HomeMy WebLinkAboutORD1123ORDINANCE NO.1123 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING A PLANNED DEVELOPMENT MAJOR AMENDMENT,CASE PZ-01-00,FOR A 2.5 -ACRE,TRAILER HOMESITES BY PLANNED DEVELOPMENT (TH/PD)-ZONED PROPERTY,LOCATED AT 1847 N. IRONWOOD DRIVE,BY AMENDING ORDINANCE NO.120;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL That the conditions of approval of Ordinance No.120,pertaining to the development of the following described property (also known as,the south 2.5 acres of the original Planned Development): The South half of the South half of the Northwest quarter of the Southwest quarter of the Northwest quarter of Section 17,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona;EXCEPT for the West 33 feet thereof; be and hereby are amended and rewritten as follows and as described in case file PZ-01-00: 1)The future land split shall provide for the creation of a 28 -foot -wide Private Access Easement,for ingress,egress and utility purposes,half (14 feet)of which is to be located on the subject site and the other half (14 feet)of which is to be located on the lots directly north of the subject site.Said private access easement shall not become effective unless all affected property owners have signed and had recorded cross access agreements.Said agreements would perpetually allow the neighbors on the south side to drive across the north lots when exiting to Ironwood;and would perpetually allow the neighbors on the north side to drive across the south lots when entering from Ironwood. 2)The Private Access Easement shall be paved and constructed according to ORDINANCE NO.1123 PAGE 1 OF 3 the City Engineer's specifications and according to any other applicable provisions of the Apache Junction City Code,Volume II,Land Development Code,Chapter One,Zoning Ordinance,Article 20 Parking,Loading,and Interior or Private Street Standards,Section 20.0108 Private Access Way Standards. 3)The property owners shall dedicate and improve to the City Engineer's standards any necessary rights -of -way,including but not necessarily limited to,the west 50 feet for N.Ironwood Drive and any necessary cut-off corners.Said improvements may include the provision of curbs, gutters,sidewalks,driveways,streetlights,pavement widening, retention basins or other reasonable improvements required by the City Engineer. 4)The property shall be developed within 24 months of rezoning approval or the Apache Junction City Council may take legislative action to revert the zoning to its former classification according to the provisions of the Apache Junction City Code,Volume II,Land Development Code,Chapter One,Zoning Ordinance,Article 19 Planned Development Zoning District, Section 19.0111.4 Expiration and Reversion of Planned Development Zoning District. 5)Any use or development of said property may be conditioned upon the provision of public improvements,a masonry perimeter wall along the north property line and landscaping in accordance with the provisions of the Apache Junction City Code,Volume II,Land Development Code,Chapter One,Zoning Ordinance,Article 19 Planned Development Zoning District. The provisions of the Uniform Building Code and all other City Codes, policies,guides and standards shall apply and control all design and construction of improvements. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of ORDINANCE NO.1123 PAGE 2 OF 3 competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
