CALL TO ORDER Vice Mayor Bluntschly called the hearing to order at 6:38 p.m. ROLL CALL Councilmen Present: Staff Present: Others Present: Councilman Burgess Councilman Connolly Councilwoman Gardner Councilwoman Perkins Councilman Damiano Vice Mayor Bluntschly City Manager Bill Da Vee City Clerk Kathleen Connelly City Attorney David Alexander Assistant to the City Manager George Hoffman Controller Keith Lewis Director of Community Services Jeff Bell Director of Public Works Rich Broman 25 members of the public in attendance PROPOSED ALTERNATIVE LOCAL EXPENDITURE LIMITATION (HOME RULE OPTION)FOR THE CITY OF APACHE JUNCTION )Vice Mayor Bluntschly called for the staff presentation on the Home Rule Option and its impact on city operations and services. City Manager Bill Da Vee showed overhead projections of charts outlining the impact of the Home Rule Option, with a background on the purpose and process of the alternative expenditure limitation,and also which City services could be eliminated or decreased should the option fail at the election on March 21st,and also that a Staff PUBLIC HEARING OF THE CITY COUNCIL JANUARY 4,1989 PAGE 1 Subcommittee has studied and come up with proposed options should the present budget have to be cut by one-third.Mr.Da Vee also stated that one option could be contracting out police services,but that after recommendations from staff on all the options,the Council would have to decide which to choose. Mr.Da Vee stated that the question was asked i f taxes could be reduced i f Home Rule didn't pass,and this could be done but is not a reason for compliance with the expenditure limitation,and that the community should know that there could be a loss in revenue due to people going somewhere else where the roads would be better,library hours longer,and community services activities,that will all be affected by the Home Rule being voted down,of roughly 26 million dollars in lost revenues.Mr.Da Vee also commented that the employee cutback will contribute to the economic impact. Vice Mayor Bluntschly asked i f any public wished to address the Council on the Home Rule Option. There being no one wishing to address the Council,Vice Mayor Bluntschly asked i f there were any comments from the Council on the issue. Councilman Damiano stated that Mr.Da Vee covered everything,but that i t would be the people's own fault i f they vote against this,i f they lose all of the services they get now. Councilwoman Gardner commented to the audience,that the Council really needs the public help in assisting with letting citizens know what the Home Rule Option is all about. Mr.Ed Barker,860 S.Saguaro, Apache Junction,asked i f the base year for the formula,which is 1978-79,ever changes? Mr.Da Vee replied that at this time,i t isn't going to change,but that there is a possibility of asking for an adjustment in the future,although when Apache Junction was first formed not many funds were expended that should have been which was unfortunately the year used for the formula. Mr.Da Vee also stated that for instance in Douglas,because of their slower growth factor,the expenditure limitation was sufficient,but with a rapidly growing community like Apache Junction,the limitation is not sufficient. There being no one else wishing to address the Option,Vice Mayor Bluntschly closed the hearing to the public. Councilwoman Gardner MOVED THAT RESOLUTION NO.88-40,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,PROPOSING AN EXTENSION OF THE ALTERNATIVE LOCAL EXPENDITURE LIMITATION FOR THE CITY OF APACHE JUNCTION,BE APPROVED AND ADOPTED, WITH THE FOLLOWING PROPOSAL TO BE REFERRED TO CITY VOTERS AT THE PRIMARY ELECTION TO BE HELD MARCH 21,1989: "THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION SHALL ANNUALLY,AS PART OF THE ANNUAL BUDGET,ADOPT AND EXPENDITURE LIMITATION TO GOVERN THE CITY SPECIAL MEETING OF THE CITY COUNCIL JANUARY 4,1988 PAGE 1 OF APACHE JUNCTION BUDGET FOR THE FISCAL YEAR IMMEDIATELY FOLLOWING SUCH ADOPTION.THE EXPENDITURE LIMITATIONS SHALL BE ADOPTED EACH YEAR AFTER TWO PUBLIC HEARINGS AT WHICH THE CITIZENS OF APACHE JUNCTION MAY COMMENT ON THE PROPOSED EXPENDITURE LIMITATIONS. NO EXPENDITURES SHALL BE MADE IN VIOLATION OF SUCH CITY ORDINANCE,NOR SHALL ANY PROPOSED EXPENDITURES EXCEED THE REVENUES AVAILABLE FOR EXPENDITURE IN THAT FISCAL YEAR PLUS ANY CARRY-OVERS FROM PRECEDING FISCAL YEARS". CALL TO ORDER Vice Mayor Bluntschly called the meeting to order at 7:03 p.m. ROLL CALL Councilmen Present: Transportation Board: Staff Present Councilman Burgess Councilman Connolly Councilman Damiano Councilwoman Gardner Councilwoman Perkins Vice Mayor Bluntschly Mel Mulholland Herb Jordan Roy Hudson Jerry Burgess William Wright Vice Chairman Marie Shanks Chairman Robert Jorgensen City Manager Bill R.Da Vee City Clerk Kathleen Connelly Director of Public Works Rich Broman City Attorney David Alexander Assistant to the City Manager George Hoffman Associate Planner/Deputy Director Jim Nakagawa DISCUSSION AND ACTION ON LETTER OF INTENT BETWEEN THE CITY OF APACHE JUNCTION AND THE DEPARTMENT OF TRANSPORTATION FOR U.S. HIGHWAY 60 AND STATE ROUTE 88 TRANSFERS ) )Director of Public Works Rich Broman explained that after several meetings with the City Council and Transportation Board,and that suggestions have been taken from both and included in the Letter of Intent to between the City of Apache Junction and the Department of SPECIAL MEETING OF THE CITY COUNCIL JANUARY 4,1989 PAGE 1 Transportation regarding the U.S.Highway 60 and State Route 88 transfers,to include a revision to the City paving the right-of-way at Idaho Road with clarifications,the extension of median curb mile east of where ADOT proposed i t on Highway 60,the addition of curbs and sidewalks along the developed areas on north and south sides of U.S.60 between Meridian and Royal Palm,and provisions for future maintenance,installation of utilities at Idaho Road. Extensive discussion took place between the City Council and the Transportation Board on these issues. Council asked questions of Mr.Broman regarding these issues. Councilwoman Gardner MOVED THAT THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVE THE LETTER OF INTENT AS AMENDED BY THE CITY BETWEEN THE ARIZONA DEPARTMENT OF TRANSPORTATION AND THE CITY OF APACHE JUNCTION: 1.THAT THE ARIZONA DEPARTMENT OF TRANSPORTATION ACQUIRE THE RIGHT OF WAY FOR IDAHO ROAD CONSISTENT WITH THE REQUIREMENTS FOR STATE ROUTES OR AT LEAST A MINIMUM OF 100'RIGHT-OF-WAY TO INCLUDE A PROVISION FOR FUTURE SEWER EASEMENTS 2.THAT THE ARIZONA DEPARTMENT OF TRANSPORTATION INSTALL TRAFFIC SIGNALS ON IDAHO ROAD AT THE INTERSECTIONS OF BROADWAY,SIXTEENTH AND SOUTHERN AVENUES, IF WARRANTED. 3.THAT ALL IMPROVEMENTS AS LISTED IN THE L.O.I.BE MADE PRIOR TO THE TRANSFER OF STATE ROUTES. 4.THAT THE ARIZONA DEPARTMENT OF TRANSPORTATION INSTALL CURB AND SIDEWALK ON U.S.HIGHWAY 60 ALONG THOSE AREAS PREVIOUSLY DEVELOPED BETWEEN MERIDIAN AND ROYAL PALM DRIVES. I FURTHER MOVE THAT THE CITY MANAGER AND DIRECTOR OF PUBLIC WORKS BE GIVEN AUTHORIZATION TO CONTINUE NEGOTIATIONS FOR DETERMINING NECESSARY RIGHT-OF-WAY LIMITS FOR IDAHO ROAD. Councilwoman Perkins seconded the motion. Councilman Burgess stated that a lot of good points have been made by the Transportation Board and Council,and these should be part of this Letter of Intent now,rather than later. VOTE:In Favor:Councilwoman Gardner,Councilwoman Perkins, Vice Mayor Bluntschly Opposed:Councilman Burgess,Councilman Damiano,Councilman Connolly SPECIAL MEETING OF THE CITY COUNCIL JANUARY 4,1989 PAGE 2 The motion failed. Councilman Burgess stated that this Letter can be rewritten with the concerns included. Councilman Connolly asked i f i t would be possible to bring the Superstition Freeway to Idaho Road. Mr.Broman explained that extra turns in the Freeway does present a problem. Councilman Burgess suggested that this be postponed and staff bring the Letter back as soon as possible. recess to come up with an amendment. meeting. meeting at 9:03 p.m. Vice Mayor Bluntschly suggested a Vice Mayor Bluntschly recessed the Vice Mayor Bluntschly reconvened the Councilwoman Gardner MOVED THAT THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVE THE LETTER OF INTENT AS AMENDED BY THE CITY BETWEEN THE ARIZONA DEPARTMENT OF TRANSPORTATION AND THE CITY OF APACHE JUNCTION: 1.THAT THE ARIZONA DEPARTMENT OF TRANSPORTATION INSTALL TRAFFIC SIGNALS ON IDAHO ROAD AT THE INTERSECTIONS OF BROADWAY,SIXTEENTH AND SOUTHERN AVENUES, IF WARRANTED. 2.THAT ALL IMPROVEMENTS AS LISTED IN THE L.O.I.BE MADE PRIOR TO THE TRANSFER OF STATE ROUTES. 3.THAT ADOT BE SENSITIVE TO THE CITY'S CONCERN ABOUT SPEED LIMIT ON IDAHO ROAD. 4.THAT ADOT AND THE CITY CONTINUE TO STUDY ALTERNATIVE CORRIDORS FOR STATE ROUTE 88 AND OTHER ROADWAYS. Councilman Damiano seconded the motion. VOTE:In Favor:Councilman Damiano,Councilwoman Gardner,Councilwoman Perkins Councilman Burgess,Vice Mayor Bluntschly Opposed:Councilman Connolly The motion carried.
