AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,REPEALING THE DESIGNATION OF CERTAIN LOCATIONS FOR STOP SIGNS IN
THE CITY OF APACHE JUNCTION,ARIZONA,AS PREVIOUSLY AUTHORIZED UNDER
ORDINANCE NO.378;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR
SEVERABILITY:AND DECLARING AN EMERGENCY.
WHEREAS,pursuant to Arizona Revised Statutes Annotated §§9-276,i t is in the
public interest to ensure safe,effective and efficient traffic flow along public
rights -of -way within the City of Apache Junction,Arizona;and
WHEREAS,pursuant to Apache Junction City Code §12-2-4 and 12-2-10 (A)and (B),
the City of Apache Junction may erect and maintain stop signs to regulate traffic
at intersections:and
WHEREAS,Ordinance No.378 was adopted on April 15,1985 by the Mayor and City
Council establishing STOP signs at Northbound and Southbound Cortez Road and
Foothill Street:and
WHEREAS,significant changes in the traffic pattern at this intersection has now
made i t necessary to repeal the warrant for these stop signs.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
1.The following stop sign warrants authorized under Ordinance No.378 are
hereby repealed:
Northbound Cortez Road at Foothill Street
Southbound Cortez Road at Foothill Street
2.The Director of Public Works and the Director of Public Safety are empowered
and directed to initiate appropriate action to remove the stop signs at the
above -noted locations.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
Ordinance No.1135

ordinances,or any part of the code adopted herein by reference,are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,subsection,sentence,phrase,clause or portion of this ordinance.
or any part of the code adopted herein by reference,is for any reason held to be
invalid or unconstitutional by the decision of any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.
SECTION IV DECLARING AN EMERGENCY
The immediate operation of the provisions of this Ordinance is necessary for the
immediate preservation of the public peace.health or safety of the City of Apache
Junction,and that an emergency is hereby declared to exist:and this Ordinance
shall be in full force and effect from and after its passage,adoption and
approval by the Mayor and City Council of the City of Apache Junction,and is
exempt from referendum provisions of the Constitution and laws of the State of
Arizona as provided in A.R.S.§19-142(B).
