HomeMy WebLinkAboutORD1128ORDINANCE NO 1128 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING THE SITE PLAN AND ARCHITECTURAL ELEVATIONS OF A COMMERCIAL/RESIDENTIAL PAINTING BUSINESS THROUGH A PLANNED DEVELOPMENT MAJOR AMENDMENT IN CASE PZ-00-06 ON A PROPERTY ZONED CI-1/PD (LIGHT INDUSTRY AND WAREHOUSE ZONE BY PLANNED DEVELOPMENT),LOCATED ON THE WEST SIDE OF SOUTH COCONINO DRIVE,ONE PARCEL SOUTH OF 22ND AVENUE;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. WHEREAS,the Mayor and City Council of the City of Apache Junction,Arizona, on March 18,1997 passed and adopted Ordinance No.984,amending the Apache Junction,Arizona Zoning Ordinance,by amending the Zoning District Map,City of Apache Junction,Arizona,changing the zoning district classification in rezoning case PZ-96-19 from CB -2 (General Business)to CI-1/PD (Light Industry and Warehouse Zone by Planned Development);and WHEREAS,said Ordinance No.984 is now in full force and effect;and WHEREAS,said Ordinance No.984 is a valid ordinance of the City of Apache Junction,Arizona and i t is the specific intent that Ordinance No.1128 not affect the validity of Ordinance No.984 as passed and adopted on March 18, 1997:and WHEREAS,the current owners of the property in question,Bud and Joan Mitchell,submitted to the Planning and Zoning Commission ("Commission")a major amendment to their Planned Development pursuant to Apache Junction City Code,Volume II,Land Development Code,Chapter 1,Zoning Ordinance, §19.011(2),Supplementary Provisions,wherein the Commission recommended approval at their March 28,2000 regular meeting by a vote of 6 to 0:and WHEREAS,the Commission's recommendation contained conditions which the Council hereby determines to provide greater flexibility in land uses and encourages creative design compatible with existing and proposed land uses in the vicinity of the property in question:and WHEREAS,the proposed Major Amendment,subject to the conditions set forth herein,enables the use and integration of contemporary land planning principles in such a manner as to promote its most appropriate use,and further allows diversification in the relationship of the various uses, structures and spaces. ORDINANCE 1128 PAGE ONE OF FOUR NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AS FOLLOWS: SECTION I IN GENERAL The site plan and architectural elevations of a commercial/residential painting business be approved,retaining the CI-1/PD (Light Industry and Warehouse Zone by Planned Development)designation,for the parcel of land legally described as follows: Lots 358,359,360,361 and 362 of the Superstition Villa Subdivision, according to the plat of record in the Recorders Office of Pinal County, Arizona.in Book 12 of Maps,Page 39,and re -dedicated in instrument recorded in Docket 430,page 600. Subject to the following stipulations: 1)The development of the subject property shall substantially conform to the proposed site plan. 2)The final landscape plans should comply completely with the Apache Junction City Code,Volume II,Land Development Code,Chapter 6,Article 6-1, Landscaping and Screening Requirements,and all amendments thereto.All plants need to be drawn at their mature size. 3)The landscape site plan needs to show street pavement,curb,gutter, sidewalk,any existing vegetation that is to remain,perimeter walls, screen walls,all drainage structures such as scuppers,rip rap,head- walls,retention basins,dry wells and drainage channels.All items should be clearly labeled. 4)An irrigation plan needs to be submitted along with the landscape plan. 5)Retention basins fronting on to streets need to be contoured without long straight side slopes.Plants shall not be located within the base floor level of retention basins. 6)All landscape setbacks need to be adhered to. 7)If a fire hydrant shall be required,said fire hydrant shall be installed and operational before vertical construction may begin. ORDINANCE 1128 PAGE TWO OF FOUR 8)A fire hydrant must be located within 250 feet of the street front of the property and must provide a fire flow of at least 1,500 Gallons Per Minute ("GPM")for a 2 -hour duration. 9)All of the civil engineering requirements pursuant to the Apache Junction City Engineering Guidelines as adopted by City Council Resolution No.95-16 and Ordinance No.932 will apply to the project including,but not limited to,topography,grading and drainage,street improvement plans and a drainage report. 10)The civil plans and drainage report are to be prepared by a registered civil engineer with the State of Arizona in accordance with the Engineering Guidelines. 11)CPTED ("Crime Prevention Through Environmental Design")recommendations shall include: a.All bushes shall be trimmed to a height of less than three (3) feet. b.All tree branches shall be trimmed to a height no lower than six (6)feet. c.A light for security shall be placed within the parking lot area. 12)A three (3)foot tall block screen wall shall be continued from the front of the building to the front fifteen (15)foot setback along the north and south property lines. 13)A ten (10)foot wide landscape strip must be placed east of and along the block wall separating the south -side yard and the parking lot. 14)Lots 358,359 and 360 of the Superstition Villa Subdivision,according to the plat of record in the office of the Recorder,Pinal County,Arizona, in Book 12 of Maps,page 39,and later re -dedicated in Docket 430,page 600,shall be combined prior to approval of any building permit. 15)The trash enclosure shall be placed in the northwest corner of the property. 16)The building shall have stucco on all exterior elevations.Roofing material may be asphalt shingles or tile roof material.The front canopy ORDINANCE NO.1128 PAGE THREE OF FOUR of the building must have tile roof material and decorative support columns that could include lodgepoles.Roof material and exterior walls shall be earth tone in color. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
