HomeMy WebLinkAboutORD1103ORDINANCE NO.1103 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE.VOLUME II.LAND DEVELOPMENT CODE.CHAPTER 1.ZONING ORDINANCE.BY AMENDING THE ZONING DISTRICT MAP.CITY OF APACHE JUNCTION.ARIZONA.CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-10-99 FROM CR-3 (CONVENTIONAL SINGLE-FAMILY RESIDENCES ON 7000 -SQUARE- FOOT MINIMUM LOTS)TO CR-4/PD (MULTI -FAMILY RESIDENCES BY PLANNED DEVELOPMENT WITH TOWNHOUSES ALLOWED AS A CONDITIONAL USE);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map.City of Apache Junction.Arizona,for the parcel of land described as: Tract A,Apache Villa,according to the plat of record in the office of the County Recorder of Pinal County,Arizona,in Book 9 of Maps, Page 58; be and hereby is amended from CR-3 (Conventional Single -Family Residences on 7000 -Square -Foot Minimum Lots)to CR-4/PD (Multi -Family Residences with Townhouses Allowed as a Conditional Use by Planned Development)in order to allow the development of a proposed family subdivision,subject to the following conditions of approval: 1)The final Planned Development plans shall be developed according to the site plans and elevations presented on the preliminary Planned Development plans for "Alternative No.3". 2)The eventual development shall not exceed the range of Medium Density as defined by the 1987 General Plan. 3)Approval of the preliminary Planned Development plans incorporates by reference any requested deviations from standard CR-4 zoning,as set forth in the Apache Junction City Code.Volume II.Land Development Code. Chapter 1.Zoning Ordinance,including requested deviations from setbacks, lot sizes and reasonable perimeter landscaping requirements. ORDINANCE NO.1103 PAGE 1 OF 3 4)The final Planned Development plans shall comply with or exceed the provisions as set forth in the Apache Junction City Code.Volume II.Land Development Code.Chapter 1.Zoning Ordinance.Article 19 Planned Development Zoning District,and the Homeowners Association Maintained Open Space Standards (as referenced in the City of Apache Junction Engineering Guidelines,adopted by Ordinance No.932,and as declared a public record by Resolution No.95-19)pertaining to the minimum requirements for open space relative to density and usable open space areas. 5)The property owners shall improve to the City Engineer's standards any necessary rights -of -way,including,but not necessarily limited to,the north 50 feet for W.Broadway Avenue,the west 40 feet for S.Delaware Drive,the south 25 feet for W.10"Avenue,the east 30 feet for S. Lawther Drive and any necessary cut-off corners.Said improvements shall include the provision of curbs,gutters,sidewalks,driveways, streetlights,pavement widening,retention basins and other reasonable improvements required by the City Engineer. 6)The property owners shall develop and submit,pursuant to the Apache Junction City Code.Volume II.Land Development Code.Chapter 6.Article 6-1.Landscaping and Screening Requirements,landscape plans subject to approval by the Parks and Recreation Department and the Planning Division, during the building permit process. 7)The property shall be developed within 24 months of rezoning approval or else the zoning may revert to its former classification according to the Apache Junction City Code.Volume II.Land Development Code.Chapter 1. Zoning Ordinance.Article 19 Planned Development Zoning District. 8)All construction shall be done in compliance with all applicable codes and ordinances as adopted in the Apache Junction City Code.Volume II, including,but not limited to,the Zoning Ordinance.the Uniform Building Code.Engineering Guidelines and the Uniform Fire Code (including,but not limited to,the provision of fire apparatus access roads,the marking of fire lanes and the provision of adequate water supplies,sprinkler systems and fire hydrants). 9)6 -foot masonry buffer walls along the perimeter street frontages shall consist of both intermittent masonry and wrought iron segments for aesthetic and view fencing purposes. ORDINANCE NO.1103 PAGE 2 OF 3 10)The developers shall pay all applicable Development Fees prior to the issuance of building permits. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance,or any part of the code adopted herein by reference,are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
