AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING
AND ADDING TO SECTION 5.0101 AND BY AMENDING AND ADDING TO SECTION 20.0108;
REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA
THAT:
SECTION I IN GENERAL
The Apache Junction,Arizona,Zoning Ordinance i s amended by amending and
adding to Section 5.0101,and by amending and adding to Section 20.0108
to read as follows:
SECTION 5.0101
delete:
LOT LINE,STREET OR ALLEY:The mean horizontal width or a lot
measured at right angles to the depth.
amend to read:
LOT:A parcel of land or two or more contiguous parcels of land to be used
as a unit under the provisions of this Ordinance,as shown i n the records
of the Pinal or Maricopa County Recorder's Office and having its principal
frontage on a street or an approved private access way.
LOT LINE:A line of record bounding a lot which divides one lot from another
lot or from a street or any other public space or from a private access
way.
LOT LINE,FRONT:In a case of a lot abutting only one (1)street or private
access way,the line separating such lot from the street or private access
way.In the case of a corner or through lot,the owner may elect any street
lot line as the front lot line,provided such choice,i n the opinion of
the Zoning Administrator,will not be injurious to the existing or desirable
future development of adjacent properties.
STREET:A dedicated,deeded,or otherwise appropriated to public uses,
public passageway which affords the principal means of access to abuttingproperty.
add,i n the proper alphabetical sequence:
LOT AREA:The total area of a lot measured i n a horizontal plane,included
within the lot lines of a lot or parcel of land,not including any public
street or private access way.

LOT WIDTH:The width of a lot shall be either:
1.I f the side property lines are parallel,the shortest distance
between side lines;or
2.I f the side property lines are not parallel,the width of the
lot shall be the length of a line at right angles to the axis
of the lot at a distance equal to the front setback required
for the zoning district i n which the lot i s located.The axis
of a lot shall be a line joining the midpoints of the front
and rear property lines.
PRIVATE ACCESS WAY:A private street or private way of access to one or
more lots which i s owned by an individual or group of individuals which
i s burdened with an easement of passage,running with the land,to the benefit
of all lots having frontage thereon,and which intersects or connects with
a public street.Private access ways are subject to the provisions of
Section 20.0108.The distinction between a private access way and a driveway
will be determined by the Zoning Administrator.
SECTION 20.0108 INTERIOR OR PRIVATE STREET STANDARDS
amend to read:
Section 20.0108 PRIVATE ACCESS WAY STANDARDS
All private access ways i n any type of development or access thereto
shall be a minimum of twenty-eight feet (28')i n unobstructed width of paved
surface (back of curb to back of curb,i f curbs are installed)with a twenty
foot (20')by twenty foot (20')cutoff at intersections or a minimum turning
radius of twenty feet (20').
A private access way may be permitted where its use is logically consis-
tent with a desire for neighborhood identification and control of access
and where special design concepts may be involved,such as within planned
development areas,mobile home developments,subdivisions,or with Conditional
Use Permits.
Any private access way shall be subject to the following provisions
as a condition precedent to issuance of any building permits on any lot
served by a private access way:
1.Such private access way must have been recorded in the office
of the County Recorder prior to the effective date of Ordinance
No.603 (January 14,1988)and in compliance with regulations
in effect at the time of creation of such private access way,
or:

2.Submitted to the Planning and Zoning Commission for their review
and recommendation to the Council,and approval by the City
Council subject to the following requirements:
a.Paving shall be installed according to city standards
for residential streets,or i n accordance with subdivision
regulations,i f applicable.Curbs,gutters,sidewalks,
and streetlights may be required by the Council.
b.Other requirements imposed by the Council for vehicular
and pedestrian safety,utilities and emergency vehicle
access.
c.No private access way shall be approved,i f i n the opinion
of the City Council,a public street would better serve
the public health,safety,and welfare or the location
of the private access way presents a potential hazard
to vehicular or pedestrian traffic at the intersection
of the private access way with a public street.
d.Permits and reviews shall be required for private access
ways i n the same manner as for public streets.Testing
and inspection for conformance of construction to minimum
requirements of approved plans shall be the responsibility
of the developer who shall provide the city with documen-
tation that such requirements have been satisfied prior
to project acceptance.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances i n conflict with the provisions of
this ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,sub -section,sentence,phrase,clause or portion of this
ordinance or any part of the code adopted herein by reference i s for any
reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction,such decision shall not affect the validity of
the remaining portion thereof.
