AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AUTHORIZING PARTICIPATION IN THE
ARIZONA ELECTED OFFICIALS'RETIREMENT PLAN AND AUTHORIZING
THE MAYOR AND ACTING CITY MANAGER TO ENTER INTO A JOINDER
AGREEMENT WITH THE ARIZONA ELECTED OFFICIALS'S RETIREMENT
PLAN ON BEHALF OF ELECTED CITY OFFICIALS;REPEALING ANY
CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
Pursuant to Arizona Revised Statutes §38-815,the City of Apache Junction
shall participate in the Arizona Elected Officials'Retirement Plan on behalf
of designated eligible elected city officials who shall be designated in the
following manner:Those Apache Junction City Council members who have served
since the inception of the program on August 17,1987,or who have accrued
five years of service whether part of that service was prior to August 17,1987,
with the City of Apache Junction making all contribution payments past,present
and future.
SECTION I I AUTHORIZATION TO PARTICIPATE AND ENTER INTO AGREEMENT
Pursuant to Arizona Revised Statutes 38-815,the CIty of Apache Junction hereby
authorizes participation in the Arizona Elected Officials'Retirement Plan for
those designated eligible elected officials as designated in Section I of this
ordinance and further authorizes the Mayor and Acting City Manager to enter
into a joinder agreement with the Arizona Elected Officials'Retirement Plan
on behalf of the named or designated city officials.
SECTION III REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this ordinance or any part of the code adopted herein by reference are
hereby repealed.
SECTION IV PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this ordi-
nance or any part of the code adopted herein by referenceis,for any reason,
held to be invalid or unconstitutional by any court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions thereof.
