HomeMy WebLinkAboutORD1109ORDINANCE NO.1109 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA.APPROVING A PLANNED DEVELOPMENT MAJOR AMENDMENT,CASE PZ-12-99,FOR A 1.51 -GROSS -ACRES,TH/PD (TRAILER HOMESITES BY PLANNED DEVELOPMENT) -ZONED PROPERTY,LOCATED ON N. IRONWOOD DRIVE,BY AMENDING ORDINANCE NOS.120 and 1026:REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL That Ordinance Nos.120 and 1026 be amended with the addition of the following conditions of approval,pertaining to the development of the following described property,which was originally part of a larger Planned Development property: The West 400 feet of the North half of the South half of the Northwest quarter of the Southwest quarter of the Northwest quarter of Section 17,Township 1 North, Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona;EXCEPTING all coal, oil,gas and other mineral deposits,as reserved to the United States of America in the Patent of said land;RESERVING unto the Grantors,their successors or assigns an easement for ingress,egress and utilities over the South 28 feet thereof:AND TOGETHER WITH an easement for ingress,egress and utilities over the South 28 feet of the West 400 feet of the North half of the South half of the Northwest quarter of the Southwest quarter of the Northwest quarter of Section 17,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona. The additional conditions of approval which specifically apply to the property described above and in case file PZ-12-99.are as follows: 1)The future land split shall be executed in accordance with the basic configuration shown on the submitted preliminary plan contained in case ORDINANCE NO.1109 PAGE 1 OF 3 file PZ-12-99. 2)The resultant three lots,at the time of development,shall be improved with new double -wide (or larger)manufactured homes or conventional homes. 3)At the time of development of any of the three resultant lots,the applicants shall be responsible for insuring the installation of front yard landscape packages,according to the provisions of the Apache Junction City Code,Volume II,Land Development Code,Chapter 6,Article 6-1,Landscape and Screening Requirements. 4)The property shall be developed within 24 months of rezoning approval or else the zoning may revert to its former classification,by legislative action of the City Council,according to the provisions of the Apache Junction City Code,Volume II,Land Development Code,Chapter 1.Zoning Ordinance,Article 19,Planned Development Zoning District,Section 19.0111(4). 5)The provisions of the Uniform Building code and all other City Codes, policies,guides and standards shall apply and control all design and construction of improvements. 6)Development fees shall be paid by permit applicants at the time of building permit issuance. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase.clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
