HomeMy WebLinkAboutORD1132ORDINANCE NO.1132 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION.ARIZONA.ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP.CITY OF APACHE JUNCTION.ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-03-00 FROM GR (GENERAL RURAL)TO C-3/PD (GENERAL COMMERCIAL BY PLANNED DEVELOPMENT),FOR THE PURPOSE OF CONSOLIDATING AND DEVELOPING FOUR PARCELS INTO A COMMERCIAL SHOPPING AND SERVICE AREA;REPEALING ANY CONFLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map.City of Apache Junction.Arizona,for the parcels of land described as: PARCEL 1 The Southeast quarter of the Northwest quarter of the Southeast quarter of the Northeast quarter of Section 34,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona; PARCEL 2 The Southwest quarter of the Northeast quarter of the Southeast quarter of the Northeast quarter of Section 34,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona; PARCEL 3 The Northwest quarter of the Northeast quarter of the Southeast quarter of the Northeast quarter of Section 34,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona; PARCEL 4 The Northeast quarter of the Northeast quarter of the Southeast quarter of the Northeast quarter of Section 34,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona; ORDINANCE NO.1132 PAGE 1 OF 5 be and hereby are amended from GR (General Rural)to C-3/PD (General Commercial by Planned Development),subject to the following conditions of approval: 1)The Phase I development of the convenience mart/petroleum sales (on Parcel 4)is to conform to the conceptual plan as presented on June 20, 2000,to the City Council and as on file in the Development Services Department. 2)All requirements of the City of Apache Junction are to be met. 3)All fire hydrants shall be installed and operational before vertical construction may begin. 4)An all-weather access lane shall be provided for access to all sides of the building(s)under construction.The minimum dimensions for this fire lane shall be 20 feet wide unobstructed,by 13 feet 6 inches high vertical clearance.This fire lane shall be constructed so as to be able to bear the load of any fire apparatus during any weather. Typically the minimum requirements are 4 inches of compacted high-grade ABC over 4 inches of a suitable sub -grade. 5)The final landscape plans shall comply completely with the requirements described in the Apache Junction City Code,Volume II,Land Development Code,Chapter 6,Article 6-1 Landscape and Screening Requirements,and amendments thereto.All plants need to be drawn at their mature size. 6)The landscape site plan shall show street pavement,curb,gutter, sidewalk,any existing vegetation that is to remain,perimeter walls, screen walls,all drainage structures such as scuppers,rip rap,head- walls,retention basins,dry wells and drainage channels.All items shall be clearly labeled. 7)An irrigation plan shall be submitted along with the landscape plan. 8)Retention basins fronting onto streets shall be contoured,without long straight side slopes.Placing plants on the floors of retention basins shall be avoided. ORDINANCE NO.1132 PAGE 2 OF 5 9)All landscape setbacks shall be observed. 10)Because Goldfield Road is State of Arizona right-of-way,all work within the Goldfield right-of-way shall require a permit from the Arizona Department of Transportation.Improvements shall be coordinated with and installed in accordance with the City Engineer's specifications. 11)A right turn deceleration lane shall be constructed,100 feet in length with a 75 -foot minimum taper,for southbound Goldfield Road right turns onto 28°Avenue. 12)Public right-of-way improvements shall be required in accordance with the City's Engineering Guidelines.The pavement for half streets is to extend 2 feet beyond the street centerline.This will require the owner to obtain a 2 -foot easement from the property owner to the north. 13)Street improvements may be phased to coincide with development of the parcels,except that development of Parcels 1 and 2,as described herein,shall require all of the improvements. 14)28th Avenue shall be an 80 -foot -wide right-of-way,with 40 feet on each side of the centerline.Ten feet of existing right-of-way could be abandoned along 28" Avenue,or the developer has the option to construct the half -street improvements within the existing 50 -foot -wide right-of-way. 15)Hilton Road shall be a 60 -foot -wide right-of-way with a cul-de-sac at the end to serve Parcels I and 2,unless a development plan shows that the street would not be necessary.Twenty feet could be abandoned on each side of the existing right-of-way to provide for the 60 feet of right-of-way. 16)The entry to the proposed convenience store/petroleum sales (Parcel 4) lot is to be located at least 80 feet from the curb return at Goldfield Road (100 feet is preferred),to provide adequate traffic stacking room for traffic onto and from Goldfield Road. 17)All intersections are to have a 20 -foot by 20 -foot corner cut-off dedication. ORDINANCE NO.1132 PAGE 3 OF 5 18)Grading and drainage plans and a drainage report in accordance with the City's Engineering Guidelines shall be required for development of each parcel. 19)Other permitted uses at the US60/Goldfield development shall include craft or hobby shop,barber or beauty shop,delicatessens,restaurants, convenience store,business offices,eye doctor,chiropractor, laundromat,video arcade,office supply store,photocopy store, photography studio,book or music store,bakery,florist,furniture store,sporting goods store,shoe store,veterinarian,pet shop,fitness studio,jeweler and other permitted uses of equal or lower intensity as listed herein;and a car wash be permitted only as an accessory use to petroleum sales or service station;and to exclude particularly RV storage,auto and transmission repair. 20)Developer shall provide extension to the sewer system,however,i f found to be infeasible per applicable Arizona State law,developer shall provide a dry sewer line on site and agree to connect when the sewer is within 200 feet of the property. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
