AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
, ARIZONA,AMENDING THE CITY CODE OF APACHE JUNCTION,ARIZONA',VOLUME II,LAND
VELOPMENT CODE,CHAPTER 1,ZONING ORDINANCE,ARTICLE ENERAL PROVISIONS
AN'XCEPTIONS,SECTION 6.0101 CONDITIONAL USE PERMITS,BY AMENDING SUBSECTION
6.010 5 n ,ALSO KNOWN AS THE "MARKET DAYS"ORDINANCE,IN CASE AM -01-00;
REPEALI ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINCD,BY THE MAYOR AND CITY COUNCIL OF,THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
The CITY CODE OF APACHE ACTION,ARIZO VOLUME II,LAND DEVELOPMENT CODE,
CHAPTER 1,ZONING ORDINANC ARTICLE 6 GENERAL PROVISIONS AND EXCEPTIONS,
SECTION 6.0101 CONDITIONAL US PERMIT.,shall be amended by adding to
SUBSECTION 6.0101(5)(n),under .'DI ONAL USES PERMITTED BY CONDITIONAL USE
PERMIT,a new provision 6.0101(5)(q),which shall read as follows:
g."Outside Vendor"means an per $n who presents proof at a Market Days
event,of being properly license by the City and is not a resident of
a specific park,but whØ is partic*ating in said park's Market Days
event for the purpose f causing th advertisement of or making a sale
at a Market Days."0 tside Vendor"d es not include an individual
selling meat,poultr , ,dairy,seafood,or other perishable products
(frozen or otherwis ),but does includelpe who sells fruits and
vegetables.
SECTION I I REPEALING ANft CONFLICTING PROVISIONS
withAllordinancesandpatsof ordinances in conflict the provisions of this
ordinance,or any pa,ht of the code adopted herein by r4erence,are hereby
repealed.
SECTION III PROVLDING FOR SEVERABILITY
If any section,ubsection,sentence,phrase,clause or portion of this
ordinance,or a y part of the code adopted herein by reference s for any
reason held t o/be invalid or unconstitutional by the decision of 47 court of
competent jurilsdiction,such decision shall not affect the validity\of the
remaining poitions thereof.
