AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION CITY
CODE VOLUME II,LAND DEVELOPMENT CODE,CHAPTER 1 ZONING
ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF
APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT
CLASSIFICATION IN REZONING CASE PZ-4-01 FROM CR-3 (SINGLE FAMILY
RESIDENCE ZONE) TO CR-3/PD (CHURCH AS A CONDITIONAL USE IN A
RESIDENCE ZONE BY PLANNED DEVELOPMENT);REPEALING ANY
CONFLICTING PROVISIONS, AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION, ARIZONA, THAT:
SECTION I IN GENERAL;
The zoning district classification of the Zoning District Map, City of Apache
Junction, Arizona,for the parcel of land described as:
All that portion of the Northeast quarter of the Northeast quarter of the Southeast
quarter of Section 30, Township 1 North, Range 8 East, Gila and Salt River Base
and Meridian, Pinal County, Arizona described as follows:
COMMENCING at the East quarter corner of said Section 30; thence North 89
deg 50 min 23 sec West, along the East-West mid -section line of said Section
30, a distance of 330.00 feet;
Thence South 00 deg 03 min 07 sec West, parallel to and 330.00 feet West of
the East line of said Section 30, a distance of 40.00 feet to the TRUE POINT OF
BEGINNING:
Thence South 00 deg 03 min 07 sec West, parallel to and 330.00 feet West of
the East line of said Section 30, a distance of 290.00 feet;
Thence South 89 deg 59 min 23 sec East, parallel to, and 330.00 feet South of,
the East-West mid -section line of said Section 30, a distance of 280.00 feet;
Thence South 00 deg 03 min 07 sec West, parallel to and 50.00 feet West of, the
East line of said Section 30, a distance of 330.23 feet to a point on the South line
of said Northeast quarter of the Northeast quarter of the Southeast quarter of
Section 30;
Thence North 89 deg 59 min 40 sec west, along said South line, a distance of
610.25 feet to the Southwest corner of said Northeast quarter of the Northeast
quarter of the Southeast quarter of Section 30;

TRUE POINT OF BEGINNING.
Be and is hereby amended from CR-3 (Single Family Residence Zone) to CR-
3/PD (Church as a conditional use in a residence zone by Planned
Development), subject to the following conditions of approval:
1)A 67' 4" height limitation shall be allowed only for the addition of a roof-
mounted steeple as shown on the elevation dated August 31, 2001,
including the proposed design and color contained in case file PZ-4-01.
2)The property owners shall remove the existing detached steeple
concurrent with installation of the proposed attached steeple.
3)A permit for the installation of the proposed steeple shall be obtained
within 12 months of approval of the rezoning request. A completion date
not to exceed 24 months from the date of approval of the rezoning request
must be adhered to. Failure to comply with this condition may subject the
property to a zoning reversion by the City Council.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed.
SECTION Ill PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion of this ordinance,
or any part of the code adopted herein by reference, is for any reason held to be
invalid or unconstitutional by the decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions thereof.
