HomeMy WebLinkAboutORD699ORDINANCE NO.699 AN ORDINANCE OF THEM MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA;ESTABLISHING A SCHOOL CROSSING AT FOUR PEAKS ELEMENTARY SCHOOL IN THE CITY OF APACHE JUNCTION,ARIZONA;PROVIDING FOR SEVERABILITY AND PROVIDING FOR PENALTIES. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT: SECTION I IN GENERAL I t is in the public interest to insure safe,effective and efficient traffic flow along public rights—of—way within the City of Apache Junction,Arizona and i t has been determined that traffic control devices are necessary for the public safety.Now,therefore be i t ordained that an Operating Agreement be approved for the establishment of a school crossing in the vicinity of Idaho Road and Tepee Street, Furthermore,the Director of Public Works and the Director of Public Safety are hereby empowered and directed to initiate appropriate action to install and enforce said traffic control devices. SECTION I I REPEALING AND CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance,or any part of the code adopted herein by reference,are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof. SECTION IV PENALTY CLAUSE Any person found guilty of any violation of or failure or refusal to do or perform any act required by Chapter 12 of this code constitutes a civil traffic violation.Civil traffiE violations are subject to the provisions of Title 28, Chapter 6,Article 20 and 21,Arizona Revised Statute,and amendments thereof.
