HomeMy WebLinkAboutORD604ORDINANCE NO.604 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-16-87 FROM CB -2 GENERAL BUSINESS TO C-4 HEAVY COMMERCIAL DISTRICT;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcels of land described as: That part of the Southeast quarter of the Northeast quarter of Section 28, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, Apache Junction,Pinal County,Arizona,lying south of U.S.Highway 60-70- 80-89,described as follows: BEGINNING at the Southwest corner of the Southeast quarter of the Northeast quarter of said Section 28; Thence along a line perpendicular to the Southwesterly line of Highway 80 to its intersection with said highway right-of-way line; Thence Northwesterly along the right-of-way line of said Highway 80,294 feet to the true point of beginning; Thence Southwesterly along a line perpendicular to Highway 80 right-of-way line a distance of 507 feet; Thence Northwesterly a distance of 50 feet along a line parallel to Highway 80 right-of-way line; Thence Northerly along a line parallel to Weekes Wash a distance of 217.26 feet; Thence Northeasterly along a line perpendicular to Highway 80 right-of-way line a distance of 305 feet; Thence Southeasterly a distance of 130 feet along the South right-of-way line of Highway 80 to the TRUE POINT OF BEGINNING. Subject property contains 57,830 square feet or 1.08 acres. be and hereby i s amended from CB -2 General Business to C-4 Heavy Commercial District;subject to the following stipulations: 1.The final development plan of this project be in substantial conformance with the approved preliminary plan. 2.The height of any structure on this site not be any higher than twenty feet (20'). Ordinance No.604 Page One of Two •.e; City Attorney 3.The final landscaping,elevations,and site plans be approved by the Planning Department. 4.The storage yard be surfaced or dust -proof. 5.The access road be improved with aggregate base course and asphaltic concrete surfacing approved by the City Engineer and provide drainage under the roadway for future retention and runoff. 6.Postpone off -site improvements,i f stipulated by the City Engineer,in order to coordinate with the Arizona Department of Transportation's program for improving Highway 60. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference i s for any reason held to be invalid or unconstitutional by the decision of the court of competent jurisdiction,such decision shall not affect the validity of the remaining portion thereof.
