AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,APPROVING A PLANNED DEVELOPMENT
MAJOR AMENDMENT,CASE PZ-9-03,A REQUEST BY HARISH RAI,ON
BEHALF OF APACHE JUNCTION MOTEL PARTNERS,L.L.C.,TO AMEND
THE COMPREHENSIVE SIGN PACKAGE EXCLUSIVELY FOR THE C-3/PD
(GENERAL COMMERCIAL BY PLANNED DEVELOPMENT)ZONED "SUPER 8
MOTEL"DEVELOPMENT SITE,FOR THE PURPOSE OF ADDING AN
ADDITIONAL TWELVE (12)SQUARE FOOT CABINET SIGN TO THE
EXISTING DETACHED PYLON SIGN BY AMENDING ORDINANCE NO.946:
REPEALING ANY CONFLICTING PROVISIONS:AND PROVIDING FOR
SEVERABILITY.
WHEREAS,the Mayor and City Council of the City of Apache
Junction,Arizona,on March 5,1996,passed and adopted Ordinance No.
946,amending the Apache Junction,Arizona,Zoning Ordinance,by
amending the Zoning District Map,City of Apache Junction,Arizona,
changing the zoning classification in rezoning case PZ-7-95 from GR
(General Rural)to C-3/PD (General Commercial by Planned Development):
and
WHEREAS,the Mayor and City Council of the City of Apache
Junction,Arizona,on February 4,1997,approved a comprehensive sign
package for the "Idaho and Superstition Commercial Subdivision"(Idaho
Business Park)more thoroughly described in case file PZ-7-95:and
WHEREAS,on October 28,2003,the Apache Junction Planning and
Zoning Commission voted 6-1 to recommend approval of the Planned
Development Major Amendment request.case PZ-9-03:and
WHEREAS,the proposed Major Amendment,subject to the conditions
set forth herein,enables the use and integration of contemporary land
planning principles in such a manner to promote its most appropriate
use,and further allows diversification in the relationship of various
uses,structures,and spaces.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION,ARIZONA,AS FOLLOWS:

SECTION I IN GENERAL:
That the conditions of approval of Ordinance No.946 be amended for the
purpose of approving a Planned Development Amendment to add an
additional twelve square foot cabinet sign to the existing detached
pylon sign as described herein,and in case file PZ-9-03 exclusively,
the property legally described as follows:
Lot 4,Idaho and Superstition Commercial,according to the plat of
record in the Office of the Pinal County Recorder,Cabinet B,Slide
116,also known as Pinal County Assessor Parcel Number 102-21-042.
The conditions of approval of Ordinance No.946 are hereby supplemented
as follows:
1)All other pertinent conditions of Ordinance No.946 are still in
full force and effect.
2)The detached pylon sign shall remain at its approved height of
thirty-five feet (35').
3)The new attached cabinet sign shall substantially conform with
the submitted elevations,design specification,size,and
content described herein and in case file PZ-9-03.
4)The new attached cabinet sign shall be no larger than twelve
(12)square feet in area.
5)All required permits for sign installation shall be applied for
and approved prior to such installation.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS:
All ordinances and parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY:
If any section,sub -section,sentence,phrase,clause or portion of
this ordinance,or any part of the code adopted herein by reference,is

for any reason held to be invalid or unconstitutional by the decision
of any court of competent jurisdiction,such decision shall not affect
the validity of the remaining portions thereof.

JUNCTION,ARIZONA,THIS 2ND DAY OF DECEMBER 2003.
