HomeMy WebLinkAboutORD1108ORDINANCE NO.1108 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE,VOLUME II,LAND DEVELOPMENT CODE,CHAPTER 1,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION.ARIZONA.CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-11-99 FROM TH (TRAILER HOMESITE ZONE)TO CR-3/PD (CONVENTIONAL SINGLE- FAMILY HOMES BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map.City of Apache Junction.Arizona,for the parcel of land described as: The Southwest quarter of the Southwest quarter of Section 34, Township One North,Range Eight East of the Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona; be and hereby is amended from TH (Trailer Homesite Zone)to CR-3/PD (Conventional Single -Family Homes by Planned Development),subject to the following conditions of approval: 1)The final development plan shall be in substantial compliance with the concept plan presented and approved with rezoning case PZ-11-99 for the proposed +/-180 lot subdivision. 2)Approval of the rezoning concept plan incorporates by reference adherence to standard CR-3 zone requirements as set forth in the Apache Junction City Code,Volume II,Land Development Code,Chapter One,Zoning Ordinance,Article 15 Residential Districts,Section 15.0400 CR-3 Single- Family Residence Zone,except that the minimum lot size shall be 6745 net square feet as measured from the property line at the back of the sidewalk. 3)The property owners shall dedicate and improve to the City Engineer's standards any necessary rights -of -way,including,but not limited to,the west 50 feet for S.Tomahawk Road,the South 50 feet for E.Baseline Avenue,typical 40 -foot -wide (from back of sidewalk to back of sidewalk) ORDINANCE NO.1108 PAGE 1 OF 3 interior right-of-ways,and any necessary cut-off corners.Said improvements shall include the provision of curbs,gutters,sidewalks, driveways,streetlights,pavement widening,retention basins and other reasonable improvements required by the City Engineer. 4)The property owners shall develop and submit,pursuant to the Apache Junction City Code,Volume II,Land Development Code,Chapter 6,Article 6-1.Landscaping and Screening Requirements,landscape plans for the perimeter road frontages and retention basins subject to approval by the Parks and Recreation Department and the Planning Division,during the platting process and the building permit process.The proposed larger retention basins at the southwest and southeast corners of the proposed subdivision shall include turf play areas,to be as large as possible,and shall be enclosed on their exterior street frontage perimeters with wrought iron view fences. 5)The property shall be developed within 24 months of rezoning approval or else the zoning may be subject to reversion to its former classification by City Council legislative action pursuant to Arizona Revised Statutes Annotated (A.R.S.)§9-462.01. 6)All construction shall be done in compliance with all applicable codes and ordinances as adopted in the Apache Junction City Code,Volume II, including,but not limited to,the Zoning Ordinance,the Uniform Building Code,Engineering Guidelines and the Uniform Fire Code (including,but not limited to,the provision of fire apparatus access roads,the marking of fire lanes and the provision of adequate water supplies,sprinkler systems and fire hydrants). 7)The developers shall pay all applicable development fees prior to the issuance of building permits. 8)The final Planned Development plans shall comply with the provisions of the Apache Junction City Code,Volume II,Land Development Code,Chapter 1,Zoning Ordinance,Article 19 Planned Development Zoning District standards for open space relative to density,or 5% of the total project. 9)The final Planned Development plans shall meet or exceed the minimum Homeowners Association Maintained Open Space Standards in effect at the time of final approval for open space (2 acres total),required usable open space (1 acre)and play stations. ORDINANCE NO.1108 PAGE 2 OF 3 10)8 -foot -wide public utility easements shall be provided within the front yard setback areas,as measured from the back of the sidewalk.On the street side of a corner lot,there shall be a 5 -foot -wide public utility and landscape easement,as measured from the back of the sidewalk. 11)The street fronting narrow side of the lots shall be considered the front yard. 12)There shall be 10 -foot minimum sideyard setbacks on both sides of the lots. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance,or any part of the code adopted herein by reference,are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
