STAFF REGARDING DUMPSTER REQUIREMENTS. Vice Mayor Eidson stated that there have been recent problems with a trailer park resident's putting garbage on the street in sacks,etc.,as well as problems in other areas of the City,so this is a request for legislation to enable a requirement for dumpster or metal garbage cans required in multiple dwellings units that would be enforceable. Councilwoman Alger agreed that this can be a large problem in the community, and suggested that this be the responsibility of the park or apartment owners to provide and maintain a dumpster rather than garbage cans. Councilman Perkins asked i f the City can impose legislation such as this without having a refuse company that is operated by the City. REGULAR MEETING OF THE CITY COUNCIL JULY 16,1991 PAGE 11 Staff assured Council that this can be done. Councilwoman Barker asked i f the property owner will have to go through a refuse company to obtain a dumpster. Vice Mayor Eidson commented that this is why he had suggested garbage cans as an option,as there is a trailer park owner who empties the cans himself. Vice Mayor Eidson stated that he had assured this particular park owner that the City would not look for violators,but would act on complaints and obvious problems. Councilman Perkins stated that he has no problem with garbage cans when an owner is taking care of that,however,there will be those who will provide cans and neglect them.Councilman Perkins asked i f it wouldn't be possible to try cans and make the owners get dumpsters i f they failed to maintain the cans. City Attorney Glenn Gimbut gave the opinion that without due process,court hearings,it would be difficult to make someone change equipment at the discre- tion of staff,so it would be preferable to have legislation that states "thou shalt not have trash"and make the park manager,the person physically in charge of the park,responsible for picking up trash. Mr.Hoffman stated that there is a "failure to maintain premises"on the books currently,so the Council may legislate a "result"or a "means to obtain the result". Mr.Hoffman suggested that there may be requirements for frequency of emptying and location of the dumpsters. Mr.Gimbut suggested requiring a certain number of garbage cans per rental unit. Vice Mayor Eidson stated that the Building Department staff had said that there wasn't much they can currently do about the problem,other than hassling the owners and giving them 30 days to clean i t up. Mr.Hoffman explained that the Building staff has to follow a certain proce- dure,and i t is a very long procedure,but that the City Attorney is going to work with staff to develop a civil citation procedure which would much quicker. Vice Mayor Eidson commented that i f there is a process on the books that can be utilized through a civil citation procedure,then this won't need to be carried any further. Mr.Hoffman suggested Council give direction to staff to come up with a civil citation process in order to be more responsive,and i f that doesn't work the dumpster avenue can be pursued. Vice Mayor Eidson MOVED THAT DIRECTION BE GIVEN STAFF,THROUGH THE CITY MANAGER TO INVESTIGATE THE CIVIL ASPECTS,OR DRAFT AN ORDINANCE REQUIRING USES IN MULTIPLE FAMILY DWELLINGS AND RV PARKS CONCERNING DUMPSTERS ON SITE. Vice Mayor Eidson seconded the INFORMATION AND REPORTS Economic Development Manager John Schoeph reported that he and the Mayor had attended a meeting of the East Valley Partnership to address public delivery, use of the air base,utilization of the Regional International Airport,and legislative impacts. Mayor Damiano thanked faithful citizens Al Pope,Betty Pope,Anne Surra, Cora Blatterspiel,and Joyce Cox,for coming to the meeting. Vice Mayor Eidson announced that Director of Public Safety Bill McDaniel's younger sister has passed away,so he will be out of town.
