HomeMy WebLinkAboutORD1176ORDINANCE NO.1176 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION, CITY CODE,VOLUME II,LAND DEVELOPMENT CODE.CHAPTER 1, ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-7-02 FROM C-3 (GENERAL COMMERCIAL DISTRICT)TO C-3/PD (GENERAL COMMERCIAL DISTRICT BY PLANNED DEVELOPMENT)FOR THE PURPOSE OF ALLOWING THE CONSTRUCTION OF A NEW CHURCH BUILDING WITH A STEEPLE TO A HEIGHT OF SIXTY-FOUR (64)FEET.WHICH IS IN EXCESS OF STANDARD HEIGHT PROVISIONS FOR THE ZONING DISTRICT: REPEALING ANY CONFLICTING PROVISIONS:AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA THAT: SECTION I:IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona.for the parcel of land legally described as: That portion of the East half of the Southwest quarter of the Northwest quarter of the Southeast quarter of Section 27,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County, Arizona,lying north of the north right-of-way line of Old West Highway (formerly U.S.Highway 60,70,80,89). Be and is hereby amended from C-3 (General Commercial District)to C- 3/PD (General Commercial District by Planned Development)for the purpose of allowing the construction of a new church building with a steeple to a height of 64 feet,which is in excess of standard height provisions for the zoning district,subject to the following conditions of approval: 1)A 64 -foot height limitation shall be allowed only for the addition of a roof -mounted steeple as illustrated in drawings ORDINANCE NO.1176 PAGE 1 of 3 dated 12/2/02 and contained in case file PZ-7-02,to include the proposed design and color. 2)A permit for the installation and building safety inspection of the proposed steeple shall be obtained within 12 months of approval of the rezoning request.Failure to comply with this condition may subject the property to a zoning reversion by the City Council. SECTION II:REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION III:PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase.clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
