AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,APPROVING A PLANNED DEVELOP-
MENT MAJOR AMENDMENT REQUEST.CASE ,PZ-7-04,A REQUEST BY
SCOTT LAROSE,ON BEHALF OF 0.S.PROPERTIES,L.P.,TO AMEND
THE PLAN OF DEVELOPMENT OF THE SUPERSTITION LOOKOUT
RECREATIONAL VEHICLE RESORT BY APPROVING A DEVELOPMENT
PLAN AND ARCHITECTURAL ELEVATIONS FOR A 3,500 SQUARE FOOT
CLUBHOUSE FACILITY AND MEETING HALL ON A ±12 GROSS -ACRE
TH/PD (TRAILER HOMESITE ZONE BY PLANNED DEVELOPMENT)ZONED
PROPERTY,LOCATED AT THE SOUTHEAST CORNER OF THE INTER-
SECTION OF SOUTH CACTUS ROAD AND WEST 4TH AVENUE,BY
AMENDING ORDINANCE NO.115 AND ORDINANCE NO.209;REPEALING
CONFLICTING PROVISIONS AND PROVIDING FOR SEVERABILITY.
WHEREAS,the Mayor and City Council of the City of Apache
Junction,Arizona,on November 18,1981,passed and adopted Ordinance
No.115.amending the City of Apache Junction,Arizona,Zoning
Ordinance,by amending the Zoning District Map,City of Apache
Junction,Arizona,changing the zoning classification in rezoning case
PZ-17-81 from GR (General Rural)and TH (Trailer Homesite Zone)to
TH/PD (Trailer Homesite Zone by Planned Development):and
WHEREAS.the Mayor and City Council of the City of Apache
Junction,Arizona.on November 15.1983,passed and adopted Ordinance
No.209.amending the City of Apache Junction,Arizona,Zoning
Ordinance,by amending the Zoning District Map,City of Apache
Junction,Arizona,changing the zoning classification in rezoning case
PZ-27-83 from GR (General Rural)to TH/PD (Trailer Homesite Zone by
Planned Development);and
WHEREAS,on June 22,2004,the Apache Junction Planning and
Zoning Commission voted unanimously (5 to 0)to recommend
approval of the Planned Development Major Amendment request.Case
PZ-6-04,with certain deviations to the Apache Junction City
Code,Volume II.Land Development Code,Chapter 6.Article 6-1,
Landscape and Screening Requirements and certain deviations to

the Apache Junction City Code,Volume II,Land Development Code,
Chapter 1,Zoning Ordinance.Article 20,Parking,Loading,and
Interior or Private Street Standards,particular to this
development as conditioned herein:and
WHEREAS.the proposed Planned Development Major Amendment.
subject to the conditions set forth herein,enables the use and
integration of contemporary land planning principles in such a manner
to promote its most appropriate use,and further allows diversification
in the relationship of various uses,structures,and spaces.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA.AS FOLLOWS:
SECTION I:IN GENERAL
That the conditions of approval of Ordinance No.115 and Ordinance No.
209 be amended for the purpose of approval of a development plan and
architectural elevations for a 3.500 square foot clubhouse facility and
meeting hall as described herein,and in Case PZ-7-04.The property is
legally described as follows:
(PARCEL I)
Northwest quarter of the Southeast quarter of the Southeast
quarter of Section 21,Township 1 North,Range 8 East of the
Gila and Salt River Base and Meridian,Pinal County,Arizona:
Excepting there -from any portion lying within the parcel as
conveyed to the City of Apache Junction in Docket 1091.Page
42,and re-recorded in Docket 1124,Page 349.
Also known as Pinal County Assessor Parcel Number 101-22-020A.
AND
(PARCEL II)
A Portion of the South half of the Northeast quarter of the
Southeast quarter of the Southeast quarter of Section 21,
Township 1 North,Range 8 East of the Gila and Salt River Base

as follows:
Beginning at the Southwest corner of the South half of the
Northeast quarter of the Southeast quarter of the Southeast
quarter of Section 21:

said South half,Northeast quarter.Southeast quarter.Southeast
quarter:
Thence North 89°45'31-East,160.00 feet along the north line
of said South half,Northeast quarter,Southeast quarter.
Southeast quarter:
Thence South 04°17'57"West,331.05 feet:
Thence South 89°45'50"West,135.00 feet along the south line
of said South half,Northeast quarter,Southeast quarter,

Beginning at the Northwest corner of said North half of the
Southeast quarter of the Southeast quarter:
Thence North 89°45'12"East along the north line of said North
half of the Southeast Quarter of the Southeast Quarter,a
distance of 660.61 feet to the true point of beginning:
Thence continuing along said north line,being a bearing of North
89°45'12 -East,a distance of 210.00 feet:

The conditions of approval of Ordinance No.115 and Ordinance No.209
are hereby amended and supplemented as follows:
1.The final development plan shall substantially conform to the
submitted conceptual elevation,floor plan and site plan.The
final development plan shall substantially conform to the
submitted site plan showing one 3,500 square foot recreational
meeting hall,food warming,and dining areas located on four
discontinued recreational vehicle spaces.
2.Pinal County Assessor Parcel Numbers 101-22-018A,101-22019A,and
101-22-020A shall be combined prior to permit issuance.
3.Developer shall remove the off -site billboard/directional sign
located on Pinal County Assessor Number 101-22-18B.
4.All construction shall be done in compliance with all applicable
codes and ordinances,including the City of Apache Junction
Zoning Ordinance,the Uniform Building Code.Engineering
Guidelines,Uniform Fire Code,and the Landscaping and Screening
Requirements.
5.Developer shall submit with the building permit application a
grading and drainage plan for review by the City and a landscape
plan for review by the Planning Division.
6.Developers shall dedicate and improve,to the City Engineer's
standards,any necessary rights -of -way:both internal and

external to the site,which shall include,but not necessarily
be limited to,curbs,gutters,sidewalks,driveways,street-
lights,and retention basins.
7.All required parking spaces shown on the concept plan shall be
designed and constructed in compliance with Article 20 (Parking,
Loading,and Interior or Private Street Standards)of the Zoning
Ordinance.
8.Developer shall pay all applicable fees prior to the issuance of
any building permits.
9.The recreational facilities shall be limited to park residents
only.Activities such as Market Days,jam sessions,or any other
activity offered to the general public will require the
processing of a Major Planned Development Amendment request.
10.All other conditions of Ordinances No.115 and No.209 not in
conflict with the provisions herein remain in full force.
SECTION II:REPEALING ANY CONFLICTING PROVISIONS:
All ordinances and parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY:
If any section,sub -section,sentence.phrase.clause or portion of
this ordinance,or any part of the code adopted herein by reference,is
for any reason held to be invalid or unconstitutional by the decision
of any court of competent jurisdiction,such decision shall not affect
the validity of the remaining portions thereof.
