AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY
AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING
THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-52-86 FROM CR-1 SINGLE
FAMILY RESIDENCE TO C-2 LOCAL COMMERCIAL;REPEALING ANY CONFLICTING PROVISIONS;
AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map,City of Apache
Junction,Arizona,for the parcels of land described as:
South half of the Southwest quarter of the Southwest quarter
of the Southwest quarter in Section 15,Township 1 North,
Range 8 East,Gila and Salt River Base and Meridian,Apache
Junction,Pinal County,Arizona
be and hereby i s amended from CR-1 Single Family Residence to C-2 Local
Commercial subject to the following stipulations:1)The applicants dedicate
the North thirty-three feet (33'), the East thirty-three feet (33'),the South
fifty feet (50'),and the West fifty feet (50')of the subject property for
public roadway and associated purposes along with twenty foot (20')by twenty
foot (20')cutoffs at the intersections of Tomahawk and Superstition,Super-
stition and Vista,Vista and Siesta,and Tomahawk and Siesta 2)The site
plans must be approved by the Planning and Zoning Commission prior to each
phase of development 3)The applicants will have 24 months to commence their
work and three years to complete the total project 4)There will be no more
grading done on the site until the Planning and Zoning Commission reviews
and approves the site plans.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this Ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,sub -section,sentence,phrase,clause or portion of this
Ordinance or any part of the code adopted herein by reference i s for any reason
held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portion thereof.
