WHEREAS, 'pursuant to Arizona Revised Statutes Annotated ("A.R.S.")Sections' 9-2,76(A)(1).. and 9-494(A),cities and towns are authorized. to establish,maintain,-acquire,hold,improve and regulate public parks; and WHEREAS,the City of Apache junction Parks and Recreation Department has experienced a large increase in the use of its parks and recreational facilities; and WHEREAS,the .City's Multigenerational Center will soon be opening and offers weight training equipment, running areas, and other fitness amenities; and WHEREAS,individuals from other communities use the City's facilities. The Director of Parks and Recreation may waive deposits for groups and/or organizations having a historical positive working relationship with the Parks and Recreation Department. SECTION II REPEALING ANY CONFLICTING PROVISIONS All ordinances and part of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section, subsection, sentence, phrase, clause or portion of this ordinance,or any part of the code adopted herein by ORDINANCE NO. 1235 5 OF 6 reference is,for any reason,held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. SECTION IV DECLARING AN EMERGENCY The immediate operation of the provisions of this Ordinance is •necessary for the immediate preservation of the peace, health, or safety in light of membership marketing and August opening date of the Multigenerational Center; and that an emergency is declared to exist; and.this Ordinance shall be in full force and effect from its passage, adoption and approval by the Mayor and City Council of the City of Apache Junction.
