AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION,
ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT
MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-7-05,A REQUEST
BY HABITAT FOR HUMANITY,REPRESENTED BY TANA NICHOLS,FROM
GR ("GENERAL RURAL")TO CR-3/PD ("SINGLE FAMILY RESIDENCE
ZONE.7,000 SQUARE FOOT LOTS BY PLANNED DEVELOPMENT");
REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR
SEVERABILITY.
WHEREAS,on June 28,2005,the Apache Junction Planning and
Zoning Commission voted unanimously 6 to 0 to recommend approval of
rezoning request PZ-7-05;and
WHEREAS,the proposed rezoning,subject to the conditions set
forth herein,enables the use and integration of contemporary land
planning principles in such a manner to promote its most appropriate
use and ensure residential land use densities that are in compliance
with the 1999 City of Apache -Junction _General Plan.
NOW,THEREFORE.BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF APACHE JUNCTION,ARIZONA THAT:
SECTION I:IN GENERAL
The zoning district classification on the.Zoning District Map,City of
Apache Junction,Arizona,for the parcel of land legally described as:
The South half of the Northeast quarter of the Southeast
quarter of. the Southeast quarter of Section 18,Township
1 North,Range 8 East of the Gila and Salt River Base and
Meridian,Pinal County,Arizona,also known as Pinal County
Assessor Parcel Number 100-35-028,
be and hereby is amended from GR to CR-3/PD,subject to the following
conditions:

1)Except as conditioned herein,all standard provisions of
the CR-3 base zoning district apply.
2)Each lot shall be furnished with a front yard landscape
package with plant quantities and design elements in
accordance with Ordinance No.940 and amendments thereto.
3)The required landscape setback along W.Greasewood Street
shall be reduced from twenty feet (20')to five feet (5').
4)Prior to any development on the site,the developers shall
dedicate and improve,to the City Engineer's standards,
any necessary rights -of -way,both internal and external
to the site.Said improvements may include,but are not
necessarily limited to,the provision of curbs,gutters,
sidewalks,driveways,streetlights,and retention basins.
5)The provisions of the Uniform Building Code and all other
city codes,policies,guides,and standards shall apply and
control all design and construction of improvements.
6)There shall be no less .b-lan three housing models.three
elevations,and a variety of southwestern color tones as
defined by the City of Apache Junction.Design Guidelines.
7)Each house shall be furnished with a single car carport
and a nine foot by twenty foot (9'x 20')pre -poured slab
located behind the front yard setback in the side yard
on the carport side of the residence.
8)Carports that are attached to the main dwelling may only
be enclosed for a garage.
9)Heating,ventilation,and air conditioning units (HVAC)
shall be ground -mounted and located behind the
main dwelling.
10)All utility/irrigation/plumbing equipment & hook-ups shall
be located on the side or rear of the dwelling.
SECTION II:REPEALING ANY CONFLICTING PROVISIONS

All ordinances and parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
SECTION III:PROVIDING FOR SEVERABILITY
If any section,sub -section,sentence,phrase,clause or portion of
this ordinance,or any part of the code adopted herein by reference, is
for any reason held to be invalid or unconstitutional by the decision
of any court of competent jurisdiction,such decision shall not affect
the validity of the remaining portions thereof.
