COUNTIES,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE,CHAPTER 4,FEES,BY ADDING ARTICLE 4-7 DEPARTMENT OF PUBLIC SAFETY FEES AND REPEALING ARTICLES 4-2 FEES CHARGEABLE FOR BACKGROUND CHECK BEFORE TRANSFER OF HANDGUNS AND 4-3 ANIMAL CONTROL FEE SCHEDULE;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. WHEREAS,Resolution 90-42 was passed by the Mayor and City Council on November 6,1990 which set the non-commercial copying charges for public records at twenty-five cents ($0.25)per page and commercial copying charges at fifty cents ($0.50)per page;and WHEREAS,certifications of public documents were also set at two dollars ($2_00)per page;and WHEREAS,Resolution 90-42 also included copying charges for other public documents in specified city departments;and WHEREAS,the Department of Public 'Safety has been experiencing a heavy influx of public record requests involving police reports,certifications,letters of clearance,photographs,videotapes,crime statistic reports and other miscellaneous documents and materials;and WHEREAS ;.there is a general need for the Department of Public Safety to update its fees for handling public record requests,animal control activities and 'other services,which will result in recovering a higher percentage of its actual material and personnel costs associated with providing such services;and WHEREAS,Chapter 4.Fees,should be amended so all of the Department of Public Safety's fees and charges are covered within the .same article to avoid confusion and duplication, ORDINANCE NO.1195 Page 1 of 6 NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,as follows: SECTION I IN GENERAL Apache Junction City Code,Chapter 4,Fees,is amended by the addition of Article 4-7,Public Safety Fee Schedule,as follows: A.Department,Accident Reports & Computer Aided Dispatch ("CAD")Requests Commercial Non -Commercial Victims of Crime B.Certified copies of Department and Accident Reports C.Photos: 1.3x5 color 2.8x10 color 3.Polaroids 4.8 '4 x 11 color copies sheet 5.8 '4 x 14 color copies sheet 6.11 x 17 color copies sheet 7.Negative duplication D.Cassette Tape E.Video Tape (VCR) ORDINANCE NO.1195 Page 2 of 6 $5.00 for pages 1-20, $0.25 for each page thereafter $0.25 per page no charge $10.00 for pages 1-20, $0.50 for each page thereafter $5.00 each photo $5..00 each photo $5.00 each photo $5.00 each sheet $6.00 each sheet $7.00 each sheet $5.00 each negative $5.00 each $25.00 each,not including outside vendor charges,i f applicable F.Crime Statistics $10.00 for pages 1-20, $0.25.for each page thereafter G.Letters of Clearance $5.00 each H.Compact Dist (AV)$10.00 each I .Compact Disc (Photo)$10.00 each J.Alarm Permit $10.00 each K.Fingerprinting $10.00 each fingerprint card L.Local Records Check $5.00 for each name M.Animal Control 1.License Fees (Dogs) i .Sterilized $10.00 per dog ii.Non -sterilized $18.00 per dog 2.License Fees (Pot -Bellied Pigs) i .Sterilized $7.00 per pig ii.Non -sterilized $12.00 per pig 3.Impound Fee $20.00 per event per animal 4.Board Fee per day $5.00 per animal 5.Kennel Fee i .Commercial Kennel ORDINANCE NO: 1195 Page 3 of 6 $80.00 annually (12 month period) ii.Personal kennel $30.00 annually (12 month period)(plus iii.Late fee 6.Quarantine fee individual fees) license $15.00 (delinquent thirty (30)calendar days from date of examination) $25.00 per animal (Plus $7.00 per day per animal board fee plus applicable license and vaccination fees). 7.Tag Replacement $5.00 per replacement 8.Pick up live Dogs,Cats or Pot -Bellied Pigs $10.00 per event per animal (in -city service only) 9.Disposal for Dead Animals • (For city residents only) I .Dogs $20.00 per animal ii.Cats $15.00 per animal 10.Euthanasia fee i .Dogs $10.00 per animal ii.Cats $5.00 per animal iii.Others $10.00 per animal 11.Vaccinations $10.00 each per animal 12.Animal traps (service for city residents only) ORDINANCE NO.1195 Page 4of 6 $25.00 deposit (10 day usage)with late returns $3.00 per day 13.Adoption Fee and Sterilization Fee for Non -Sterilized Animals i .Dogs $61.00 ii.Puppies (4 months or less)$45.00 iii.Cats $35.00 14.Adoption Fee for Sterilized Animals i .Dogs and Cats (Males)$25.00 ii.Dogs and Cats (Females)$30.00 iii.Others $25.00 SECTION I I REPEAL OF ARTICLES 4-2 AND 4-.3 Article 4-2 Fees Chargeable for Background Check before Transfer of Handguns and Article 4-3 Animal Control Fee Schedule are hereby repealed. SECTION III REPEALING CONFLICTING PROVISIONS t-. - " All ordinances and parts of ordinances in conflict with t.,1,1e, provisions of this ordinance,or any part of the code adopted h'ereih.4:by ,'reference,are hereby repealed. SECTION IV PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance, or any part of the Code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portion thereof.
