AN ORDINANCE.OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY
AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING
THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-50-86 FROM C-3
(PARCELS 1,2 AND 3)AND GR (PARCEL 4)TO GENERAL COMMERCIAL DISTRICT BY
PLANNED DEVELOPMENT C-3/PD REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING
FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
1.The zoning district classification on the Zoning District Map,City
of Apache Junction,Arizona,for the parcels of land described as:
Parcel No.1
That portion of the North 1 of the Northwest A of the Northeast
A of the Southwest *of Section 27,Township 1 North,Range 8
East,Gila and Salt River Base and Meridian,Pinal County,Arizona,
described as follows:
BEGINNING at the Northwest corner of the Northeast i of the South-
west A of said Section 27;thence South 89°58'East 67.35 feet
to the TRUE POINT OF BEGINNING;thence continuing South 89°58'
East 477.30 feet;thence South 32°06'18"West 236.35 feet to a
point on U.S.Highway 60-70-80 and 89 right-of-way line;thence
North 54°48'West along said highway right-of-way line 405.05
feet to the TRUE POINT OF BEGINNING;
EXCEPT the North 40 feet thereof.
Parcel No.2
The North 1 of the Northwest A of the Northeast i of the Southwest
A of Section 27,Township 1 North,Range 8 East,Gila and Salt
River Base and Meridian,Pinal County,Arizona;
EXCEPT that portion lying within the right-of-way of U.S.Highway
60-70-80 and 89;and further
EXCEPT that portion of the North 1 of the Northwest A of the North-
east A of the Southwest i of Section 27,Township 1 North,Range
8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona,
described as follows:
BEGINNING at the Northwest corner of the Northeast 4 of the South-
west A of said Section 27;thence South 89°58'East 67.35 feet to
the TRUE POINT OF BEGINNING;thence continuing South 89°58'East
447.30 feet;thence South 32°06'18"West 236.35 feet to a point
of the U.S.Highway 60-70-80 and 89 right-of-way line;thence North
54°48'West along said highway right-of-way line 405.05 feet to
the TRUE POINT OF BEGINNING;and further
EXCEPT the North forty feet (40')and the East thirty-three feet
(33')thereof;and further EXCEPT a portion of the North 1 of the
Northwest i of the Northeast i of the Southwest of Section 27,
Township 1 North,Range 8 East,Gila and Salt River Base and
Meridian,Pinal County,Arizona,further described as follows:
COMMENCING at the Northeast corner of the Northwest A of the North-
east 4 of the Southwest A;thence South along the East line of the
Northwest 4 of the Northeast A of the Southwest 4,a distance of
sixty feet (60')to a point;thence West along a line parallel to
and sixty feet (60')distant to the North line of the Northwest *
of the Northeast *of the Southwest * ,a distance of thirty-three
feet (33')to the TRUE POINT OF BEGINNING;thence North along a
line parallel to and thirty-three feet (33')distant to the East
line of the Northwest *of the Northeast *of the Southwest a
distance of twenty feet (20')to a point;thence West along a line
parallel to and forty feet (40')distant to the North line of the
Northwest *of the Northeast A of the Southwest A,a distance of
twenty feet (20')to a point;thence proceeding in a Southeasterly
direction to the TRUE POINT OF BEGINNING.
Parcel No.3
The South of the Northeast *of the Northeast *of the Southwest
*of Section 27,Township 1 North,Range 8 East,Gila and Salt
River Base and Meridian,Pinal County,Arizona.
Parcel No.4
The South of the Northwest *of the Northeast *of the Southwest
*of Section 27,Township 1 North,Range 8 East,Gila and Salt River
Base and Meridian,Pinal County,Arizona,lying North of the Northerly
right-of-way line of Highway 60,70,80,and 89
be and hereby i s amended from C-3 (Parcels 1,2 and 3)and GR (Parcel 4)
to General Commercial District by Planned Development C-3/PD.
2.The approval of the zoning district classification shall be construed
as only concept approval for the base zoning and shall serve as official
approval of the base zoning amendment to the Zoning Map.
3.Development of said property shall be in accordance with the provisions
of Article 19 of the Zoning Ordinance.The provisions of the Uniform
Building Code and all other City codes,policies,guides,and detailed
standards shall apply and control all design and construction of
improvements.
4.The rezoning materials be submitted for the last property within 60
days of the acquisition,understanding the property may be i n probate
for some time yet.
5.Abandonment of the E.17th Avenue,E.18th Avenue,and S.Bowman Road
within the limits of the project must be approved.
6.All of the properties must be legally combined into one parcel.
7.No grading,grubbing,or site preparation commence until just prior to
the start of the construction.
8.Developer relocate or preserve native vegetation where reasonably possible.
9.That development occur according to the site plan submitted.
SECTION I I REPEALING ANY CONFLICTING PROVISONS
All ordinances and parts of ordinances i n conflict with the provisions of
this Ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,sub -section,sentence,phrase,clause,or portion of this
Ordinance or any part of the code adopted herein by reference i s for any reason
held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
