CALL TO ORDER Mayor Bluntschly called the meeting to order at 6:30 p.m. ROLL CALL Councilmen Present:Councilwoman Barker Councilman Cox Councilwoman Alger Councilman Eidson Vice Mayor Damiano Mayor Bluntschly Councilman Absent:Councilman Vehon (previous plans) Staff Present: Others Present: Acting City Manager/City Clerk Kathleen Connelly City Attorney David Alexander Assistant to the City Manager George Hoffman Director of Public Safety Bill McDaniel Director of Community Services Jeff Bell Director of Public Works Rich Broman Economic Development Specialist John Schoeph Director of Library Pam Loui Associate Planner/Deputy Director Jim Nakagawa Mr.Jim Geil 171 N.Val Vista Apache Junction,Arizona PROPOSED RESOLUTION NO.89-21,ADOPTING TENTATIVE BUDGET FOR FISCAL YEAR 1989-90 SETTING FORTH TENTATIVE ESTIMATES OF THE MONIES NECESSARY FOR PUBLIC EXPENSES FOR FISCAL YEAR 1989-90;GIVING NOTICE OF TIME AND PLACE FOR HEARING TAXPAYERS FOR THE ADOPTION OF THE FINAL BUDGET FOR FISCAL YEAR 1989-90 )Acting City Manager/City Clerk Kathleen Connelly explained that a series of budget work sessions have taken SPECIAL MEETING OF THE CITY COUNCIL JULY 20,1989 PAGE 1 place,resulting in the proposed tentative budget before the Council,and the Council may at this time,either adopt the tentative budget as presented or make changes.Ms Connelly stated that once this budget is adopted,the amount may not be increased,merely decreased. Councilman Eidson pointed out concerns with the additional police officer being taken out and the amount designated for the Chamber of Commerce,stating that the police officer will be necessary and that the Chamber brings a lot of revenue into the City and should be funded appropriately. Councilman Eidson suggested that instead,the License Enforcement Officer be cut from the budget,and a current employee take on those duties. Mayor Bluntschly commented that the idea of removing a police officer was not agreeable,but cuts have to be made somewhere,and should funds become available next year,the police officer may be added.Mayor Bluntschly also stated that i f the position is put back in and additional funds given to the Chamber of Commerce,funds will have to be taken from something else. Vice Mayor Damiano stated that the Chamber of Commerce proposal is dated January 30,1989,but wasn't submitted to the Council until this Monday,July 17,1989,which didn't allow for much time for review.Vice Mayor Damiano further stated that the Chamber of Commerce funds have been cut even though they are supposed to be the "right arm"of the City,and as they advertise for the City this is the wrong area to cut funds. Vice Mayor Damiano also suggested deleting the License Enforcement Officer from the budget,and asked what the salary range is. Ms Connelly replied that the range is 20. Controller Keith Lewis added that the salary is $19,000. Ms Connelly stated that by having this position filled,many additional revenues are projected to come in to the City. Vice Mayor Damiano stated that i f this position is to be filled,i t should begin as a part time to ascertain i f i t is worthwhile,and this would allow for additional funding for the Chamber of Commerce. Councilwoman Alger pointed out a difference in the non -departmental and library sections of the budget,and asked Controller Keith Lewis what those were. Councilwoman Alger explained that there was a misunderstanding about the Library Clerk position,and that i t was not intended to come out of Contingency,but rather to be eliminated. Acting City Manager/City Clerk Kathleen Connelly explained that information was submitted to the Department of Revenue on a total of 24 vendors at Park n'Swap six or seven weeks ago,and they have just begun going through that list finding that a large amount are not paying sales tax,with some dropping their tax license immediately after obtaining a business license,and some declaring low or no sales.Ms Connelly stated that the City gets a percentage of the State's 5%in addition to the 2%, and the License Enforcement Officer would assist with this lost revenue,and also pointed out that there has not been a staff increase in this area since 1981 even though the business license program has increased 302%,so collections need to be enhanced not cut. Mayor Bluntschly stated that 20% of the vendors at the swap meet are not in compliance,and also at least that much in the business community at large. Ms Connelly stated that the State has a legitimate division of the tax collection for City Sales Tax collection now,unlike in the past,and that they have commented that the more assistance received from the City,the better they in turn can serve us. Ms Connelly added that this is the first step in forming a City tax collection division. Vice Mayor Damiano again stated that part time would be sufficient to begin with for that position,as that person could not possibly be that busy. Councilwoman Alger disagreed, stating that the City needs to begin enforcing things,and although the Chamber is necessary to the City,the fact that the Council is serious about turning the City around making i t a better place to live,needs to be addressed,and this is one way to do that. Director of Library Pam Loui addressed the Council with statistics on the Library,arguing the need for the Library Clerk position,offering alternatives for funds. Ms Connelly stated that in the budget for this year is $9,500 for elections,which the Council may consider putting into Contingency in the event that there is not an election,for the SPECIAL MEETING OF THE CITY COUNCIL JULY 20,1989 PAGE 3 police officer position later on in the year.Ms Connelly added that enough money would need to be left in Contingency just in case there is an election, however,leave the License Enforcement Officer in the budget. Councilman Eidson stated that this does not accomplish his concern. Ms Connelly informed the Council that Councilman Vehon had expressed interest in being present during the streets discussion,and suggested that i t be continued until the next work session. Mayor Bluntschly called upon Operations Supervisor Doug Dobson. Operations Supervisor Doug Dobson stated that the request was made to look into the possibility of doing paving and chip sealing in-house,and quoted a cut -back of $100,000 versus using a contractor for one project,but that drainage and engineering has not been addressed in this research as yet. Mayor Bluntschly asked what project in particular has been considered. Mr.Dobson replied that the Broadway Road with four lanes from Meridian to Ironwood,Ironwood to Idaho,the Superstition project along with residential projects,and the Library parking lot.Mr.Dobson further stated that presently study is being done to ascertain how many projects could be done in-house and at what cost. supports doing these projects in-house. meeting. meeting at 7:35 p.m. Mayor Bluntschly stated that he Mayor Bluntschly recessed the Mayor Bluntschly reconvened the Mayor Bluntschly stated that the Council may have found some ways to come up with additional funding,but will mean getting to work rapidly,and would be preferable to taking money away from something else to fund the Chamber of Commerce. Mayor Bluntschly opened the hearing to the public,and asked i f any wished to address the Council regarding this item. Mr.Jim Geil,171 N.Val Vista, Apache Junction,representing the Chamber of Commerce,asked that the full amount of the request be funded for the Chamber and that the cap be put back to SPECIAL MEETING OF THE CITY COUNCIL JULY 20,1989 PAGE 4 $15,000,and refreshed the Council's memory on the purpose of the Chamber of Commerce in the community. Mayor Bluntschly asked i f there was anyone else who wished to speak?There being no one else wishing to address the Council,Mayor Bluntschly closed the hearing to the public. Councilwoman Alger MOVED THAT RESOLUTION NO.89-21,ADOPTING TENTATIVE BUDGET FOR FISCAL YEAR 1989-90;SETTING FORTH TENTATIVE ESTIMATES OF THE MONIES NECESSARY FOR PUBLIC EXPENSES FOR FISCAL YEAR 1989-90;INCLUDING THE CHANGES MADE IN THE BUDGET THIS EVENING,AND A $15,000 CAP ON CONTINGENCY FOR THE CHAMBER OF COMMERCE OVER AND ABOVE THE $75,000 ORIGINALLY CREATED;GIVING NOTICE OF TIME AND PLACE FOR HEARING TAXPAYERS FOR THE ADOPTION OF THE FINAL BUDGET FOR FISCAL YEAR 1989-90,BE APPROVED AND ADOPTED,AND THAT THE FINAL BUDGET HEARING SHALL BE HELD ON AUGUST 1,1989,AT 7:00 P.M.,IN THE CITY COUNCIL CHAMBERS. Vice Mayor Damiano seconded the motion. Acting City Manager/City Clerk Kathleen Connelly asked Mr.Lewis i f he had all of the mentioned changes. Mr.Lewis replied that the $9,500 from the City Clerk's budget going back to the Contingency,and the Chamber of Commerce budget change,as well as the police officer remaining in place to be possibly funded later in the year. VOTE:Unanimous The motion carried. Mayor Bluntschly announced to the public that the final hearing of the budget will be on August 1st at 7:00 p.m., in the City Council Chambers. PROPOSED ORDINANCE NO.684,AUTHORIZING PARTICIPATION IN THE ARIZONA ELECTED OFFICIALS'RETIREMENT PLAN AND AUTHORIZING THE MAYOR AND ACTING CITY MANAGER TO ENTER INTO A JOINDER AGREEMENT WITH THE ARIZONA ELECTED OFFICIALS' RETIREMENT PLAN ON BEHALF OF ELECTED CITY OFFICIALS )Ms Connelly explained that last year the Council took the first step in becoming participants in the elected officials program,which is set forth by a Legislative act and is State Law,and that step three has been completed.Ms Connelly stated that presented for action is step four,which would allow the City to participate in the elected SPECIAL MEETING OF THE CITY COUNCIL JULY 20,1989 PAGE 5 officials retirement plan,and would authorize the Mayor and Acting City Manager to complete an agreement with the State,and that when taking action the Council should specify which members and under what circumstances the Council wishes to participate in the plan. Ms Connelly added that the Law was changed this year,stating that i f the City does not participate in this plan by September 14th,there are additional funds that would have to be made available. Mayor Bluntschly opened the hearing to the public,and asked i f there was anyone who wished to address the Council on the Ordinance.There being no one wishing to speak,Mayor Bluntschly closed the hearing to the public. Councilwoman Alger MOVED THAT ORDINANCE NO.684,BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Vice Mayor Damiano seconded the motion. VOTE:Unanimous The motion carried. Acting City Manager/City Clerk Kathleen Connelly read as follows: ORDINANCE NO.684,AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AUTHORIZING PARTICIPATION IN THE ARIZONA ELECTED OFFICIALS'RETIREMENT PLAN,AND AUTHORIZING THE MAYOR AND ACTING CITY MANAGER TO ENTER INTO A JOINDER AGREEMENT WITH THE ARIZONA ELECTED OFFICIALS'RETIREMENT PLAN ON BEHALF OF ELECTED CITY OFFICIALS; REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. Councilwoman Alger MOVED THAT ORDINANCE NO.684,AS READ BY THE CITY CLERK BE APPROVED AND ADOPTED WITH THE FOLLOWING AMENDMENTS:PARTICIPATION IN THE PROGRAM SHALL INCLUDE ANYONE SERVING ON THE APACHE JUNCTION CITY COUNCIL SINCE THE INCEPTION OF THE PROGRAM,AUGUST 19,1987,OR ANY WHO HAS ACCRUED FIVE YEARS OF SERVICE AS AN APACHE JUNCTION CITY COUNCIL MEMBER,WHETHER PART OF THAT SERVICE WAS PRIOR TO THE INCEPTION OF THE PROGRAM,WITH THE CITY OF APACHE JUNCTION MAKING ALL CONTRIBUTION PAYMENTS PAST,PRESENT,AND FUTURE. Mayor Bluntschly asked i f there was anyone who wished to speak in favor or in opposition to Ordinance No.686 or Resolution No.89-25.There being no one wishing to address the Council,Mayor Bluntschly closed the hearing to the public. Vice Mayor Damiano MOVED THAT ORDINANCE NO.686,AS READ BY THE CITY CLERK,BE APPROVED AND ADOPTED. Councilman Cox seconded the motion. Vice Mayor Damiano stated that after being on the City Council for many years,he has never seen a budget take so long,and thanked the department heads for cutting down as their budgets were too high at first.Vice Mayor Damiano also thanked Acting City Manager/City Clerk Kathleen Connelly for the wonderful job on the budget. Mayor Bluntschly agreed with Vice Mayor Damiano,and added that this was a learning experience for the Council, and the community will benefit,and further thanked Controller Keith Lewis for his efficiency and work. VOTE:Unanimous The motion carried. PROPOSED RESOLUTION NO.89-25,ADOPTING FINAL BUDGET FOR THE CITY OF APACHE JUNCTION FOR FISCAL YEAR 1989-90 )Councilwoman Barker MOVED THAT RESOLUTION NO.89-25,FULLY ADOPTING ESTIMATES OF EXPENDITURES BY THE CITY OF APACH EJUNCTION FOR THE FISCALYEAR BEGINNING JULY 1,1989,AND ENDING JUNE 30, 1990;DECLARING THAT SUCH SHALL ESTABLISH THE BUDGET OF THE CITY OF APACHE JUNCTION FOR FISCAL YEAR 1989-90,BE APPROVED ADOPTED.
