HomeMy WebLinkAboutORD1152ORDINANCE NO.1152 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE,VOLUME II.LAND DEVELOPMENT CODE,CHAPTER 1.ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-15-00 FROM GR (GENERAL RURAL)TO CR-3 (SINGLE FAMILY RESIDENCE ZONE/MINIMUM LOT SIZE 7,000 NET SQUARE FEET):REPEALING ANY CONFLICTING PROVISIONS,AND PROVIDING FOR SEVERABILITY. WHEREAS,on April 24,2001,the Apache Junction Planning and Zoning Commission voted unanimously (6 to 0)to recommend approval of the request for rezoning Case PZ-15-00,changing the Zoning District classification from GR (General Rural)to CR-3 (Single Family Residence Zone/Minimum Lot Size 7,000 Net Square Feet). BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION.ARIZONA,THAT: SECTION I:IN GENERAL The zoning district classification of the Zoning District Map,City of Apache Junction,Arizona,for the parcel of land described as: The Northeast quarter of the Northwest quarter of the Northeast quarter of Section 29,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona, be and hereby is amended from GR (General Rural)to CR-3 (Single Family Residence Zone/Minimum Lot Size 7,000 Net Square Feet).subject to the following conditions of approval: 1)The final development plan shall require a common area for use by the residents that shall provide amenities comparable to.or exceeding,the City's Parks,Open Space,and Right -of- Way Landscape Standards.Turf play areas shall be provided in the common spaces referred to as the central play area and ORDINANCE NO.1152 PAGE 1 OF 3 southwest detention basin.The central play area shall be landscaped to provide for screening and sound protection to all adjacent lots. 2)The final development plan shall require a minimum of three floor plans no less than 1,244 square feet in size and one floor plan no less than 2,000 square feet in size. 3)Architectural treatments will be required for all models and shall be extended to all elevations of the home. 4)Roof treatments shall be designed to ensure that there is no -sea of uniformity"created.The design shall incorporate a . palette of colors that complement the southwestern flavor of the area. 5)All air conditioning units shall be ground mounted. 6)The property owners shall dedicate the north fifty feet (50')of Broadway Road to the City for improvement.Said improvements shall include the provision of curbs,gutters, sidewalks,driveways,streetlights,pavement widening, retention basins,and other reasonable improvements required by the City Engineer. 7)The property owner shall develop and submit,pursuant to the Apache Junction City Code,Volume II,Land Development Code, Chapter 6.Article 6-1,Landscaping and Screening Requirements,landscape plans for the frontage and retention Basins,subject to approval by the Planning Division,during the platting process and the building permit process.Tract "A"shall be enclosed with a solid wall at the western property boundary.Lots that back up to Tract "A"shall have a wrought iron fence across the rear property line. 8)The property shall be developed within 24 months of rezoning approval.or else the zoning may be subject to reversion to its former classification by City Council legislative action. pursuant to Arizona Revised Statutes Annotated (A.R.S.) 9-462.01. ORDINANCE NO.1152 PAGE 2 OF 3 9)All construction shall be done in compliance with all applicable codes and ordinances as adopted in the Apache Junction City Code,Volume II,including,but not limited to. the Zoning Ordinance,the Uniform Building Code.Engineering Guidelines,and the Uniform Fire Code (including,but not limited to,the provision of fire apparatus access roads,the marking of fire lanes,and the provision of adequate water supplies,sprinkler systems,and fire hydrants). 10)The developers shall pay all applicable development fees prior to the issuance of building permits. 11)On the west side of the subdivision a meandering pedestrian trail system shall be incorporated into the landscape design.
