AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION,
ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT
MAP.CITY OF APACHE JUNCTION.ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-04-00 FROM
CB -2 (GENERAL BUSINESS ZONE)AND TH (TRAILER HOMESITES
ZONE)TO C-3/PD (GENERAL COMMERCIAL DISTRICT BY PLANNED
DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND
PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map.City of
Apache Junction.Arizona,for the parcel of land described as:
The East 440 feet of the Northeast quarter of the Northeast
quarter of Section 31,Township 1 North,Range 8 East of the
Gila and Salt River Base and Meridian,Pinal County,Arizona;
EXCEPT for the South 33 feet of the Northeast quarter of the
Northeast quarter,as conveyed to the County of Pinal in Deed
recorded May 28,1974,in Docket 748,Page 447;
be and hereby is amended from CB -2 (General Business Zone;the North +/-
890 feet of the property)and TH (Trailer Homesites Zone;the South +/-
397 feet of the property)to C-3/PD (General Commercial District by
Planned Development),subject to the following conditions:
1)The development of the Walgreen's site shall conform to the
conceptual site plan Option 4A,the version dated September
26,2000 (as contained in Case File PZ-04-00).A deceleration
lane to the north Walgreen's driveway on S.Ironwood Drive
shall be provided.A deceleration land to the south driveway
on Ironwood shall be dedicated but not constructed until such
a time as future development on the subject site is begun.

2)All site fire hydrants shall be installed and operational before
vertical construction may begin.
3)An all-weather access lane shall be provided for access to all
sides of the building(s)under construction.The minimum
dimensions for this fire lane shall be 20 feet wide unobstructed
by 13 feet 6 inches high vertical clearance.This fire lane
shall be constructed so as to be able to bear the load of any
fire apparatus during any weather.Typically the minimum
requirements are 4 inches of compacted high-grade ABC over
4 inches of a suitable sub -grade.
4)The final landscape plans shall comply completely with the
requirements described in the Apache Junction City Code,
Volume II,Land Development Code,Chapter 6,Article 6-1
Landscaping and Screening Requirements (Ordinance No.940)
and all amendments thereto.All plants need to be drawn
at their mature size.
5)The landscape plan shall show street pavement,curb,gutter,
sidewalk,any existing vegetation that is to remain,perimeter
walls,screen walls,all drainage structures such as scuppers,
rip rap,head walls,retention basins,dry wells and drainage
channels.All items should be clearly labeled.
6)An irrigation plan shall be submitted along with the landscape
plan.
7)Retention basins fronting onto streets shall be contoured
without long straight side slopes.Avoid placing plants on
the floors of retention basins.
8)All landscape setbacks shall be adhered to.
9)Public right-of-way improvements shall be required in
accordance with the City's Engineering Guidelines.
10)The property owners shall dedicate to the City,the North
56 feet of the subject site for right-of-way and utility
purposes.The property owners shall dedicate to the City,
the East 56 feet of the subject site for said purposes,

from the intersection of Ironwood Drive and Southern Avenue
to the south side of the southernmost driveway.From the
south side of the southernmost driveway to the south property
line,the applicants shall dedicate the East 50 feet of the
subject site.A 20 foot by 20 foot cutoff corner shall also
be dedicated at the inside right-of-way lines of the inter-
section of Ironwood Drive and Southern Avenue.
11)The proposed driveway on Southern Avenue is to align with
the proposed driveway on the north side of Southern,which
will be located approximately 289 feet west of the center-
line of Ironwood Drive.If the driveway on the proposed
Walgreen's site is not directly across from the driveway
to the north,then the Walgreen's drive will have to be
a minimum of 200 feet further to the west of the driveway
to the north.The driveway on Southern Avenue,put in for
the development of the Walgreen's site will have to be
the only access to the overall property from Southern
Avenue.Said driveway is to be shared with future
development that will take place on the subject property.
12)Any driveways located within 400 feet of an intersection
may be limited to right turns only in the future when
concrete medians are constructed for the intersections.
13)The proposed northernmost driveway on South Ironwood Drive
for the Walgreen's development is to be limited to right -in/
right -out turns only.
14)A grading and drainage plan along with a drainage report,
and street improvement plans,including streetlights,water
and sewer plans,are to be provided.The grading plan is
to include the water and sewer service to the building.
15)Half -street improvements are required on Southern Avenue
with a proper taper approach eastbound as shown in Option
4A,subject to acceptance by the City Engineer,and to
include the provision of sidewalks along the entire north
side of the rezoned property.

16)For the purpose of constructing the necessary right-of-way
improvements (including the taper approach)on Southern
Avenue,the property owners shall dedicate to Pinal County,
for roadway and utility purposes,the North 50 feet of
their Sierra Del Saguaro Trailer Park.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions
of this ordinance or any part of the code adopted herein by reference
are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference is for
any reason held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction,such decision shall not affect the
validity of the remaining portions thereof.
