AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,REPEALING ORDINANCE NO.158 AND ORDINANCE NO.294,ADDING CHAPTER
5 TO VOLUME I I OF THE LAND DEVELOPMENT CODE OF THE CITY OF APACHE JUNCTION,
PERTAINING TO FLOODPLAIN MANAGEMENT,ADOPTING BY REFERENCE,PROVIDING
FOR REPEAL OF CONFLICTING PROVISIONS,PROVIDING FOR SEVERABILITY,PROVID—
ING FOR PENALTIES AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNC—
TION,ARIZONA,THAT:
SECTION I IN GENERAL
That certain document which was made public record by Resolution
Number 87-16,entitled "Floodplain Management Ordinance"is hereby
adopted by reference as Chapter 5,"Volume I I of the Land Development
Code"and made a part thereof as i f fully set forth in this ordi—
nance.
SECTION I REPEAL OF CONFLICTING ORDINANCES
All ordinances and parts of ordinances in conflict with the provi—
sions of this ordinance or any part of the code adopted herein by
reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,sub—section,sentence,phrase,clause or portion
of this ordinance or any part of the code adopted herein by reference
is for any reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction,such decision shall
not affect the validity of the remaining portion thereof.
SECTION IV PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF
Any person,firm or corporation,whether as principal,owner,agent,
tenant,employee,or otherwise,who violates any providions of this
ordinance or violates or fails to comply with any order or regulation
made hereunder,shall be guilty of a class 2 misdemeanor.Each
day's continuance of a violation shall be deemed a separate offense.
SECTION V EMERGENCY CLAUSE
I t is necessary for the preservation of peace,health,and safety
of the City of Apache Junction,Arizona,that this ordinance become
effective immediately,an emergency is hereby declared to exist,
and this ordinance shall be effective immediately upon passage and
adoption.
