CALL TO ORDER Mayor Hill called the meeting to order at 6:02 p.m. ROLL CALL Councilmen Present:Councilwoman Gardner Councilman Damiano Councilman Connolly Councilwoman Perkins Councilman Burgess Vice Mayor Bluntschly Mayor Hill Staff Present:City Manager Bill R.Da Vee City Clerk Kathleen Connelly City Attorney David Alexander Director of Public Safety Bill McDaniel EXECUTIVE SESSION,SPECIAL MEETING, WEEK OF MAY 9,1988 )Councilwoman Perkins MOVED THAT AN EXECUTIVE SESSION BE HELD AT 7:00 P.M.,AND A SPECIAL MEETING AT 6:00 P.M.,ON MAY 11,1988,IN THE CITY COUNCIL CHAMBERS. motion. VOTE:Unanimous The motion carried. PUBLIC HEARINGS PROPOSED RESOLUTION NO.88-10,DECLARING CITY PERSONNEL POLICIES AND POLICE SPECIAL MEETING OF THE CITY COUNCIL MAY 5,1988 PAGE 1 Councilman Connolly seconded the PERSONNEL POLICIES AS PUBLIC RECORD )Vice Mayor Bluntschly MOVED THAT RESOLUTION NO.88-10,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,DECLARING AS A PUBLIC RECORD THOSE CERTAIN DOCUMENTS FILED WITH THE CITY CLERK AND ENTITLED PERSONNEL POLICIES,CITY OF APACHE JUNCTION AND POLICE POLICIES AND PROCEDURES,CITY OF APACHE JUNCTION,ARIZONA, BE APPROVED AND ADOPTED. Councilman Damiano seconded the motion. VOTE:Unanimous The motion carried. PROPOSED ORDINANCE NO.627,AMENDING THE APACHE JUNCTION CITY CODE CHAPTER 3 ADMINISTRATION,ARTICLE 3-10 PERSONNEL SYSTEM,PERTAINING TO RESIDENCY REQUIREMENTS FOR CITY EMPLOYEES (With the Emergency Clause) )Mayor Hill asked i f there was anyone who wished to speak on this ordinance. City Clerk Kathleen Connelly explained that this Ordinance proposes to change the standard Personnel Policies and the Police Policies establishing residency requirements for those presently required to live within the city limits,to a 25 minute response time,to include police personnel,department heads,and supervisory personnel,and those having no residency requirements would remain as such. Director of Public Safety Bill McDaniel stated that Police Department employees,by their presence at this meeting,are indicating their desire to see this residency requirement is relaxed. Councilman Damiano MOVED THAT ORDINANCE NO.627,BE READ BY TITLE ONLY WITH THE EMERGENCY CLAUSE,AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. motion. miles would 25 minutes be. 10 to 15 miles. SPECIAL MEETING OF THE CITY COUNCIL MAY 5,1988 PAGE 2 Councilwoman Gardner seconded the Councilman Burgess asked how many Mr.McDaniel replied approximately Councilman Burgess expressed the opinion that city employees are paid with city taxes,and should reside in Apache Junction to spend those salaries in Apache Junction,but that Gold Canyon and on the mountain are considered in Apache Junction. Councilman Damiano stated that people should be free to live where they wish. Councilman Connolly stated that employees should at least be required to live within Pinal County. Mr.McDaniel commented that most employees will choose to live within the city limits,and that only a few will find i t necessary to live outside Apache Junction. Officer Robert Haywood,2569 W. Cactus Wren,Apache Junction,spoke in favor of the Ordinance. Mr.McDaniel pointed out that officers would like to be able to shop without running into criminals that they arrested the night before,which does happen. Councilwoman Perkins agreed with Councilman Burgess and Councilman Connolly. Vice Mayor Bluntschly agreed with the officers that there is a problem running into those they arrested,and the housing options are limited in Apache Junction. Lieutenant Louis Garcia,750 E. Southern,Apache Junction,addressed the Council in favor of the Ordinance,and stated that very few officers will choose to reside outside Apache Junction. City Manager Bill R.Da Vee explained that the response time criteria came into being following the Supreme Court ruling that cities could not require residency,and that there is concern that Apache Junction only requires residency in the Police Department and for select other positions. Officer T.J.Watkins,P.O.724, Apache Junction,requested that the change in residency be approved. Officer Dan Schultz,455 S. Delaware,Apache Junction,requested approval of the Ordinance. Officer Dick Virgil,W.22nd Avenue, Apache Junction,spoke in favor of the residency change. SPECIAL MEETING OF THE CITY COUNCIL MAY 5,1988 PAGE 3 Officer Theresa Sherwood,1524 S. Frontier,Apache Junction,addressed the Council requesting approval of the Ordinance. Officer Richard Boulden,1047 W.4th Avenue,Apache Junction,requested approval of the Ordinance. VOTE:Unanimous The motion carried. City Clerk Kathleen Connelly read as follows: ORDINANCE NO.627,AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE BY AMENDING CHAPTER 3 ADMINISTRATION,ARTICLE 3-10 PERSONNEL SYSTEM,PERTAINING TO RESIDENCY REQUIREMENTS FOR CITY EMPLOYEES; REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND DECLARING AN EMERGENCY. Councilman Damiano MOVED THAT ORDINANCE NO.627,AS READ BY THE CITY CLERK,BE APPROVED AND ADOPTED. Councilwoman Gardner seconded the motion. Councilman Connolly expressed the feeling that to approve this Ordinance would be "selling out"the City and Pinal County. Vice Mayor Bluntschly requested that the emergency clause be removed from the Ordinance. Vice Mayor Bluntschly amended the motion THAT THE EMERGENCY CLAUSE BE DELETED FROM ORDINANCE NO.627. Councilwoman Gardner seconded the amendment. VOTE (on the amendment):Unanimous The amendment carried.
