HomeMy WebLinkAboutORD1115ORDINANCE NO.1115 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,ESTABLISHING LOCATIONS FOR "NO PARKING" SIGNS ON PUBLIC RIGHTS -OF -WAY IN THE CITY OF APACHE JUNCTION,ARIZONA; REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL Pursuant to Arizona Revised Statutes Annotated (A.R.S.)§9-276,the City of Apache Junction has determined i t is in the public interest to ensure safe, effective and efficient traffic flow along public rights -of -way within the City of Apache Junction,Arizona.The City finds that traffic control devices are necessary to further this goal.Pursuant to Apache Junction City Code Section 12-3-4,the City of Apache Junction may erect signs restricting parking.Now, therefore,be it ordained that "No Parking" signs may be erected at the following locations: 1.North Side and South Side of East Lost Dutchman Boulevard measured from the center of the intersection of East Lost Dutchman Boulevard and North Tomahawk Road and continuing west for a distance of 1,322 feet. 2.East Side of North Idaho Road beginning at the North Side of the driveway at 1001 North Idaho Road and continuing north to north end of curbing at 1177 North Idaho Road. Furthermore,pursuant to Apache Junction City Code Section 12-2-4(A),the Director of Public Safety is hereby empowered and directed to initiate appropriate action to place,maintain and enforce said traffic control devices. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. ORDINANCE NO.1115 PAGE 1 OF 2 SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof. SECTION IV EMERGENCY CLAUSE It being necessary for the preservation of the peace,health and safety of the City of Apache Junction,Arizona,that this ordinance become effective immediately,an emergency is hereby declared to exist and this ordinance shall be effective immediately upon passage and adoption by the City Council,and is exempt from the referendum provisions of the Constitution and the laws of the State of Arizona as provided in A.R.S.§19-142(b).
