HomeMy WebLinkAboutORD1147ORDINANCE NO.1147 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA.AMENDING THE APACHE JUNCTION CITY CODE CHAPTER 2.MAYOR AND COUNCIL,ARTICLE 2-7,LIBRARY BOARD,SECTION 2-7-5 MEETINGS:REPEALING ANY CONFLICTING PROVISIONS:AND PROVIDING FOR SEVERABILITY. WHEREAS,pursuant to Arizona Revised Statutes Annotated (hereinafter "A.R.S.") §9-414(A),the City Council of the City of Apache Junction has appointed seven citizens as trustees of its public library who preside over the Library Board; and WHEREAS,current City Code §2-7-5 allows the Library Board to meet for regular business purposes on the first Tuesday of each month and for special meetings at other times as the board shall appoint:and WHEREAS,A.R.S.§9-415(A),in 2000,was amended to allow the Board to meet each month of the year for business purposes,and at such other times as they shall appoint:and WHEREAS.i t is the preference of the Board members to convene Board meetings for regular business purposes at times other than on the first Tuesday of each month. WHEREAS.to create this flexibility,the Board has recommended to the City Council that the City Code be revised to more accurately reflect state law. NOW,THEREFORE.BE IT ORDAINED by the Mayor and City Council of the City of Apache Junction.Arizona.as follows: SECTION I.IN GENERAL That Section 2-7-5.Meetings,of the Apache Junction City Code be amended to read as follows: Sec.2-7-5 Meetings A.The board shall establish a regular meeting day and time once a month for meetings relating to regular business purposes.Special meetings may also be called but on an as needed basis. ORDINANCE NO.1147 PAGE 1 OF 2 B.A quorum shall consist of four voting members for the transaction of all business. SECTION II.REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III.PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,clause,phrase,or portion of this ordinance,or any part of the code adopted herein by reference is,for any reason,held to be invalid or unconstitutional by any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
