HomeMy WebLinkAboutORD1141ORDINANCE NO.1141 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-00-12 FROM CR-3 (SINGLE-FAMILY RESIDENCE)TO C- 1/PD (NEIGHBORHOOD COMMERCIAL/CONVENIENCE DISTRICT BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcel of land described as: Tract A.APACHE VILLA FIVE,according to the plat of record in Book 19 of Maps,page 62,Pinal County,Arizona. be and hereby is amended from CR-3 (Single -Family Residence)to C-1/PD (Neighborhood Commercial/Convenience District by Planned Development),subject to the following stipulations: 1)The development of the site shall conform to the conceptual site plan and elevations,except as provided herein. 2)Development of the site shall conform to the City of Apache Junction City Code (hereinafter "A.J.C.C.").Vol.II,Land Development Code (hereinafter "L.D.C."),Chapter 1,Zoning Ordinance,except for the following:the allowed uses of the C-1 district,per Sections 16.0302,16.0303 and 16.0304 shall be limited to administrative or professional offices only. any other use shall require a major amendment to the Planned Development; the landscape setback required along 16th Avenue per Section 6-1-5.6.2 and screen wall requirement along the northwest property line as required by Section 6-1-5.0.1 of the A.J.C.C.,Vol.II.L.D.C..Chapter 6,Landscaping and Screening Requirements and the screen wall requirement of the A.J.C.C.,Vol.II,L.D.C.,Section 16.0309.3 of Chapter 1,Zoning Ordinance shall not be required. ORDINANCE 1141 PAGE 1 of 3 3)Developer shall landscape and maintain the right-of-way along the north side of 16th Avenue from the western edge of the project to the eastern edge of the adjacent drainage way where i t crosses 16th Avenue.Said landscaping shall be installed per City standards.The area may be used for the retention and dissipation of stormwater for the project as approved by the City Engineer. 4)Construct a return -type driveway in accordance with MAG Detail No.251 modified for a radius of 16 feet minimum sidewalk ramps in accordance with MAG Detail No.231.Said driveway shall align with existing driveway on the south side of 16th Avenue or offset an appropriate distance as determined by the City Engineer. 5)Provide streetlights along all street frontages at a spacing of 180 to 200 feet per engineering standards for arterial and collector streets. 6)Storm water runoff generated by the property improvements to be retained on -site and dissipated on -site.Project cannot drain into the adjacent drainage channel and must be diverted elsewhere as approved by the City Engineer. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section.subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
