AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING
THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-3-87 FROM GR GENERAL RURAL TO
C-3/PD GENERAL COMMERCIAL BY PLANNED DEVELOPMENT;REPEALING ANY CONFLICTING
PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINDED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
1.The zoning district classification on the Zoning District Map,City
of Apache Junction,Arizona,for the parcel of land described as:
Parcel 1
Lot 28 Block 3,Amended Plat of Newton,Book 5 Page 23A,Pinal County,
Arizona,EXCEPT the west 150 feet.
Parcel 2
The West 150 feet (150')of Lot 28,Block 3,Amended Plat of Newton,
Book 5,Page 23A,Pinal County,Arizona,EXCEPT the North 17 feet
(17').
be and hereby i s amended from GR General Rural to C-3/PD General Commercial
by Planned Development.
2.The approval of the zoning district classification shall be construed
as only concept approval for the base zoning and shall serve as official
approval of the base zoning amendment to the Zoning Map.
3.Development of said property shall be i n accordance with the provisions
of Article 19 of the Zoning Ordinance.The provisions of the Uniform
Building Code and all other City codes,policies,guides,and detailed
standards shall apply and control all design and construction of improve-
ments.
4.The dedication of the North seventeen feet (17')of the eastern parcel
(101-02-082)and the East seventeen feet (17')of the subject property
for public roadway and associated purposes along with a twenty foot
(20')by twenty foot (20')cutoff at the intersection of Superstition
and Ironwood.
5.The applicant combine the subject site (County Assessor's Tax Parcel
Numbers 101-02-082 and 101-02-083)into one parcel through the Pinal
County Assessor's Office.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances i n conflict with the provisions of
this Ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,sub -section,sentence,phrase,clause,or portion of this
Ordinance or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction,such decision shall not affect the validity of
the remaining portions thereof.
